DID DJI just THUMB THEIR NOSE at the FAA REGULATIONS With the release of the DJI MAVIC MINI 249g Drone? Rules Explained here... Some FAA Rules apply while other laws do not. This video takes a deep look at the current state of regulations under the FAAs control in the US and outlines exactly what is the current state of affairs, for the moment. So is this a Brilliant or Sinister move by DJI, so slyly targeting 249g? What do you think, II'd like to know. Let me know in the comments...

DJI isn’t “skirting” anything. They looked at the law and built a product for those in the market that wanted it. I’m an actual pilot and refuse to register a damn toy to even fly below the trees in my backyard and I am not alone. The FAA rules are out of line and are not the law. They are “rules”. Congress needs to rein the toy registry agency in by the nose.

Your position is absurd and just because you say you are a pilot doesn’t mean you are or a responsible one. Your analogy is like saying I don’t need a vehicle license because I drive my car on my property vs driving on public roads. Yes all air space is FAA jurisdiction but you know there is zero issue flying below your trees on your property.

So soccer balls weigh 410g to 450g and they fly for short periods of time. FAA should, as part of their jurisdiction, start to demand the regulations of all sporting toys that leave the ground. This is only reasonable according to FAA reasoning.

I checked to see if I could get auhtorization if I needed it but could not. So basiclly with the MINI 2 I cannot ever fly in any controlled areas and the FAA stated I would need PART 107 if I was in a zero grid on the FAA UAS map. Thanks.

Thank You and You're Welcome! The registration rules have not changed as of yet but Remote ID continues to plod forward so time will tell. That being said, registration for the mini is not required if used ONLY for recreational use, and if anything close to "furtherance of a business" happens, for hobbyists the pilot needs to be registered once for all drones, for 107 pilots all drones need to be registered individually. Good Flying!

DJI never made a 249g drone to completely evade following FAA regulations as most regulations apply to any and or all drones. They just made a 249g drone so you don’t have to register it with the FAA. You still have to follow drone regulations and laws. You just don’t have to register it. Even though registering is very easy and only $5, it’s still one more thing to do.

Your info on FAA registration is not entirely correct. What you showed was for Part 107 (Commercial) pilots. Only commercial pilots have to register individual aircraft, and they must register ANY drone they use, regardless of size (including the mini). Recreational pilots only need to register themselves, not their individual aircraft, so all of their aircraft will have the same FAA registration number. This means that if you already own a drone above 250g and are registered with the FAA as a recreational pilot, you aren't really getting any benefit from the weight being below 250g aside from it being lightweight to pack around. It's still an amazing value for the price, but it's something to be aware of.
@AlienDrones
@AlienDrones 4 жыл бұрын
Hello, thanks for the comment. For recreational pilots you're correct that the FAA registration is not specific to the drone itself but still required if a UAV exceeds the 250g weight limit and the # must be attached to the drone itself, while mini drones such as the Mavic Mini do not require registration. Of course there are nuances with multiple drones or part 107, but in this shortened, basic review for hobbyists I didn't really intend to cover that much detail. Leave it to the government to complicate things, LOL! Good Flying!

Alien Drones a note non Americans, if your UAS is registered in another country, like Canada, you cannot register the UAS in the USA. YOU WOULD GO THROUGH THE NORMAL PROCEDURE AS THOUGH YOU WERE GETTING A FAA DRONE REGISTRATION NUMBER, BUT IT IS ONLY THEN RECOGNIZED AS PROOF OF OWNERSHIP. Any UAS registered in another country and have a registration number from that country, will effectively void any FAA UAS registration. But as a visitor you must still get the FAA Registration number to show ownership and still post it on your UAS.

@AlienDrones

Thanks for the comment. If you fly for recreation only (no posting any videos that could "further a business") and the mini stays below 250 grams, then no registration or 107 license is necessary. If you post videos to social media, regardless of the weight of the drone, it is considered commercial in nature (someone, doesn't have to be you, could "further a business" with your video). Once it is considered commercial, not only do you have to register but you must have a 107 license to be legal. Hope this helps, Good Flying!

Hello, thanks! You are correct, registration is required once the take-off weight is over 250g so you'll need to register, and have remote ID broadcasting after 9/18/2023. You might want to do them at the same time because once you register you only have a limited time to enter the RID number, or you'll have to register again to be able to add the RID number to the site.

