Just received a right to sue letter from the EEOC.. Months of harassment. The first time I made a complaint to HR, I was suspended w/out pay and retaliation constantly followed for 6 months until I was terminated while during 7 weeks of physical therapy

Just remember intimidation is only a scare tactic to cover up insecurities of their own. You can get to the bottom of it by asking them directly about the issues or hang-ups they are having with you directly. It forces them to talk / listen to the nonsense that comes out of their own mouths and makes them self aware of their own behaviors.

I lodged a harassment complaint and then my former employer suspended me and fired me a week later because they claim to have a counter complaint from the person I harassed and ''witness statements'' from witnesses which I know is absolutely false because I kept to myself and never ''yelled'' broke any policies. Everyone has yelled, cursed, and even almost fought and none of these people got fired. I'm a male and most of everyone i work with is female. I have documentation going back a year.

Facts mines coming from all I reported the two that harassed me now it starting to feel like retaliation because now the other employees not really doing anything and I’m being blamed

I paid for a product at my local lowes and when I came with my uhaul to pick up my purchase ( 6 door double door frames) and when I arrived the store managers told me that I couldn’t buy the frame because someone else came and paid more for the frames so they sold to the other customer. The. Store manager also said that I could afford the doors that came with the frames . I told the managers that I didn’t need doors and I just wanted frames and I could have paid for doors but I already have doors for the frames . Then the one manager said “ but you have to get the doors custom build to the frames and I know that you don’t want to pay that much for custom doors. They were questioning my ability to pay for the doors . I was so insulted and note: they were saying all of this in front of customers and staff . The store manager actually told me that my purchase was not enough so we resold my purchase. The two managers also told me that I didn’t have a receipt and I informed them that I did have a receipt . They also didn’t believe that the uhaul on the outside was not mine so. Had to show them the receipt for that as well . The initial store associate that help me pay for the door frames spoke on my behalf and told the two managers that I did purchase the door frames and that he was the one that helped me secure the purchase and when the store associate left the managers said that he didn’t know what he was talking about and that he shouldn’t have sold them to me . Then I replied “ so you do know that I bought the frames then right ?. They insisted that they can’t prove that I purchase the frame , now because they can not fine the purchase in the system . This is after I showed Id , card that I purchased the frames with , and having the store associate proving to them that I paid and I still haven’t been reimbursed for the frame as of yet. There is more to this story. I need an attorney please someone help me get justice . Ps I was treaded so poorly that I start a audio recording of some of this incident. They one manager also started to stated racist undertones as well . I never pull the race card so please understand this was so discriminatory that its basic was monetary and racially motivated. I have filed a complaint to the lowes corporation but still no response from them . Thanks

I am being harassed right now. I 💕 ve on the second flight 🛫 r in my apt complex. And, there's a Caucasion girl living in the third FL or making noise at specific times. When I'm asleep, when I'm cooking. It's becoming a pattern of activity. I'm a a disadvantage because I cannot prove the harassment and it's not in a agency setting. It's being done indirectly; cameras and phones.

An urban legend says HR is evil. Well once they're contacted by the EEOC or your state's agency the legend becomes TRUE and turn on the employee.

Isn't it illegal if a person files a harassment complaint and the harasser files a counter complaint after the fact which is baseless to begin?

It highly depends on the situation. Sometimes there are unwarranted exchanges in the workplace and both individuals become victims. It is however, illegal for a company to retaliate against an employee who files a claim, and then the employer terminates the employee.

I was discriminated against at work and my HR manager told me it’s best to resign. She said she would give me an incentive of 4weeks worth of pay if I resign. I don’t know what to do because I took the offer because I no longer wanted to work for this company no more due to racism. But now i am in need of a job. Please help should i go to the eeoc to file a complaint

This happens frequently when managers try to force people out of the organization because they feel as if it will be the easiest route. They will always double down on their beliefs and ways of doing things. So it's best to find a better place to work. If you stay, it will only get worse, even though you would like to change the scenery, they are not willing to budge.

Hold on hold on it's not that HR makes huge mistakes it's that the defense attorney or the law firm they hired is telling them how to act once they've been contacted by the EEOC. You can say, show all of your accreditations and degrees but they're meaningless once a defense attorney are representing you the company and HR. The law and the legal system are what they've always been and will never change.

I’m a homosexual, a SDO took it upon herself to tell another male employee that I lead attracted to him, making that employee feeling very uncomfortable, and I got called to the MDO office being accused of harassment. Is this something to file an EEO on ?

It's very unfortunate you have to deal with this. Based on what you've shared, it sounds like a hostile work environment. Please document these incidents as they occur. Also, have a secondary confirmation with the MDO to share your side of the situation and assure this isn't something that is being documented and placed in your personnel folder without your knowledge. Reach out to the EEOC for additional guidance because they will furnish the steps you need to take moving forward. They will need to see the documentation that you have tried to resolve this issue and that you have spoken with someone (preferably a manager) to address this. Keep your note pad close because I feel as if it will only get worse.

So how much does EEOC get with the settlement? Does the employee/complainant even get something?

It depends on the situation and the type of discrimination. They will seek lost wages and collect any fines associated with the evidence found during the investigation.

What about if you already have a case but the company is trying to make you settle for pennies?

Getting the case is definitely a huge step. However not all cases will render millions in return. At minimum your income loss should be accounted for and other damages. Always push for more but kudos for catching their attention. They will likely try to pay in effort to make the problem go away. But if they never address root cause; they will be faced with more lawsuits in the future.

Hello, my name is Xavier I work for one of the biggest pest control companies in South Florida. We have a company group chat that our general manager created I am the only African-American in this group chat everyone else is a Hispanic there’s one young man he’s African-American and Hispanic, but other than that everybody else is Hispanic. I’ve been called the N-word in this group chat I’ve had jokes refer to me using the N-word and they just use the N-word constantly and all of our managers are in this group chat I’ve even brought it up to two of the managers what should I do?

Hello, sorry to hear you are having to endure this type of behavior. You would need to file and official complaint with someone in the HR department or directly to your manager. Make sure this complaint is in writing. And make sure you have screen captures & timelines associated with the incidents. If you ever pursue a lawsuit or file an EEOC claim, you would need to show evidence and your efforts to resolve the issue. I know how emotionally charged these events can be, but try to stay calm and state the facts.

@@HRGirl411almost the same situation here .. got called foul term in a group chat for work full of employees . By member of management. And the lead manager defended them . As well as other employees making light of the situation. Went to HR they didn’t really do anything and management kept defending the individual . I ended leaving 1-2 weeks later. Would it be worth it to File an EEOC claim ?
