I think that the Disney lawsuit is just a delay tactic. Remember that Bob Iger is supposed to be gone from his CEO position rather quickly. So as long as Disney gets to keep its special district perks till Bob leaves then he is good with that.

@@owenbowen1090 Dubious and bizzare? He's said it many times this is a niche are of law, that he happened to practice. That's not uncommon. There are many lawyers (like Legaleagle who isn't even licensed to practice in Florida, and on his on firm lists his is practice areas as "business strategy, TELEVISION, FILM, & THEATRE, DIGITAL MEDIA & TECHNOLOGY, soooo I question how much he actually knows about this subject area ) who are broader based generalists. Problem is sometimes those generalist, forget that's what they are and feel the need to pontificate on subjects that area more specialized. It's no different than higher a criminal lawyer, who will represent anyone for any crime, vs the lawyer who only (or predominantly) does DUI cases, or sex assault cases.

He should learn a phrase from the military "stay in your arcs" (or just from other lawyers, you don't go to a criminal lawyer for real estate deals or visa versa). Viva Frei is a smart and more ethical lawyer. At least when he is talking about a legal topic, he makes it clear when talking about areas of law that he is not familiar with or practised in. That's how I found @LegalMindset, because Viva and Barnes were talking about this issue, both were like this is actually a very complicated/niche area of law, and Barnes mentioned he talked with Andrew...now here I am. I am curious if it is actually against Bar ethics/standards to give opinions like legaleagle has done considering this isn't his stated area of practice or the fact he's not even licensed in Florida.

If Walt's dream for the city of tomorrow had become a reality in the late 1960s early 1970s the district would look like the Pullman district in Chicago or Gary, Indiana. I hold Roy Disney in high esteem for building something of lasting value in central Florida. The last thing I want around a resort is residential housing

@michaelconners7668 Who knows, could be very much correct, or it could look akin to many other Florida planned communities like Seaside, Coral Gables or even the Villages. There would also be insane restrictive covenants on the land, thats guaranteed. Roy Disney and successive CEOs did choose the most profitable route, no doubt about that - but they also mislead the legislature regarding their intentions. They made a mistake to not include a sunset clause within the legislation which dissolved the district within a certain period of time if no residential community was constructed

@@LegalMindset People and corporations have the right to order their affairs. So Disney ordered its affairs. They thought they were smart. But they're not so smart. Disney should have gotten out of the special district business in the 1980's. The cost of the district today for Disney is that it has a shadow on its title for its most valuable asset, the Walt Disney World Resort, From what I understand Walt's plan for the city of tomorrow was along the lines of a paternalistic company town like Pullman and Gary. The people who worked in the city of tomorrow were going to live in the city of tomorrow. Walt wanted the city to have six million residents. That sounds like a Detroit or a Chicago just waiting to happen in central Florida. Do the people with their cottages work in Seaside?

I think you're right. DeSantis is hounding RCID issues when I THOUGHT the point was teachers overstepping their boundaries with children and protecting them. How is this helping? Chapek is the person who made the comments and he's out. So why is DeSantis like a dog with the (now incorrect) bone?

I have known avout RCID for years, however didn't care. Once I saw that they were trying to politically interfere, I saw a problem. This timeline truly shows just how messed up the RCID was. I didn't know almost any of the things presented beforehand, so thank you for informing me.

The deannexing of Celebration seems to be their most blatant move to preserve the RCID. Or maybe the trailer parks? But, I am sure the vast majority like me are just now becoming aware of their existence and purpose. To me, the true show of Disney Corp 's character is. The underhanded, manipulative attempts to hold onto something that they knew they did not rightfully posses. It is this kind of continued malfaesance and viscious defense of the dishonorable behaviour that, causes me to dismiss these companies constant virtue signaling. Maybe I am old school? But, if you haveto be forced into an honorable action? You have no honor.

@@kennethbartlett4836 the tourism benefits are effectively locked in. The state already has what it wants. Disney can't change course on Disney World without stabbing itself in the chest. The interests of the Central Florida Tourism Oversight District are still aligned with Disney; the mouse just doesn't have them in its pocket any more.

Might want to take a look at the diversity equity and inclusion of Celebration , Florida. It's probably not a sunset town, but not by much. Now Bay Lake and Lake Buena Vista are a different story.