Thanks for the video. I do have a question… you mention maximum height can be greater than 400’ around tall buildings. What about mountains, i live in Washington and some cliff walls are 1000’ feet. Does the 400’ rule change in deep wilderness mountain areas?
@AlienDrones
@AlienDrones 2 жыл бұрын
Hello, thanks for the question! Two things, 1) just want to be sure I emphasize that this was discussing hobbyist rules so now you can only fly 400' above the _structure_ you are close to _if_ you have your part 107 certificate. Recreational fliers cannot fly over 400' AGL regardless of being near a building or structure. So if you fly up to a 1000' skyscraper at 400' AGL, you can look in the window but you can't head for the rooftop. 2) The height rule is AGL, or _above ground level_ and this means directly below the UAV . So if you are on a mountain top, the natural earth at your feet is ground level and you can fly up to 400' above that in uncontrolled airspace. Say there is a cliff and as a hobbyist you fly _out_ over the cliff, at the same elevation you launched, but the ground is now 900' down below the UAV. You are now flying over 400' and are in violation of the height rule. You need to immediately drop the UAV down 500' to within 400' from the ground level below it to maintain 400' AGL max... As a 107 pilot you can fly out 400' (laterally) before you have to drop down to 400' AGL. Hope this helps. Good Flying! 👽🛸

Thanks for the video! Is there anything more specific about the rules about flying over "groups of people"? It's pretty vague. If I am flying a Mavic mini over the water at the beach and there are people in the water, is that a group?
@AlienDrones
@AlienDrones 3 жыл бұрын
Hello, thanks for the question! No worries, so as far as the FAA is concerned it is simple. Do not fly "directly" over a person or people. So what this means is simply do not fly "directly" over a person. If a bunch of people are standing close together, you cannot fly "directly" over the "group of people". The test is this: if you point your camera straight down and there is not a person or persons "directly" under the UAV, you are good to go! Be sure to keep in mind that this is at all times so make sure your entire flight path is not "directly" over a person at any time (I'd keep it at least a few feet away just for a safety factor) and you're golden! Good Flying!

You mentioned on heliports, I know both local hospitals have helipads, although the Air ambulance is based at the airport now (used to be at one of the hospitals). One of the more experienced droners here is also ex-military and ex-helicopter pilot. I live on the other end of the town from the hospitals, and outside the airport radius. This person indicates I should contact the air ambulance service that runs the local Med flight copter, let them know I will be in the air, how long and I will contact them when done. The hospitals are located on the hill part of the city, and I live and fly most my time in the valley, where the hills are probably 200 feet height. DO you think the call is overkill, or should I just listen the him (he is 107 certified obviously) If you want to see the situation, the city is Dubuque, Iowa . Great videos, going to try to view them all or least relative ones. I am recreational only. And I hope they eventually come out with the recreational testings. BTW I am member of the local RC club, but only have had drones, and the AMA field slightly overlaps the airport zones.
@AlienDrones
@AlienDrones 3 жыл бұрын
Thanks for your comments! I'll offer my personal and humble opinion but realize it is just that and of course the final decision is ultimately up to you based on what lets you sleep at night. That being said, I understand the abundance of caution stating that you should contact the local air ambulance service before and after drone flights. While this does seem to be a responsible move on the surface, personally I wouldn't do it. Beyond the absence of any requirements to do so, you as the RPIC are responsible to yield to all air traffic in the airspace, both manned and unmanned, regardless of notification. If you are scanning methodically and aware you'll have no problem staying out of the way. Beyond the reality that most UAVs (especially the Mini) anywhere close will simply be pushed far out of the way by the prop wash or be crushed like a bug, I'd be more worried about life saving efforts that are modified based on your interaction. Do your due diligence, fly alert and responsibly, always have an "escape route" planned and certainly try to be a good neighbor and you'll be good. Hope this helps! Good Flying!

Unfortunately the FAA claims jurisdiction "from the Earth to the Heavens" which means you can not fly, outdoors, at any altitude, even on your own property, if you are in a "no fly" zone. Most of the new UAV apps won't even allow a launch. If you happen to have a model that doesn't restrict it by itself and you do launch, and get caught, BIG, big fines in a NFZ... ☹

As a hobbyist on your private property, as long as there is no controlled airspace, no TFRs and you aren't in any type of national park or protected wildlife area, you should be good to test it out up to 400'! You still need to yield to manned or unmanned aircraft and need to follow all the "flying responsibly" rules such as over people and vehicles, etc. Keep it in visual line of sight and watch out for those branches, wires, antennas, etc. If you have a heart condition I recommend having your medication near as the first drone flight is VERY exciting! I literally had a pit in my stomach until it was back on the ground so keep it close, slow and in a nice open area for the first few flights, you'll thank me later! 😎 Good Flying!

