Debt Enforcement is a very profitable growing industry in the UK. They act on very dubious legal grounds, and get results by making threats, harassing and bullying poor and vulnerable people into paying money they can not afford.
Recently we have learnt about the tragic case of Jerome Rogers, who took his own life because of an almost identical situation, shown in this video.
The guy with the camera was acting lawfully and in a peaceful manner and stopped the enforcement agent taking away a car, that was the lady's only means of earning money and looking after her sick mother. Later that night the lady needed the car for an emergency and a good samaritan passerby removed the clamp without any damage.
The law must change to stop these 'parasite' private Debt Enforcement Companies acting in this way. Or we, The People, must set up local groups to help those being harassed by these parasite private companies. The UK is in desperate need of People Power. Our 'State' encourages debt then makes £billions in the aggressive recovery of debt.
Many cases like this, are not even real debt, but dubious enforcements that border on criminal acts of theft, trespass, threatening behaviour and stalking - this guy was at a vulnerable woman's house for seven hours.
You decide who was in the right and acting in a decent lawful manner.
Set up your local 'Bailiff Action Group' today in memory of Jerome Rogers and all those who have had their lives ruined by debt and dubious parking fines.
Local Councils have much to answer for, in these cases, it is they who very swiftly, without any dialogue with the debtor, sell the debt to the private Enforcement Companies. Things must change.

Set up your local 'Bailiff Action Group' (BAG) today. Set up a facebook page, you only need a few people to be available to go to victims houses and stand on the property between the bailiff and the private property being threateded. It may not end the case but it will give the victim time to take stock of situation and protect their goods from these private parasite companies. Victims can still contest the case at this level as no high court authority has been issued. Cases like this are mainly involving PCNs or Council Tax, and the actions of the 'Private Debt Companies' are over zealous and disproportionate to the original fine or debt. It is morally and legally wrong. Always act peacefully and lawfully, never make threats, in fact, say very little. Never give them an excuse to involve the police. Matters like this are 'Civil' matters not 'Criminal' matters. Matters like this, at this stage, are not backed up by any hight court writ or judge. So it is a legal 'grey area' that the Police do not want to get involved with. In some cases, if the police facilitate the actions of a bailiff, who is acting outside the law, the Police can be assisting an illegal act (a crime) and thus acting outside of their oath to protect the public. Debt Enforcement is big business in the UK, the many multi- billion pound private companies are not regulated by a government body and it's time they were. So, until there is such regulation to protect the poor and vulnerable, we 'The People' should unite and act on mass, to protect each other from these thugs. Your local council is as much to blame, write to your local MP to stop this epidemic of selling minor debt to private companies. Remind them of Jerome Rogers, killed by his debt and by the actions of a debt enforcement company. Power to the People.

High Court Enforcement Officers can be used to enforce county court judgements, available to some creditors were the debt meets the criteria (over £600 and not regulated by the Consumer Credit Act 1974). They have no more power than county court enforcement agents/bailiffs enforcing a CCJ but the fees are more and they can add statutory interest to the debt at 8%. Even where a debt is enforced by HCEOs, it is still the county court which deals with any application to challenge or set-aside the judgement.

I removed one with a angle grinder left it on door step. They returned and picked it up then called the police to say I removed it. Police asked to interview me for alleged criminal damage. It was a voluntary interview which I did not have to attend but I did just for the pure entertainment. They asked me did I remove it as there were no witnesses, I said no obviously 🙄 case closed. Scum bag bailiff was gutted ☹️ and he never returned to my house 😂😂😂😂👏😎

@@stanley2532 just coz someone owes money doesn't mean they don't pay bills, I agree some it is, but that's not the case here. People get behind on payments for all sorts of reasons, it doesn't mean they just outright refuse to pay but a lot of times these companies will send it off to bailiffs for one missed payment without even trying to resolve it with a payment plan.

The clamps top chain goes over the top of the drive shaft behind the suspension leg, taking the wheel off won't release the clamp, you'd have to remove the wheel and separate the suspension leg and drive shaft to get the clamp off, totally possible but 1-2 hour job!

If the car is on private property then you can rightfully remove that clamp, the court warrant is a public warrant, public and private cannot mix

Everybody should carry super glue and use it on every clamp they find . Clamping lasted a day in France because all the locks were superglued .

Thats was just for 'illegal parking' if it happens on say parks that were and are owned by the council, councils are the only organise that can clamp cars with out a court order.

