Retired railroad engineer Terry Rolin’s life savings were seized by the government, but he hasn’t been charged with any crime. Terry saved up cash and kept it in his Pittsburgh home over many years. But when he moved out of his old house into a new, smaller apartment he didn’t feel safe keeping so much in cash savings. He asked his daughter, Rebecca Brown, to take the money home with her to Boston, deposit it into a new joint bank account, and use the money to replace his teeth and fix his truck, among other needs.

Concerned about flying with the more than $82,000 her father had entrusted to her, Rebecca checked online to make sure that she didn’t need to do anything to take the money with her on the plane. She found out that flying domestically with any amount of cash is completely legal. So, she packed the money in her carry-on and headed to the airport.
But she didn’t make it to Boston with her father’s life savings. Her bag was held by the Transportation Security Administration (TSA) after she went through security screening because the money showed up on their X-ray. She was questioned by Pennsylvania State Troopers and then further by a Drug Enforcement Administration (DEA) agent. The DEA agent took the money without charging Rebecca with a crime or arresting her. After making them wait for months, the government told Terry and Rebecca that it wants to take that money for good using a legal process called civil forfeiture.
Terry and Rebecca didn’t do anything wrong. That’s why they are teaming up with the Institute for Justice (IJ) to file a lawsuit to get the money back from DEA. Furthermore, their lawsuit is a class action against DEA and TSA for practices that violate the constitution and are outside TSA’s legal authority. Finally, the individual DEA agent is being sued for damages because of his violation of Rebecca’s and Terry’s rights.

@A-Plus Computer Services While I agree with you the flaw in your logic is cash is untraceable so if lets say it is drug money she is a mule. By the time they do court and all that she has weeks/months to hand off to another say they spent it. Or go on run utilizing cash limited resources is what gets people caught. If you could buy a different car every so often (most old owners forget take plates) stay in nicer hotels that are not scanning ids for cops as a side gig. Thats not to say there is not solutions I would say put a freeze on it BUT require it be accessible for emergency's aka got some car repairs. They pay the person doing repairs ect. As well as require them to be "charged with a crime" to get assets frozen. Probably biggest thing we could do that would stop it dead in its tracks all fines and fees and seizures do not go to collectors. Aka if your city writes you a ticket and fines you 100 dollars for going half a mile per hour overspeed limit. Instead of them cashing the and being hundred dollars richer. Have it go to state general fund. If statetrooper writes you a ticket then it goes to federal government. If its a federal agency doing the seizing put it straight towards the national debt no discretion of use whatsoever. This will make it so instead of making money by seizing property they instead lose money. Discouraging them from this behavior unless it is serious enough to be worth the cost. It will cut down on frivolous policing. Same goes with prisons we need to have policy to prevent profiting twice off taxpayers and imprisoned seriously they charge tax payers then they charge inmates. There is huge incentive to keep prisons full. We need to shift the dynamic my thought is make majority of pay based off recidivism fund prisons to be flexible right now it cost as much to run 1/4 full prison as it does a full one. Better designs and we could make it easier to adjust usage .

Plus in order to remedy the long overdue dictatorship of the banking cartel, politicians, and to throw out the congress men from their seats will require a civil war. They are too comfortable taking bribes, lavish gifts, and conflict of interests while receiving funding within to make unconstitutional decisions.

When I got hired at a retail store I filled out the IRS W-4 form, claimed EXEMPT and did not sign my name on their filthy IRS W-4 form. On the signature line I wrote the words "All Rights Reserved"

The forced taking of money or property without proving it involved in anything illegal should be considered theft. The police do this routinely because they know it will usually cost more to recover it than its value. In many cases the local police departments reap the theft they are legally committing.

It's a civil matter not criminal so the burden of proof is considerably lower. Not enough space to debate the issue here but there is a criteria that should be followed to seize and keep cash. Sadly many agencies are abusing the forfeiture law to please the politicians who count on seized money to supplement their budgets.

