Trial Day 50
Robert Durst stands trial for the 2000 murder of friend Susan Berman. The trial began just before the pandemic in early 2020 and was halted two weeks in. The restart happened on May 17, 2021, with the same jury panel.
The defendant’s wife Kathleen McCormack Durst went missing in 1982. Evidence and testimony would show that Robert Durst killed her, the prosecutor said. The defendant allegedly told Berman it was an accident and asked her for help. She served as his alibi.
Berman, 55, was shot execution-style at her Beverly Hills home in 2000, and the prosecution suggested that it was because of what she knew about Kathleen’s death and disappearance. As defense lawyer Dick DeGuerin would have it, however, Durst is innocent. His client only came across the body, panicked, and fled, he maintained.

This guy practically got away with not only murder, but dismembering his victim as well. As he has said himself” to himself “ killed them all of course….this trial is just an unsavoury spectacle.

Durst gets caught out with his lies but Lewin's questions in response are so convoluted. He just ends up repeating the same question in several different ways but it then loses all the impact of 'catching' Durst out. I hope that the jury saw Durst smiling as Lewin got up. He plays the rambling old man character too well and needs to be asked a few more direct questions. He's being allowed to evade the question and waste too much time. Frustrating to watch!

Instead of moving on after making a point, Lewin beats the horse to death, belaboring a point to distraction. He should give the jury credit for understanding the points he's trying to make and move on. Seems like he watched too many episodes of Perry Mason and wants Durst to crumble. It doesn't happen in real life, at least 99% of the time it doesn't happen.

Some actual direction from the judge would be sooooooo helpful. Like him instructing the witness to answer the actual question would be fantastic, no???!!

I agree. The judge should enforce normal courtroom rules: ask questions without making a speech; answer questions as posed, and don't make a speech instead; object by stating the ground and then shut up, no speaking objections; move to strike non-responsive answers instead of grandstanding; don't disrespect the judge by violating the rules and refusing to acknowledge the judge's admonitions. You don't want a circus? Don't let the lawyers and the defendants be the ringmasters.

He’s wasting time, and as a sadistic person he loves controlling the experience for all involved. If he wanted the jury to be on his side he’d answer the questions.

I have a question for Mr. Durst. If he found her best friend Susan Berman with a cold face why he didn't call to the Police, immediately or got on the street and screaming to the neighbours or stop the cars or anything else is normal in this case. It is not about a friend it is a person down on the floor! What he explains us here, to be or not to be! One think is mandatory in this case:Call 911 or rescue that person.

They did ask him that, and he claimed the phone was not working. When asked why he didn’t go to the neighbors he said, roughly: because I didn’t. I left.

His explanation is ridic. If he came upon his dead friend, and didn't murder her himself, of course he could have called 911 on the phone lying right next to her, but he didn't because he didn't want to be associated with the crime scene. Because he killed his best friend. Who in the history of Earth has reported the death of his best friend by sending a note to the police with the address and the word "cadaver"? Only Bob "Smartest Guy in the Room" Durst.

@@chrispaul6290 I am totally agree with you. This situation could be taken in account by the Jury. It is completely unusual to send a note to the Police for announcement of a cadaver when you know that died person, you pretend that she is your Best friend! It is the main evidence of his crime. Also the reservation of the room at that expensive Hotel where they never gone. And his trips so confuse and without any relation between them, in fact. He declared one in the Jinx and now other. We don't talk about a cake here, it is about a human being, but he is too arogant to respect someone. He rise the voice to the prosecutor in this trial, what we expect from this?

Wish they ask him what if you just given your wife a Divorce? What if he just choked up the funds of the alimony and allowed his wife to live! She’d be rich and a live! But at least all of these others people wouldn’t of had to die and he would of lived a completely different life not on the run! And wouldn’t be on a court stand at the age 78 begging for his freedom! So? Was it WORTH IT Durst???? When you could of just paid your ex wife what she was entitled to?