Had my car clamped a few months ago by the DVLA. The driver of the lorry that came back to lift my car told me that they can’t clamp a car on the drive or lift the car if it’s on the drive. He also said remove the clamp and throw it for the scrap man. 😂

Remember 'Traffic Enforcement Control' At Northamton, is not a real court... They are a bulking centre, they stamp paperwork from councils, then pass them on to Private Debt Enforcemnt Companies. Remember this when they knock on your door, they are acting illegally, just act peaceful and lawful, and stand between them and your car. Never let them into you house. Job done.

red Trespass is a civil ,'offence,' not a criminal offence. Therefore the police gave no powers. However, the property owner DOES have the legal right to use reasonable force to remove a trespasser. It only becomes a criminal matter when it becomes aggravated trespass, ie when you ask someone to leave private property and they refuse to do so. Then you can call the pigs and the perpetrators could be arrested if they had no legal entitlement to be on the property. NB, your cars interior is private property. To the above applies to your vehicle as well.

please all remember if a clamp is UNLAWFULLY put on a vehicle it can be LAWFULLY removed - CUT THE CLAMP OFF AND BIN IT IN ANOTHER AREA

I got clamped once , the clamp is now at the bottom of the Thames . Also arrived back at my car on another time to see that a tow truck was about to lift my car, so i jumped in the driver's side and so they had to abandon what they were doing under health and safety regs

They can indeed, the only place they cannot is on private property not owned by the debtor EI a relatives or friends property. it's still possible for bailiffs to seize a car on such private property however they need a special warrant to do so. your home, business or in a public place is fair game. However in this case I suspect his actions were illegal, as it appear he was not a Bailiff.

A 'Warrant of Control' is NOT a 'Warrant of Entry'. He has ZERO authority to enter private property, which includes the driveway.

In case you’re unaware, we got rid of them in Scotland ages ago. I can’t remember how it was done, but I think there was a law change here after multiple enforcements went badly wrong for the agents, and it persisted. Much in the same way as the tables were turned on those who attacked Glasgow Airport. They were severely beaten up while on fire, and as a direct result, there hasn’t been another terror attack attempted in Scotland since.

I had the same problem with Torbay council some 5 years ago, unfortunately, I had a stupid wife who did not use some common sense, and sit in the car and allowed the car to be stolen with my Trade Tools, and further damaged the car. whilst in the possession of it. I am not either started legalities because I have six years to prosecute the bastards, but I did get the bailiff fired from his job, with Ross and Roberts and through Somerset County Courts, but the war is not over.

Criminal Damage is a chargeable offence under Criminal Damage Act 1971. Not that anyone would prosecute you for cutting the clamp, but you never know.

I can see you removed the clamp and placed it outside against the external wall of the house. You photographed that. You had no legal duty to store or protect that clamp from theft. They left it on your drive so you leave it on your drive. If it goes missing, ie some passing youth steal it....well, it ain't your fault *wink wink*.

Thanks Gerald Thompson, for this, Look up the 'Bill of contracts act ! 1777 ? or Exchange of contracts act! Any private dept collection firm , is chasing monies that have already been written off ! they have in essence bought a dept ! and try to get this money from you. for any dept to be legal ! the two parties must have both signed A CONTRACT ! any dept collecting company must show the contract you signed with them ! or have the contract from the people who you signed the contract with ! but for any dept to be written off ! one part of the contract 'legally binding' is forfeited ! in a nut shell ! they are trying to chase money that they have no real chance of getting , they have bought the dept at their own risk ! Always ask to see a copy of the contract you have signed !which makes it legally binding ! they will NOT and can Not show it to you ! because for a dept to written off that contract is nul&void

What you say about debt collection companies is true, but If they're unsuccessful in collecting the debt they can go through the County Court, if they win they ask for the debt (plus costs) to be enforced. The debt collection company cannot enforce the debt, if they start bullying you, you can call the police. The validity of all this business about contracts will be decided by the court. The County Court may do the enforcement, but it takes time and is not always successful. The creditor (eg debt collection firm) can transfer the matter to the High Court for enforcement. This is where the enforcement agents that you see on the telly appear. They will have a warrant issued by the High Court which sets out what they can and can't do. There are criminal offences (and the police can be involved) if you obstruct them, assault them or damage their property, or if they break into your property, assault you and so on. How do I know this? Experience from both sides of the fence. Money Saving Expert and WHICH? websites have sound advice on this matter. What was the ultimate outcome?

Well done Sir; people should start getting into the frame of mind, that parking tickets, should be a means of guaranteeing someone's right to move around a place, without hindrances -and I think particularly to all the fragile people, the old, the pregnant, the lesser able - and not a means to some shroud Council to embold their "revenues" often pushing people into a spiral of despair. So, start reclaiming the parking areas subject to unreasonable fees.