I’m a Federal Law Enforcement Officer. DO NOT blindly back Law Enforcement. Even as a Fed every Cop has to prove themselves as a conscientious person to me in order for me to trust them. And 10 other states Bloomberg is heading it up its an unconstitutional bill but their pushing it through the governors claiming it will stop the school shootings n mass murders. In VA you can't own a gun if its clip holds more than 10 rounds and if your gun is capable oh holding more than 10 rounds you may only have a 10 round clip but because some one some where may have a clip that holds more than 10 and is capable of fitting your gun you are a felon and the person that has the clip may not have the gun the clip fits he to is a felon because some one some where there is a gun that the clip does fit. Update: the DEA has chosen to return the money but it would appear they are still going forward with the lawsuit. according to Techdirt back in 2021 the magistrate said it could go forward. God bless everyone.

This is so fucked up. I've heard of stories like this where cops pull people over and take their life savings and use the excuse that it could be drug money. I really hope this woman got her money back PLUS SOME! They definitely would deserve it- with her and her father having to deal with this shit and be broke and not able to pay bills, not able to get the medical treatment he needs (with his dental stuff), and getting late fees and fines and stressing like crazy over that shit.

I’m a full time ebayer and reseller. It’s a cash business. I get pretty nervous because I routinely carry $1,000+around. I’m not scared by the thugs in society, but I am petrified of the thugs that work for the police. Our local law enforcement would steal any amount, and to make sure it stuck, they would gladly charge you with a slew of crimes.

The drug war mostly works like prohibition did, creating a degree of scarcity, keeping prices high and the income of the criminal organizations very high. Guess how many political campaigns were financed by drug money? You'd have to guess because everyone who has contributors from the illegal drug trade lies about it or covers for someone who lies. Civil forfeiture just gives law enforcement and the DEA a chance to profit from the hysteria, though NOWHERE NEAR on the scale that political leaders and bureaucrats do.

The supreme court just ruled on this in Feb of 2019 striking down the practice for states and I would assume also on the Federal level. They will lose this suit (which I hope they do) how these laws ever were able to be taken into effect without it being ruled a violation of the 4th Amendment "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated..." is beyond me.

pol2doc Your grandparents remembered the Great Depression, when they closed all the banks, all deposited money was lost and the government seized all property in every safe deposit box in the country. I saw a very small article in the San Diego Union Tribune in the 1980s on a back page that said they had started looking for the owners….so if you put it in a bank you lose it, and if you don’t you lose it. But the new strategy, of course, is to destroy the value of anything regular citizens have with ridiculously high inflation, a shell game they played on a lower level continuously before the last 18 months. If my social insecurity matched what I put in starting at age 15 in the value of dollars then, I’d be semi wealthy.

There are two courses of action needed here. First, the war on drugs must end. That would immediately put all DEA agents out of business. Second, TSA must be disbanded. Do these two things, and then we'll be on a path to having a free country again.

If you look for the case, it will read "USA vs. $80,000" The government versus the money. As if the money can defend itself.

If there is a court case ie; USA v $80,000.00 the person who had the cash taken from them will appear in court as a claimant to have it returned to them if they make a solid case. In civil cases a solid case means you prove your side of the argument 51% for you. It's called the "burden of proof". In criminal cases guilt must be established as "proof beyond a reasonable doubt".

@@rickweaver7997 oh I know it's not your fault. I just think it's disgusting that they utilize civil court, pushing the burden of proof on the citizen. When someone is sued in civil court it makes sense that the burden of proof is on the plaintiff, not the defendant. It's hard to sue someone for good reason. However in a civil forfeiture case, the citizen, essentially now a defendant in a non-existent criminal case, is saddled with the burden of proof as the plaintiff, with the state being the defendant. They're essentially being told "prove you're not a criminal and you can have your money back." This is of course after the legal expenses which can easily add up to more than the original lost cash, not to mention bureaucratic stalling tactics. Time is money and it can takes months or years to win against civil forfeiture. The entire system is rigged so that most people will simply eat the loss. The state suffers no penalty whatsoever either way, so they have every incentive to just grab the money whenever an opportunity presents itself, confident that most of it will just stay in the state's pocket. Considering the police are armed at the time the money is taken via a bogus system and the threat of death or imprisonment for "resisting" is implicit, how is it any different than some random person with a rifle setting up a check point in a town with a crooked sheriff and demanding a road tax from everyone that drives past? Sheriff gets a kickback so he just lets it happen. If a citizen resists on the spot, highwayman declares self-defense shooting and the sheriff backs him up every time. If the citizen pursues it in court the sheriff relents to keep it out of the papers, but still that checkpoint remains to catch more suckers.