Please define #6 line of sight. Because who can actually see a Mavic Mini after 300 feet distance? If my Mini is 1 mile away at 200 feet height over the ocean, is that line of sight?
@AlienDrones
@AlienDrones 3 жыл бұрын
It is defined as visible with the unaided eye (or the eye of a visual observer), so the smaller the UAV the shorter distance you can legally fly. One mile away does not qualify for sure, especially for smaller UAVs. And before you ask, yes indeed, all those "range test" videos you see on KZfaq are indeed illegal... 😉 Good flying!

In the US, the mini must follow all of the same laws, ordinances and rules of heavier UAVs. The only difference is the registration requirement and even that is only if the flight is completely recreational. Not sure of other countries so in other areas be sure to do your own due diligence beforehand. Good Flying!

Has the registration law changed? Do we have to register it now?
@AlienDrones
@AlienDrones 4 жыл бұрын
Thanks for the question. AT THIS MOMENT if the UAV flight weight is below 250 grams, AND the flight is 100% recreational, AND you are not flying in controlled airspace, AND none of the footage, pictures, or information about the flights controls, footage, or any other aspect of the flight fits within the FAA's definition of "continuance of a business" (which is very broad) then registration is not required. Keep in mind that if you are flying only recreationally then only you, the pilot has to register, not the UAV itself, and the same registration number is placed on all UAVs for that owner. In the future if/when remote ID and/or UTM is implemented then registration will be likely required to fly anywhere but a fixed site (as well as transceiver equipment installed and operating). All other rules and regulations must still be adhered to regardless of registration requirements. Good Flying!

@AlienDrones

Thank you for your kind words! I do try and advance the hobby, it is awesome for sure.. As far as your question here ya go! Registration cannot be transferred. If you registered under the Recreational but now need to be under Part 107, you will need to re-register under the Part 107 Dashboard and you can either leave the Recreational Flyers registration, or cancel it out. NOTE: There will be $5 fee when you re-register. If you are using the UAS for both recreational and Part 107 use, you can register as Part 107 and operate under either Recreational Flyers or Part 107. A Part 107 registration supersedes that of a Recreational Flyers registration. Hope this helps! Good Flying!

@AlienDrones
@AlienDrones 4 жыл бұрын
If you want one, absolutely get one. You can still fly responsibly and follow the rules. I'm probably giving you different advice than most, but if you're excited to get into the hobby, you won't regret stepping up to the Mavic Air 2 right away. In general if I decide to do something I would rather do it well the first time. Don't get me wrong, the mini is very capable both flying and photo/video functionality. If you end up doing something silly and dropping it in the water or something you'll be out much less money. But, you will get less functionality by design and I personally like to use the snot out of my stuff and only upgrade when something dies or there is something that I want to do that my old tech won't do but the new stuff will, so I start out with the good stuff. I always regret when I start out cheap and then I'm missing something, and yell at myself that I should have got what I really wanted in the first place. If you're one of those that like to upgrade every year or two just to get the new stuff and build up a fleet of cool drones, then by all means, get the mini first, fly it and learn how to be a responsible pilot, then in a year or two, if the industry isn't completely locked down, get another. Who knows, maybe the Mavic Air 3 by then... Good Flying!

Question: I own 5,000 acres of land since I own the airspace above my land this would mean that I can fly my drone without restriction over my land? Regardless of weight. Will the FAA come after me if my drone weight is 55.1pounds with no 107 license? Does weight go by gross carry weight?
@AlienDrones
@AlienDrones Жыл бұрын
Unfortunately the airspace, even over your property, is controlled by the FAA so anything in the airspace must follow FAA rules. This is why airplanes and helicopters don't ask your permission to fly over your property, sometimes only a couple hundred feet over rooftops. It is considered public use. Weight is takeoff weight, so any cargo is added to determine the weight class.

I believe that states and local regulations still have to be followed even if you use a drone less than 249 grams/.55lb. I have a question. What about VLOS on these small drones? Any pilot knows that a certain quantity of feet/meters is impossible to locate visually. If the drone is flying at a high altitude (below 400ft/120m) forget it ( DJI fly is the only way to know where is it). You will not see it unless having an eagle eye or has a depredator as VO.

Thank you for your comments! It should be noted that in Canada, the 250g lower limit for registration is explicit and UAVs under 250g are exempt from most of the rules with two exceptions: fly safely and Class F zones, Forest fire NOTAM zones and 5.1 Zones of the Aeronautics Act zones are prohibited. tc.canada.ca/en/aviation/drone-safety/find-your-category-drone-operation (In the section "Micro drones (under 250 grams) and drones that weigh more than 25 kilograms") Apparently, this is a common approach outside the US and the DJI Mini drone is sold internationally. There is a world out there that is not the US. With the Mini 2, there's a special version for Japan that gets the weight down to 199g. I don't see this as "skirting the rules" as this weight class was explicitly created in most countries other than the US, so clearly most govs saw a legit argument for devices like the Mini. The real problem is that the US got their law wrong by creating a class of drone in one section, then forgot they did that in another and didn't include the same range limit.