Apart from all the BS from this jobsworth 'Enforcement officer' ... just look at the way he left the attached clamp (leaning outwards) between 19:21 and 19:23 - THAT'S seriously dangerous as someone walking past - especially in the dark - could easily walk into it. Surely he could/should be prosecuted for that, under the Health & Safety Act?! Just a thought, potentially for future similar situations, as we need to use all the 'legal' ammunition we have against these thugs!

If I was police officer and I was called to a incident like this, I would only need to call the local court and ask them, did you issue a warrant of control against this person and than I would nick the enforcement agent for 1) wasting police time, 2) aggravated trespass, the penalty is three months inside 3) causing obstruction on a public highway, 4) a fraudulent warrant, trying to obtain money. 5) data protection act of 2018,, 6) unlawful punishment of debtors act 1970.

I cut 7 clamps but unfortunately last one he clamped it and within 20 minutes the tow truck was there i sat in the car they called the police when the police arrive they were bias unprofessional and the told you must pay or they take your car they have a court order i didn't know at the time that there is a rule of exempt goods like if you work with your car (taxi driver) they can not seize it I had to pay

I hope she never paid. There are people from " Beat the bailiff" who can help and tell you what to do. Don't park your car on your own drive without gates. Park it at friends or relatives. A multistorey car park is also a good place. It is too narrow for a tow truck with the ramps.

Everyone will continue to get things wrong until they understand that this situation does not pertain to law, this situation pertains to acts and statute, the court he referred to is a bulk stamping centre and although it's titled as a court no one is tried and there are no courtrooms, just thousands of fake court papers. Don't fall for it, if ever someone knocks on your door ask who they are but never give your name, when they say enforcement or some other stupid word just shut the door.and report a prowler.

Those clamps are easy to remove without damaging them, if you know how to change a wheel. Ive seen one vid where someone removed one without damaging it and then padlocked it to his fence and the police told the bailiff he would either have to pay what the guy was demanding to unlock the padlock, or be arrested for criminal damage when he removes it himself... Or abandon it 😂

You need to secure the wheel clamp to an un-removeable object on the property. Attach a notice on it saying that you are prepared to remove the lock on payment of a fee of £1000 or at a discounted fee of £500 if it is paid within 24 hours. Payment must be by bankers draft only. No company Cheques are acceptable.

Fun fact: if you park a vehicle on a neighbouring drive, the enforcement agency cannot touch that vehicle. (Obviously get permission of the owner of the drive way first)

Incorrect if it’s not on your property they can take it ,if it’s on your private property they can’t unless they are a certified bailiff a repossession agent has no court appointed power unlike a certified bailiff

If you have a car un your name and its put on a neighbours drive way, that is private property and cannot be removed without a warrant for that address. If it is on my drive and they have a warrent for my address it's theirs to take. If it is on a public road or car park they can take it.

Why doesn’t someone organise something. We need to get together and put a stop to fines doubling, and trebling from £48 to £1000,s of Pounds in a matter of weeks!! It’s obscene that we, the People, are letting them get away with it!!

They take the car to cover the debt, but do they ever return the cash difference? They'll get more than 500 for that car so they make a profit on the debt

Perfectly legal to clamp the vehicle if it is on her own property or on public property. I am afraid the bailiff is able to do this and the guy recording has all the wrong information on what the bailiff can and can't do. The car is clamped for potential removal for sale to pay off whatever the debt was. The Bailiff cannot give information regarding the debtor or the debt to to anyone other than the debtor or a representative of the debtor, provided the debtor is present to give authority or signs a letter of authority giving the bailiff permission to speak to that person. Claiming the debtor has not heard anything, but the guy with the camera seems to know it was for a parking charge is contrary. How do you know what the debt is for if you haven't been told? If you want to protect your car from being clamped or removed, park it on a neighbours drive as it cannot be clamped or removed from private property, other than the owner of vehicle's property.

This makes me laugh he has clamped the car but he has got no right . I have had a few clamps put on but now they don't bother coz it cost them too much money especially when I clamp their vehicles.

It's a shake down, since for them NOT complying means NOT asking anyone you know to give you money since their ENTIRE business model is based on intimidating ppl into their families bailing them out NOT collecting their money from the actual debtor who obviously has NO money. This means they threaten to seize all their assets, and tell you they YOU have to prove who owns it. That's a outright lie, in fact, they aren't even allowed to seize your goods unless it covers the FULL debt. Thus they get you onto a payment plan (hopefully something unaffordable) and thus sign a controlled goods agreement which means that you're both PAYING the debt AND they own you're property.

