Welcome to today's KZfaq video, where we'll be tackling the topic that has caused confusion and controversy in the industry for nearly two decades: drivers' hours and the use of POA, or Periods of Availability. In this video, we'll shed some light on this important aspect of driver regulations and clarify when to use POA.
When the Road Transport (Working Time) Regulations 2005 was introduced, it was hoped that the confusion surrounding drivers' hours and POA would be resolved. But even after all these years, the confusion remains.
POA is one of the modes selected on the tachograph, represented by a square symbol with a line through it. Used by drivers in scope of the EU Drivers’ Hours Regulations 561/2006, it’s similar to a break, but it does not count towards the working time. It does not qualify as a break under the EU Drivers’ Hours rules, so it will not count towards the required 45-minute break after 4 and a half hours of driving.
In this video, we'll explain why POA exists and what exactly are periods of availability. We'll also discuss when to use POA and provide some examples for better understanding.
Remember, it's important for drivers to accurately record their activity using the appropriate mode on the tachograph. So, let's clear up the confusion and gain a better understanding of drivers' hours and the use of POA.

Many thanks for your videos. My question is - If after arriving at the destination to unload the driver is told there will be a delay of few hours (not told exactly the wait time ) so he has to wait for his turn? Should this be recorded as POA or Other work ? Pls advise.

Hi sivakumars1712, to be able to use POA the duration must be known in advance. To be told of a delay of a few hours is not enough information to meet the rules for POA. Thanks for your kind comment

Hello, hope you can help, been watching lots of your videos and revising for my exam, can’t get my head around a practice case study, It says a ltd company run by a sole trader is selling up to a new partnership. My question is, what is the correct procedure for the operator licences currently being used by the ltd company. Is there anything else that would need to happen in this scenario Thanks in advance.

Hi @demdriver, thanks for messaging. With respect to an Operator Licence it depends on the company entity as to what happens. For a sole trader or a partnership, an Operator Licence is issued to the named persons on the application. This licence is not transferable, so if the 'Company' was sold, the new owners would have to apply for a new Operator Licence in their own right, whilst the original holders of the Operator Licence would surrender theirs. However, it is slightly different for a Ltd Company. The Operator Licence is issued to the Company (not the individual directors), so if the Company was sold, it is effectively the directors that are changing. Therefore, providing the Company Name and Ltd Company Registration Number remains unchanged, the Operator Licence remains valid. Companies House and the Office of The Traffic Commissioner will need informing of the director(s) that have been removed and the director(s) that are being added.

@@NTPOnlineLearning hello, really appreciate your reply, cleared a few things up on my mind, I just can’t get my head around how a sole trader can run a Ltd company. Is that allowed.

Good question. If you are in charge of the vehicle, are you still actually working, are you freely able to dispose of your time and are still available to return for work if needed? Moreover, do you know how long the wait for recovery is? If you are told that they will be with you in two hours, you are not required to stay with the vehicle and are available to resume work when requested, then you could arguably use POA for that specific two hour period. You need to meet all the criteria.
