It's called flipping the script. He does it all the time, like when Donald takes language in a warrant which expressly limits the use of lethal force and claims that it is an authorization of lethal force. Or when Donald takes language in the Presidential Records Act which entrusts the outgoing president with the task of separating personal documents from presidential materials without archival supervision and claims that means he gets to choose which are personal and which are presidential. His claim is that if you aren't watching him like a hawk he is empowered to steal from you. And the judge (Aileen Cannon) is buying his argument.

I am surprised that the jury was not sequestered. I was on a jury in Manhattan and we were sequestered because we were still deliberating. The courtroom was bad enough, but after being taken to one of the "Jury Restaurants" in Little Italy, they put us on a yellow school bus never telling us where we were going. We eventually wound up in a hotel in Staten Island! Then back to court the next morning. We had one hold out that was finally convinced to convict. Later we found out that the man had a long criminal record but they were not allowed to be entered into testimony.

It's very likely that the court had reliable information that someone intended to commit violence or attempted direct jury tampering. They really don't sequester for anything other than a known direct threat to either the jurors or the proceedings.

According to Glenn Kirschner NY law required defence to request that at the beginning of the trial, and they would have had to be sequestered for the whole trial. He also said that it's rarely done in NY except when there is a direct threat to the safety of the jurors. In this case the jurors have been kept anonymous.

Sadly, with the level of division in our country at this moment, I find it hard to believe that 12 people will find any agreement and we will probably see a mistrial due to a hung jury. It's a shame that the documents case didn't go forward...to me that is more of a slam dunk for a guilty verdict.

In Australia, the juries are given the whole transcripts, less sustained objections, they can also look at the videos and audio of what is said on the stand. In other words, they have all the facts available to them. If a trial takes 3 or 6 months, it would be impossible to remember all the important matters from individual witnesses,