The person who owns the white car, owns it, this bully was contracted from warwickshire county council on a dubious parking ticket... this is the state of the UK, you might be next, time we all set up Bailiff action groups.

Wrong information; first to take the matter to the High Court is not expensive and if the debtor does not heed the writ issued by the High Court then it is quite legal to remove goods from your property to recover the debt and actually take a car and sell it at auction after 7 days to cover the debt. any surplus money from the sale is returned to the debtor. If goods are on finance then they cannot be seized. If you say the goods belong to someone else then the onus is on that person to prove they owns the goods. The judge at the High Court can place any order he wishes on the High Court Writ.

I had this exact same thing. Waited for them to go. The clamp magically disappeared. Had police about a week later looked around my kitchen asked me off I removed it. No. Goodbye. Heard nothing since. 😁

its ok lawmakers, pass another law on top of the 3 million statutes and acts not laws legally not lawfully binding..the people will have to follow it, or we will force them to..just any law really its ok we dont need to cote on it just pass it buy only if we get a backhander and it helps other coorps (i.e corpse dead legal entities) and and if it harms living people that will be better, and attach some moral grounds to it,.. they have no recourse its law cos we say so..see the problem here when i mirror it the other way, only my mirror is true and happening scary, your example hasn't got yet the force of the will of the people , i wonder why..maybe because people are too decent and policy makers are scum bullies to start with to even contemplate the laws that are there to benefit the whole community as long as that community lives like a slave nuclear family and works for us..while we fkn pedo their kids..

Glad we don't live there! When I was single I had sheriffs come to my house & it was an illegal eviction needless to say my ex landlord ended up paying $500 for their services. It's not good here either!!

LEXICO You need a pair of mole gribs to snap the 1inch piece of metal that semi shields the chain were it is welded to the triangle, Also the chain links are quiet small so you need to narrow the end of you're crowbar tip . I have a 3ft crowbar with a narrow tip which takes clamps off quicker than they can put them on,And it's always in my boot . And I always make clamps on my car my property. And then i tell them your clamp is now my clamp ,Cheerio

@@mikekemp9877 So you received a summary county court judgement and your claiming it didn't effect your credit rating.... OK mate... Reality, that's not correct, I've been a mortgage financial adviser for over 20 yrs and if you receive a CCJ, it really does reduce the number of lenders whom will consider providing credit to you and you will find the rates and fees much higher (ie 39.9% for a car instead of 4.99%). It can also cause you to be declined from insurers such as L&V. If a summary CCJ is issued and not settled within 30 days it remains on your credit file for 6 years, unless you are able to set aside via a court application and have the case heard in court, but that costs yet more admin fees so you are much better to file a defence to Northampton County Court and turn up to your local county court on the day and have your chance to win without any further hassle whatsoever. It's alright for people on here to make claims, but I've seen so many CCJ's on credit files courtesy of Northampton County Court, so irrespective of no judges been there, it still screws you up if you ignore.

Those clamps are easy to remove without damage...3 bolts from top of suspension strut...job done...then put your clamp on their clamp and send them an invoice for illegal parking...

I have assisted customers of mine in these matters. It is apparent that all the so called "enforcement agent" is interested in is earning dubious fees. Every case I have acted in has ended up in a debt repayment plan ! Local authorities are the worse culprits. They care little about the individual circumstances of small business and individuals. I have no problem with a legitimate debt being recovered. But in a modern digital age "enforcement agents" are stone age for all but the most extreme avoiders. The courts can attach a bank account or earnings or benefits at a rate that a debtor can afford. The obvious crooks who defraud should be dealt with by the police. No one should have to deal with bully boy tactics.

It's a bad situation to be in regarding bailiffs and debt collectors. The bailiff only has to fart and the fees get added on and the debt increases by stupid amounts. The same as when they enter a property and start listing items for seizure. As soon as they write something down it goes up by hundreds. It should be banned. It should not be allowed to go 100% above the original debt.

But, this is just PLAIN STUPID!!! arriving on a PRIVATE PROPERTY & NO previous warning & sitting outside in their own car for MANY HOURS!!! At LEAST!!! two before even ILLEGALLY clamping the vehicle ( of which ALL the time is on PRIVATE PROPERTY!!! This is TRASSPASSING!!! & to wait ALL DAY.from 7 am to 3 pm is just STUPID!!! All forces have directed their constables not to assist bailiffs/enforcement officers as since 2009 they are no longer members or representatives of the court. There are no judges at the Northampton center, thus making 99% of all warrants illegal.

LOL He put a cheaper lock on it because he didn't want his good lock getting damaged when it got cut off....He knew ya'll would remove it after he left. It's no 'strange reason', it was good thinking on his part....