First at the moment it is illegal, and it's illegal as the camera does not give a 360 view and the drone could be causing a problem with out you even knowing it. A flight for life helicopter comes up from behind the UAV for instance and now has to deviate it's flight path or worse sustains damage, you won't know it as a pilot as you lose situational awareness once you can't see it anymore. Mini drones, nano drones and probably thousands of "toy" drones all fall into this same trap of people believing they are outside the regulations. These have been around for years without the FAA taking particular notice. I wonder if the fact that the Mavic Mini is a higher quality more serious drone will be the thing that triggers a rule change or if its just one more in that long list of drones under 250g.

You only need a part 107 license if you want to sell your photos or videos. You DO need the trust certificate to fly period. Anything about 249g does need to be registered but it only takes 2 min to register it and costs $5. That number can be used for all your aircrafts that are not being flown for commercial. You can add as many aircraft as you want to the registration number.
@AlienDrones
@AlienDrones 2 жыл бұрын
Howdy! Thanks for taking the time to comment! There are a lot of misconceptions about when a 107 certificate is needed, and charging for photos is only 1 of many reasons. It's important to note that the FAA considers _all_ drone flights as 107, unless they meet a very specific set of rules that excludes that flight, not the other way around. If you're interested what types of actions are 107 or not, I just released a video interview I did with pilot institute talking about it: kzfaq.info/get/bejne/d9ZpabVn2sDDqXk.html Good Flying!

@@AlienDrones I did some extra research to ensure I knew the rules. The FAA only considers flights that are for someone other than the pilot of the aircraft a part 107 or commercial flight. If you are flying for yourself or for your own entertainment then you are flying recreationally. Everyone makes flying drones sound very difficult when in reality it is much easier and takes just a couple steps to get in the air. Get your drone. Get your trust certificate. If your drone weighs more than 249g then also get your aircraft registration number. That’s it. As long as you fly for yourself and no others you are golden. If you want to sell your photos or are flying in goodwill for others then you need your remote pilot certification and your part 107 license.

How do you get LAANC approval for a 249G drone that is not registered?
@AlienDrones

Thanks for the question! The short answer is you cannot. The drone must be registered to become authorized in controlled airspace. Good Flying!

Guess what? I used Aloft to request LAANC approval to fly today & it was instantly granted. Class D airspace, Recreational 249G drone. At no time did the app request a registration number. I need to find a video on how Aloft interfaces with the DJI app, I have them linked but there’s a lot I don’t understand yet.

@@dp4racing That's good to know! Maybe something has changed recently, I'll have to look into it. According to the FAA website registration is required to use LAANC even under 44809. Regardless, got your authorization, nice! I'm going to check in with the FAA, see what's different, maybe they updated something. Appreciate the heads up! 👍 UPDATE: I reached out to the FAA and their website is incorrect, you do not need to have registration to receive LAANC approval if the drone doesn't require it. Learn something new every day! Apologies for the confusion!

@@AlienDrones I thought what the hell, I’ll try it & it worked! They sent me a text message with approval & it makes sense they know who is flying where, & they have my name & phone number. I’d like to better understand what info Aloft sends to the FAA. Does it send drone location in real time? Thanks for your great videos, I’m learning a lot!

Are there licenses you can get to fly above 400 ft?
@AlienDrones
@AlienDrones 3 жыл бұрын
Thanks for the question! There are a couple of ways, both require your 107 certificate. Within 400' of a structure you can go 400' above the structure, so if the building is 1000' tall, you can legally fly 1400' AGL. Also, you could apply for a an airspace waiver as well. Again, both of these require 107 certification first, there is no way for a hobbyist to do so legally... Good Flying! 😎

Thank you! I do have more questions, please. Can I post videos on KZfaq if my channel is set up as nonmonetized? Also, I was reading that parks under national parks service do not permit drones but what about parks under bureau of land management? A quick Google search showed me that some areas do allow drones but i guess the safest bet would be to call the office that services that area.
@sunshynff
@sunshynff 3 жыл бұрын
@@LW4816 Yes, you can, but be aware that the FAA recently fined someone that was non monetized for the amount of flight footage they had uploaded, claiming they had enough on their channel that they were "building their brand" which they claim in today's world has a value to it. So just be careful on how much you upload.

