This is why there are usually small dog sections and big dog sections. I’m not saying she shouldn’t owe part of the bills but no small dog owner should bring their small dogs to play with unknown big dogs. Thats a pretty stupid decision on his part.

There's just too much risk at dog parks, unless you're alone of course. Many professional dog trainers are against them and that says a lot.

@@erinnorwood6124 At the time she was disabled but later she was willing to pay but he wanted it faster. She didn't have 0 income "forever". To pay $100 and not half is her good faith for the damage caused to his dog.

Judge Milian's job when going through law school was identifying forged and fabricated documents. She got paid to be credulous and I've yet to see anything sus get by her.

Plaintiff's parting comment that he would go to that park again, further putting his dog at risk, shows just how stupid and irresponsible he is! A pet owner should ALWAYS maintain control of their pet! I'm so tired of seeing these types of cases where dog "owners" claim to care about their animal and then put them at risk for injury or death because they are so clueless about animal behavior! That goes for stupid cat owners who believe their kitty should be allowed to roam the neighborhood because they think their cat is able to fend for themselves but end up on a posted sign because their cat has disappeared! If you want a pet then be responsible for that animal and recognize that an animal relies on you for care and safety and treat as you would any toddler that depends on a responsible parent!

Because telling someone you’ll do something doesn’t 100% make it enforceable? A verbal agreement can be broken- a verbal CONTRACT cannot, but for it to be a contract both sides have to give up something.

It wasn’t a verbal agreement, she offered to pay half to be nice. But she’s not legally obligated to pay half. She can change her mind on her offer.

Legally she’s not reliable on an off leash park . And the typed evidence kinda got the judge mad I feel he had a good case by just presenting the text of her agreeing with paying half but lying is a big no no.

Depends on the state. Some have strict liability laws which will supercede whatever the local dog park rules are. In any case, her dog has had its one free bite and she'll be liable for any attacks from this day forward.

@@jayburris6252since it's a leash free park then it becomes personal responsibility. Usually it's the owner's fault for not having control of their dogs ie leashed.

I was shocked at the verdict! I thought the defendant was gonna lose the case and have to pay half. I saw the defendant’s face to, I think she was shock to. I wonder since the plaintiff lied about those made up affidavits, that’s why he lost 🤔

Wait a minute I’m confused. If they share the risk, don’t they share the damages 50/50? The defendant admitted that her dog caused the broken arm… isn’t that at least 50/50. It would be 100% if there was evidence of previous attacks. 2nd time I have disagreed with the judge 😢

Depends on the state's statutes. Some require negligence to be demonstrated while others follow strict liability rules. I think the plaintiff knew that and fabricated the "affidavits" to ensure he won. Now that the defendant's dog has a record of biting another dog, she's on notice and will be liable for damages if it happens again. That's why the judge mentioned "one free bite".

Carry a bodycam video when you walk your dog and go to a dog park. There's too many irresponsible dog owners who then lie when something happens.

Don't ever take your dog to a dog park. I have done dog rescue for years, and there is not a chance I would ever take a dog to a dog park. Too many irresponsible careless people

There’s no negligence and that’s why the verdict. Thanks Harvey! Remember they were in an off-leash dog park. That means if you go in with your dog, you are accepting the risk involved. His dog was attacked in the dog park. That was the risk.

I believe JM ruled against him because she was upset she believed the plaintiff was lying about her dog being accused of several other attacks. Once again she ruled off emotions 🙄

She went from I don't recall my dog ever biting another dog in front of JM to hey, dogs sometimes play rough and get bitey and then quickly to I haven't been back to the dog park since this incident because I need to find a solution so my dog can safely play in her exit interview. So what is it, your dog has never bitten or it's too aggressive to go back there?

There two different types of "agreements". One is a contract, and the other is a promise or consent. The former can be enforced while the latter cannot and can be withdrawn at any time.

Dog parks are just accidents waiting to happen. You don't know when you go in what the other dogs are like, so it's enter at your own risk.! I am a little surprised at the decision.

I don't understand the ruling in this case - while I agree that when you put a dog in a situation of risk you assume liability, but the defendant admitted she agreed to pay 1/2 the vet bill, so why wasn't he awarded what was agreed to?

They become a problem when someone lies and says there never was one, but when someone admits to the contract, it is in fact and in law, able to hold up in court. Go to law school, then come back and talk to me. ;)

These animal cases oftentimes involving the negligent owners always touch a nerve. People forget that they should always be under your own personal care and control at all times no matter what. Both litigants were negligent in this case in my opinion. If you can't properly take care of and handle your animals then you shouldn't be allowed to own them! No excuse

@@peezypeeze9140because JM gives Spanish people preferential treatment. The woman made a verbal contract to reimburse the plaintiff via weekly payments. She later changed her mind. She knew that she could not afford the arrangement. The defendant said what she thought the plaintiff needed or wanted to hear.

Hate to break the news to you. All you personally are responsible to maintain the behavior of your dog. If you know your dog attacks, you know you shouldn’t be letting him go in the dog bark so no you don’t enter at your own risk. It doesn’t say that if it’s a designated sign, it says that your dog can’t run without a leash and pick up after your dog if it’s a legitimatecity site it doesn’t sound it but that’s what it would say and don’t say you are the owner of the dog you take full responsibility of what your dog does just like you take responsibility when your children have a problem