This is incredibly helpful, Andrew. I knew that Florida and that area in particular hadn't really been happy with Disney for a while, but what I could never figure out was why they'd make a deal that seemed to be so much in the Mouse's favor to begin with. Very modern Disney-esq to be given leaway to make one thing and then do something else entirely and then still demand to be given everything they asked for despite not upholding their end of the bargin.

first read about the way disney acquired land in florida in a book called 'inside the mouse', which is a pretty good read--at any rate, they were basically super underhanded and scummy about it--especially when epcot ended up being another theme park and not a planned community that walt was interested in creating. your usual sneaky corpos.

Good video, but there is one element you left out. It is the moving of Disney Corporate jobs to lake Nona Complex… these people in California who did not want to relocate were the group most vocal about the don’t say Gay Bill…. Opposition in Florida was limited… did these people create drama to prevent them from being forced to relocate… you decide… but this was an important catalyst that started this all.

Shouldn’t the Federal case be dismissed from being moot since both the state and board declared the development agreement and restricted covenants are void? I’m surprised there’s no countersuit. Shouldn’t the state and board file to have the case dismissed in Federal court and to request it be resolved as a state matter? Thank you professor for the education.

They will file to stay the federal case until the conclusion of the state case. Then they will file for dismissal based on lack of standing once the contracts are confirmed void by the state courts.

There IS a state case, to be clear. I covered this. The Federal case will either be 1) stayed or 2) dismissed without prejudice (allowed to be refiled). Once the state case rules in the new District's favor (Disney will 100% lose the state case), the federal case (whether stayed or dismissed) will lack standing.

Andrew, you keep saying in your videos that Disney lawyers crafted a poor legal argument because they don't understand FL property and special district law, so how likely is it that state lawyers will show command of such laws, as you do? I would hope any FL state attorney would know these laws as well as you, but as you say, most lawyers specialize.

No, governmental actions are legitimate for any possible reason except if they are labeled "arbitrary and capricious". This would require there to be absolute ZERO reason for disbanding RCID except pure hate. Clearly there are many legitimate reasons for altering RCID into the present district.

@@LegalMindset true, but does Disney have an argument that a law not enforced for 50 years is a pretext? The history cuts in Disney's favor, not against Disney. Of course, any pretext argument is a tough road to hoe.

Just making discussion. Not a legal person. Should have it been revoked years ago? Yes. Was the legislature previously inclined to do so? Who knows. Use obi-wan/anakin line about evil and retaliation. But if you really want to dig into the history it is a long massive SEC falsification case against Disney. They have for years stated that RCID is not Disney. But Disney ran it and used it for it's primary benefit. Even have their chief legal consul as the primary for RCID. Did people massively fail on enforcement? Yes. Should people have caught the legal consul shenanigans? Yes. But it is now not then. Their arguments are thin and would have to get the most insane judge to win. Ie one who thinks companies should have more power than the government

@@RabbiTzviHirshGoldsteinGovernments often wait decades before regulating industries or taking specific action - whether through true ignorance, just forgetting about the issue, or because it isn't a top priority. Remember as well that Disney and the District are seperate entities, so the only entity with standing for the dissolution of the district is the District itself, not Disney.

How dare you oppose the Rat’s first amendment right to support grooming and continue to show the incompetence/potential corruption of both their legal council and other “legal analysts” giving their “expert” opinions… I thought you had a different specialty practice? nope the Florida disney deal should have been scrapped when DISNEY failed its end of the deal by NOT building the city the promised.I think Disney should have to pay Florida back pay for the past 40 something years for breach of contract.

@kennethbartlett4836 It was not explicitly in the legislation (which indeed was a mistake) but when examining statutes, we DO look at legislative intent as part of the analysis. Further, the 1968 bond validation case clearly incorporates the concept of a city or at least as an area that will incorporate BOTH residential and commercial uses - not SOLELY Disney use.

I do not agree they said that they would build a city and thus reedy creek was born, BUT once Disney got it's meat hooks City what city we aren't going to build no stinking city! Now that we got what we wanted. Since the reneged on the verbal deal they should have to pay every single person i think 1,000,000 dollars for lying and the POC triple that.