And still have more money than he could ever spend. Yes I agree with narcissists it is always about control and never being told no. They don’t get left by a woman, they are supposed to be the one to leave!! I have the same issue trying to get a financial settlement from my ex that was decided years ago - I have been separated from him for 17+ years... it’s painful and he could afford to pay the minuscule settlement and let everyone move on, but he just refuses to - control. Pathetic.

Maybe he put his hand over her face to make sure she was dead after he shot her, and she wasn't quite dead yet, and he really did feel one of her last breaths

I was just thinking that. He's not giving the jury enough credit. But on the other hand, I could see how he'd be concerned about covering all his bases just in case. He would be kicking himself for the rest of his life if he gave the jury "credit" and they found him not guilty. Playing, replaying things he said....we get it. Just state the inconsistency and move on. At this point, trying to get Durst to admit the inconsistencies is futile. Ain't gonna happen no matter how many times you replay a clip. All that said, the jury would have to have the IQ of toddlers to find Durst in any way credible. Personally, I think a non-answer from Durst...or when he skirts a question is an answer in of itself (if I was a juror). But I'm not a lawyer so I can't really say Lewin's overkill isn't being done out of necessity from a legal standpoint. Either way, I've over it. MOVE IT ALONG, LEWIN!

He’s very skilled, and I admire his style. He and Martinez are both very unorthodox. That’s definitely what it’s gonna take to get Durst.

Well, All I learned is that Durst is a Liar and was at the scene of the Murder. But the most important piece of evidence I learned was Wiener and Wenier are not the same name . That sealed the deal for me, I am now Convince of my Verdict. .

Judge just informed Durst how to stall through prosecutor questions.. Horrid decision by judge. Years of effort ruined over a couple of days? If Durst freed- blame lies with Judge. Durst manipulative tactics win the trial.

Lewin claiming not to know whether dead people can breathe is the height so far of his wasting the jury's time & playing dumb. Anyone trying to determine whether their friend was dead would check BOTH for whether they were breathing & for body temperature; this idea that he just noticed "her face was cold" & left the house without considering it further is ridiculous. Judge should instruct Durst to answer the questions being asked & not draw out the answers unnecessarily to simple yes-or-no questions. He's sandbagging because he knows that Lewin has finite time left to ask difficult questions.

@Mel D - you're missing the point - durst lied about being at her home & writing that note until he was FORCED to confess. he now still says he didn't write it while in her home, & he doesn't know where he got the envelope & stamp. he testified that he wasn't wearing gloves while there, yet his fingerprints weren't found in the home or on the letter. they proved the stamp is the same kind that she had in her day planner. If there's GSR on that letter it would link him to the shooting & him going thru her stuff at her desk immediately after, wearing gloves.

Old age .. My mom is same age as Durst and could have said something in 2015 and not remember the exact words. This prosecutor needs to move on. I would love to see if he remembers every word he's ever said. All these assumptions and hypotheticals is confusing I think to this jury.

This is complete overkill.What durst meant is that he may not have experienced the breath but he did experience the event.Lewin needs to wrap otherwise he might lose a juror or two if this not already happened..

Yeah, about 90% of lawyers would criticize Lewin's cross-exam style. Lots of "why" questions, lots of open-ended questions, allowing Durst to control the narrative (even though there's plenty of testimony showing how deceitful and devious Durst is). Ask leading questions that box the witness in and/or that force him to reveal damaging information and move on. Most attorneys would have cut Durst to ribbons in three days, tops. But Lewin likes the sound of his own voice, and he wants to prove that he, not Durst, is the smartest person in the courtroom. That's dumb.

The whole nonsense at 39:00 or so is a great example of how Lewin asks questions poorly. He should have asked very simply: “what is it that you have not experienced?”

If prosecutors refused to try cases where the defendant is dying, that would be a license to kill issued to anyone with a terminal illness or a great number of birthday candles.

If I was in this jury I would sure with Durst. Lewins arrogant tone while beating a dead horse is just ridiculous. Any intelligent juror doesn’t need to be put thru this. Asking the same question for 25 minutes