I don't own a drone but I've been wanting to learn. I've been looking at the Mavic Mini just because it's better than any Chinese drones on line. Does this mean that I would have to look up laws just to fly in my back yard?
@AlienDrones
@AlienDrones 3 жыл бұрын
Thanks for stopping by! Just a couple of quick points, first, just for clarification the Mavic Mini is a Chinese made UAV as well, but that's not necessarily bad as the do make some great products! But more importantly, absolutely yes, you do have to follow the rules as listed in this video regardless of what drone you get. Doesn't matter if it's the Mavic Mini, a Phantom, Autel, Skydio, a $5000 Inspire model or a cheap toy from the dollar store, if it is in the airspace you could get yourself in real trouble if you don't follow the basic rules. Really, they're not that bad once you take a little time to understand them and know what controlled airspace is and how to identify it, they are mostly common sense. I have a lot of info throughout the channel so feel free to browse, and if you have specific questions (after you do some of your own due diligence first, of course) I'd be happy to answer what I can. It is a great hobby but there are big changes coming in the next few months so make sure you stay in tune with the vids I post here and the FAA Drone zone for changes as they happen. Good Luck and Good Flying! 👽🛸

I have a DJI mini 2 SE on the way and Im not going to lie, Im blown away with what Ive found online involving what it is going to take to get it into the air when it actually gets here. I have my Trust certificate and have joined a CBO even though I didn't have to so I have a set of guidelines to work with as well as support if needed. I do feel that a lot of this is a money grab, how does if you make money or not using the drone have anything to do with safety while flying a drone? If you want to go that route just say, If you put any footage that you shoot with a drone on social media of any kind its commercial use and if it stays strictly on your cell phone, computer or tablet its recreational, and if registration was free regardless of if you had to do it every year or the $5 fee was a one-time fee there would be less issues regarding it. And dont get me started on why a 107 cost $150. You can say that DJI is skirting regs, but I call it a company looking out for the consumers by finding a way to help us get our drones (249g) in the air for free, but still have to be knowledgeable of what we are doing while fling our drones, and if they put some money into their pockets doing it why shouldn't they get their fair share, it certainly works for me!

Hello. I'm also planning to buy the same drone. And I'm confused. I absolutely don't understand. Do I need a license for it? Do I need to register this drone? And what should I do in general? I can't even figure it out. There's a lot of information on the internet. And I'm just lost. I want to fly the drone, I want to take some footage. But I really don't know anything about it. Where should I turn? Who should I pay? Do I need a license? Or should I learn to pilot a drone? Nothing is clear.

@@LFTLstudios If you get a DJI mini 2 se you won't have to register it because it weighs less than 250g. (dont add anything to your drone that would put it over 250g either) as long as you only fly it for recreational purposes, not commercially such as making money with the footage or even doing non charitable for a church, only footage for your personal use, I wouldn't even upload your footage to the internet....keeps you out of trouble. and as long as you fly recreationally you won't need a part 107 license or RID. You will need to take your online trust certificate test, its free and it took me about 20 study time before I took and passed it, just print it out and keep a copy on you when you are flying and find a CBO (community-based organization) "anyone will do" there's like 4 of them and print out their guidelines to have with you so you can fallow there rules when you fly...it sounds like a lot but it's really not. Good luck 🚁and if you need more help down the road just hit me up back on this link!

Hi found this very interesting something you didn't mention and I believe it is the Law in the US that you can not make any money of your video including what you might make on KZfaq. Our laws are far more relaxed then in The US In Canada you do not need a license or to register a drone under 250 gm. The mini 2 actually comes in well under the 249 as they claim I weight mine. I do hold a basic license here as I did fly my Holystone HS720E which is well above that 250 g and a lot more restrictions apply to that then any under the 250. There is only one rule that applies here and with it I can fly in some restricted air space that I can not in fact fly my bigger drone and that's why I bought it. We also can sell all our footage and do not need a license to do that other then that it was interesting, but something I never see added to any of these videos that is unless I just haven't seen it is how does flying in the US apply to people from other countries, example when we come to the US from Canada. We have regulations in regard to that just can't remember them now. Thanks good video

Thanks for your thoughts! The making money criteria is a myth though, being commercial or part 107 has nothing to do with monetary compensation. It's all about "adding value" to yourself, your business or someone else. Growing a non-monetized KZfaq channel by gaining subscribers and likes/views would be considered a 107 commercial operation, regardless of making any money. It's a common misconception, I indeed wish it would be that black and white, it would make things MUCH simpler indeed... Good Flying!
