If the officer saw the kid even holding his phone on a public road then entered private property, he has broken the law. That's the sticking point here.

Wrong... for example the Ontario stunt driving law prohibits you from doing a burnout in your own driveway. So no you cannot claim that road laws don't apply on private categorically. EDIT: Case in point after looking it up, all Saskatchewan traffic laws apply to private lots.

This cops abuse of his/her power is just ridiculous. If this is what he/she thinks is a part of their job and not just abuse of power, then they should find another job. In no way was the accused going 2 to 5 km if that in a drive-thru, a threat to society. The accused is only 18, and due to the lose of dermerit points, the above ticket will cost him a lot more then $500 when his insurance finds out. Maybe he should sue McDonald's, for if it wasn't for their app he wouldn't be in this predicament.

Maybe it is different where he is, but here where I live, if a cop were to try this then the cop would be breaking the law. Going by the laws here, this happened on private property and so the cop can't do anything unless the property owner requests it. And obviously McDonalds didn't request for the cop to do anything. Either they have stupid laws there or that cop is on a power trip and should be put in his place.

Did you not notice the one piece of information that isn't specified is WHERE Mason was when he pulled his phone out? I doubt he was in line at the drive thru when a cop came swinging up and ticketed him. Why didn't anybody else get ticketed? I'm sure there were others in the drive thru line with phone in hand and the McDonald's app open. How would the cop even have known someone in the drive thru had their phone in their hand and why target Mason? Do you think he was just randomly patrolling a McDonald's parking lot and picked a car in the drive thru to look into? Here's what I think happened because there's nothing stating otherwise: Mason had his phone in his hand on the road going to the McDonald's to place his order in advance. Just before he turned into the McDonald's, he passed a cop on a motorcycle who had to turn around. Mason proceeded to get in line at the drive thru and the cop came up behind him and issued him a ticket, which I admit he probably didn't have to do, he could have just given him a warning and said just make sure you're in line at the drive thru before pulling your phone out, but in any case the cop still issued the ticket rightfully. The ticket itself says it's for having phone in hand while on a public road. This tells me the cop caught him with his phone in his hand before he turned into the McDonald's. The cop doesn't know where Mason is going, all he knows is he saw a driver with their phone in their hand and needs to catch up with them. I don't think Mason's court battle is going to go the way he's hoping it will if this is the case.

Then you don't agree with the distracted driving law.... no offence but you need to realise the issue here is mainly because how lazy and far reaching and abusive our laws are made. Ofc police judgment is also part here but it goes back to our lazy laws,. A police officer can F your life up if they feel like it and apply laws. For example disturbing the peace, if you have a heated discussion with an officer and their ego is bruided they'll threathen to arrest you for disturbing peace because you "speak to loud".

Fight it He was on private property. And McDonald's coperation should get involved the cop had no juristriction on private business property unless mcdonalds asked for help. A example of abuse and over reach of authority. I can bet you next time a cop goes through a fast food drive through someone might spit in there food.

I wish you'd all educate yourselves... If the cop saw the kid with his phone even just being held on public roads, then turned in to private property, he's guilty of distracted driving. If not, he may get off, that's the point to fight in court.

They can do that too. It's entirely up to the cop. At least in regards to the no electronic devices hands free or otherwise rule for N drivers, the law isn't definitive. So a lot of situational interpretation goes into it usually it's fine, I guess. But you get one D-head like this and suddenly this becomes a question of concern.

Not a lawyer But if this charge was based on private property (AkA McDonalds parking lot) The Highway Traffic Act (HTA) - only apply on roads. They don't apply on any private property - even if that property is accessible to the general public.

It's really stupid. You literally need your phone to pay nowadays. In other words, the phones have Apple Pay and Google Wallet, so it is assumed that it can be used. It's even less dangerous than taking out your actual wallet and manually taking out the money etc etc. It is also private property. I think he is a rookie police officer. It has already happened to me that a rookie police officer gave me an exaggerated fine. Furthermore, it is ageism because it focuses on and assumes that someone who is very young is rebellious, crazy, reckless etc. etc.

I lived in bc and ontario and law does not apply on private property. If this goes through with a conviction, whats not holding the law back when you break the law on your own driveway as it is also private property. I could be holding the brakes in my car scrolling through my music list on my driveway, the law applies there too? 🤨

Not sure how laws work in Saskatchewan but in Ontario you could take this to court and fight it because it was on private property. I was in a car accident (and had a friend also a car accident) in a parking lot like this one and when the police showed up even though it was clear the other person was at fault the police said there was nothing they could do because it was considered private property. So if they can't charge a driver in an accident on private property that can't charge you for texting also.

According to the teen driver he didn’t pull out his phone until he was in the drive through lane. According to the cop he had it out earlier when still on a public street. Who is correct? Do we have bodycam or security cam footage to support either side?

Sounds like there is more to this. If the cop was already behind you, the driver was probably using his phone on the road and the cop followed him into the parking lot

Was the officer on duty while ordering food? If so, would that not constitue him being on a "break"? Maybe there should be an investigation opened on the police officers whereabouts during the day of the incident. You do not have free reign to conduct personal business during your shift as a government employee, check his GPS records and make sure they match up with all patrol and service requests. Any discrepancies should be followed up on. I am concerned about this officers professionalism and conduct.

Assuming that everything happened as it is implied in this video. Maybe it's different where he is, but here where I am the cop actually could not have legally given him a ticket because it happened on private property. If it was here with the laws applied, he would be able to not only fight the ticket (and win), he could also likely get the cop in trouble.

Private property, open to the public. HTA laws apply. You would need a sign that says PRIVATE PROPERTY and deny police officers, who would still have jurisdiction because your license says operate a vehicle with an electronic device, not operate an electronic device WHILE USING PUBLIC ROADS. If you damage your vehicle how is your insurance supposed to know you were obeying all laws? So if you got to the McDonalds then we can assume you have insurance and breaking the policy.

Private land for the public to use. Laws apply. You cannot bait someone into a parking lot then have distracted drivers hit your children. McDonalds 16 year old employee definitely wont enforce it, neither will the company that owns the parking lot (mcdonalds doesn't own the parking lot) So they require police officers to enforce it. I know right!? Police officers caring about children! What a sin!!

@@scambaitspidey3470 I'm sorry, road laws do not apply. A Police officer cannot ticket you on private land. They have zero jurisdiction. Unless the police officer wanted to take it to court as a civilian. In which they would lose.

I'll pull over in the parking lot to use the app, but that's because it's slow. I'm sure the parking lot is legit no cell phone use, otherwise that would let some drunk off the hook in his car with the keys doing the same

Yeeeaaaah but the drive thru isn't that either. If I had to guess, he took issue with the guy letting his vehicle roll while doing it I could see that being unnerving like he wasn't aware of or controlling the vehicle. I dunno.
