What I really want to ask a judge is this. They keep ruling that police aren't required to knew the laws they enforce. But they also constantly scold citizens that "ignorance of the law is no excuse."

@@jondspenthank you for bringing up Uvalde, Tx where 376 law enforcement officers representing Uvalde ISD police, Uvalde PD, Uvalde County SO, Texas Rangers, Texas DPS and US Border Agents stood around chit chatting or hiding behind shields while surely several of the victims lay bleeding out in the subsequent passing of some 76 minutes. Since then all agencies have been pointing fingers and the illustrious Governor of Texas has officially swept it under the rug. I’m please to report there were no law enforcement officers injured or killed by the lone gunman. Officer safety.

So, our rights can be adjusted to meet the needs of someone interpreting how things are "in the current times?" No. Make adjustments to the law or location of open records availability if that is the case. The last thing we want is for tyrants to have the opportunity to set their own restrictions based on "the way things are now-a -days." What's next because of the "current times" excuse? - skin color? religion? funny hats? Arabic headbands? How about wigs and long nails with ghetto language affections? Not so pretty is it?

Most of the time I think filming in public is fine. And I usually agree with the citizens who exersize their constitutional rights. But filming kids at a school would be reasonable suspicion to investigate the motive of the person filming kids.

Nothing more, nothing less; if anything YOU and everyone else should be grateful that he's standing up for OUR FREEDOM AS CITIZENS! These tyrants violated his constitutional rights and took a step further for no reason! They do it everyday when someone tries to exercise our rights! while this is true, in other nations, officers are required to follow set rules and regulations and have knowledge to work in their realm. Something like this happens only in area's where education of officers in the duties and laws to which they are to enforce is lacking. I have seen NUMEROUS videos from the states that an officer gets information and law requirements from the legal council for the town. This type of thing should be a requirement of officers to have a working knowledge or the Constitution, its ability and limitation, and a contact number to a legal council so that they can best serve their communities. @@l.h.3586

I think it's insane that the public expects professionalism and more knowledge of the law from them. You have to look at the root motivation behind someone aspiring to be a police officer. I think as a civilian they feel powerless, and law enforcement is one way to acquire power and authority. No educational requirement beyond a GED, no specific experience.

100% correct, thats why in order to be a officer you should be required to attend training to gain the knowledge. failure to pass the constitutional test should be a immediate fail and retrain for the individuals. Used to, officers had to have certification. Now it seems like they don't have to have any training in the law of professionalism.

Also, it appears, that LEO's reciting and taking an oath to protect, defend, and uphold the Constitution of the United States of America is simply a bunch of meaningless words with no true meaning or actual oath of honor being taken or given. The importance of swearing an oath should be Police Academy's very first day of training. Training on the content of the Constitution so they know exactly what they are SWEARING AN OATH OF HONOR TO UPHOLD.

I do hope that this gentleman followed through with a law suit. @@tacticalmosquito6480 that’s simply not true. He, as her superior, has the obligation to assess the situation and determine what the correct course of action should be. He spoke to the school and they said they would allow him to file paperwork for records requests but were concerned that he wanted it for a child (that’s of no consequence because it can be denied if unlawful). IF this were the case, they could have taken the request and simply denied it if it were for a child BUT he said it was for the principal (which again they can deny based on the subject of the information he’s requesting BUT she as the principal is open to more information than the students). The school confirmed this with her supervisor whilst officer Posey continued to escalate things outside unnecessarily (which is the opposite of what a police officer is supposed to do) to the point of harassment. Her captain SHOULD have de-escalated the situation by moving Posey out of the situation because of her escalation and worked out some sort of agreement between the two parties BUT he chose to ignore laws and instead continue the escalation with a trespass on government property. The captain has the responsibility to keep his officers trained and in accordance with the law just as his superiors have the obligation to the same.

Few years back, I was walking my dog and we went through the parking lot of a public high school. A cop came up and told me I couldn't be on school grounds while school was in session. He didn't ask for ID or anything, but told me I had to leave. I basically ignored him, but when I got home, I looked up the city laws -- so such rule exists. Not sure what his issue was. We were harmless -- just a guy and his dog, and it took us less than 5 minutes to pass through the lot. Guess it made him feel authoritative.

A police officer CANNOT go ask some if they want another person trespassed from their Property. The School Woman DID say she would give up what he was asking for...all she needed was his name, the officer would NOT let him in to give his request and name. Public Property is NOT owned by the School Board or the city...it is PUBLIC. -This IS a location people CAN go into and request information...so he every right to be there. He was NOT causing a disturbance, he just had a camera, which is 100% legal. -The SC has said that "The public CAN record Public Servants in the process of their duty...police or people giving out info about the city/school. The police are the ones that caused the disturbance.

The public servant here knows very well the constitution. It’s the guy and a bunch of people commenting here that are mistaken how that all works. No i.d. No entry. That does not infringe on any constitutional rights. He is free to not show his i.d. And leave without entry. If he wants entry, he can show i.d. and identify himself. Once he identifies himself they can still say no if they have reason. Considering he came with his camera already on rolling, there is a backstory here not presented. His attitude is already a warning sign.

@@Thedrunkenswede1337 That's not what he said. He said soliciting a trespass by the officer is a crime. This means the officer cannot in any way encourage someone to have someone else trespassed. Being trespassed does not mean you are breaking the law. It means once you leave you cannot come back, which would be called trespassing, or violating an order of trespass.

Let's play devils advocate here. Would anyone feel comfortable with "any anonymous adult" randomly showing up a k-12 school for a records request while children are present? Remember, there are 'some individuals' who are legally (and rightfully) prohibited from being on or near school property. Without any ID........how would police know? Just food for thought.

Indeed, an innocent person wouldn't have any problem telling a police officer their name. Only someone with something to hide would hide it. He probably was on some kind of register as a sex pest and was using Auditing as a guise to gaining entry into a school to film children..

If the school DECIDED to keep the records near the kids, well, that is their fault. They could quite easily have placed the administrative office at a location that is not near the children.

Whether you like it or not, it's a public school and our constitutional right. He stated his bussiness and if these bone heads knew anything, they could have simply followed him until his bussiness was concluded. I 100% understand why this is controversial, but we are supposed to be innocent until proven guilty. Suspicion isn't a crime. If you don't like it, put your kids in a private school.

@@claudewest957 Tax payer funds have a cop at most schools during working hours. The cop, if they knew the law, could have simply followed the man "for the children's safety" until he completed is records request. Policy doesn't overrule laws, if your policy is in the way of laws you find a workaround to be lawful.

Short synopsis, man shows up to do a records request, officer goes high and to the left as if it is illegal to even be there to make the request - escalates the situation only to find out the administration never had an issue with him being there or making the request - an officer initiated controversy.
