Because for the past few years states have removed the need to be insured or have a DL. Especially enforcement of said traffic laws.. Because there are certain demographic factors that claim it is unfair to them. Yet the ones most impacted are the other people and law abiding citizens. I too have been struck by uninsured no valid vehicle license, no drivers license and illegal citizen. I had to pay for my repair and insurance went up. I couldn't even go to court because the driver disappeared.

Hot Take here - In conditions like that the cop really ought to know better than to make a maneuver like that at that spot there. He's not entirely at fault (the driver choosing to swerve into oncoming traffic instead of the ditch) but lights and sirens didn't change the fact that he also was across the double yellow on a two lane highway in the middle of a snow storm with a number of vehicles as potential hazards. During conditions like that there is still a safe or defensive way of driving even if you are LEO responding to a call - driving to the conditions which are clearly not good is one of them. He just assumed that there aren't stupid drivers on the road when there are stupid drivers on the road ALL of the time.

@@peterpontzer4006 yea exactly, the law says cops must also follow all traffic laws unless driving to an emergency but still then they have to drive with the publics safety in mind. There is no point rushing and driving recklessly to an emergency if you are at risk of causing one on the way there.

Seriously, I've driven in Wisconsin plenty. Sometimes you just hit a patch of really nasty ice. Last winter I was creeping along a road doing 20mph. Started slowing super early for the stop sign and still slid into the intersection. Old car, had the tires lock up and when I let go of the brakes, they stayed locked up. The ice was too slick to break the resting friction of the pads and I slid into the ditch at 3mph. Yeah it's easy to say "keep a safe following distance" but sometimes the distance required to avoid a collision in snow is hundreds of feet which just isn't feasible.

Given the weather conditions on the road I would say the officer is also to blame. He actually caused the whole situation. I'm not condoning the individuals actions to drive into oncoming traffic, however, the officer caused the situation that resulted in the individual having to take action. The officer passed unsafely and he himself also drove into oncoming traffic. Rewatch the video if you doubt my observation. Yes, he had his emergency lights on, but that does not allow him to put others in danger, which he did. He could have waited until it was safer to pass but he didn't.

Like-you DO realize the cop had his emergency lights on and was passing around the guy in front of him because, you know, emergency vehicles can disobey normal traffic laws when responding to emergency calls. How are you comparing the cop driving in the middle of the road to the other driver swerving into the middle of the road?? Even if that person indeed did slide, it is their fault for not braking like the person in front of them clearly did. Or, at the very least, swerve off to the SIDE of the road and not literally into oncoming traffic.

Just curious. Despite the fact that the cop had his lights on, does he really think those conditions were safe for him to do the EXACT same thing? He crossed over the yellow line first to get around the vehicle in front of him. Yes, he's allowed to do that with his lights on but he's also supposed to take all due care for the safety of others on the road. I kind of fall in the middle on this one, 50-50 fault.
@-simon.
@-simon. Жыл бұрын
I see it as 100-0 fault. Any time an emergency vehicle has its lights on you are supposed to slow down/stop and move right. That driver didn't stop and turned left, hence the accident. They would have learned this in driving school had they attended. Even a few minutes delay can be a matter of life and death when you’re traveling by ambulance. The same holds true if a first responder can’t get to the scene of an accident, a fire, or a disaster. Emergency vehicles need to get to the place where they can help people. If you’re on the road where they are traveling, you can help them get there by giving them a clear path to their destination. (According to Minnesota law) If the emergency vehicle is traveling on the opposite side of the road, and there is no divider, pull over to your right. That vehicle may need to use your lane to get by.

I can understand it, but it is YOUR job to follow far enough behind that you can stop if the car ahead stops suddenly. If you dying have snow tires you should be following even further back. Like a thousand feet. If you think that is silly, you are doing it wrong. You WILL be at fault when you rear end someone or get into a collision. You are responsible for being in control of your car at all times. If you can't, you were driving too fast and not exercising due caution. You can be going 5mph, if you crash, you can still be charged. It is up to you to be in control. If you have to drive 3mph, then that's what you do.

That is one of the dumbest things I have heard in a while. The majority of people with licenses have no clue how to drive, and you don't need to do a basic exam and get a little card to be a good driver. All you have to do to get a license is show that you know to stop for stop signs and pedestrians, you know how to parallel park, turn around, etc. There is nothing in the training or testing referring to driving in winter conditions. You learn that by doing it, and you don't need a card in your wallet to do that.
@Plush-Freddys-Pizzaria

@@justforever96 Now, I agree with u to a certain degree. To learn to drive one should take classes and usually when classes are taken those drivers go on through the entire process and become licensed. Than you have the group who learn on their own resulting in many failed attempts, tickets and crashes. To have a license and loose it is different than never obtaining one from the start. Why should we have to pull $500 out of our @$$ for classes to be able to drive and others don't have too? Driving is a PRIVILEGE not a RIGHT. That got a little side tracked but u get the idea. 😜

The cop also has a responsibility to drive safely with emergency lights on, he should of waited for a break in oncoming traffic before going into the opposite lane as it seems like there isn't really a solid shoulder on that road for cars to merge over.

Of course you think it was the cop's fault. But look at it this way. True, the officer did move to the left to pass the car slowing down. When he did that, he was not directly facing head on with the other car and it appears that there was room for him to safely pass down the middle. The driver that hit the officer pulled out from behind that car and headed directly for the officer, who he should have seen because the officer had his lights on. At the point of impact, that other driver was in the opposing lane of traffic, which he had no right to be in. The driver admitted he couldn't stop in time which means he was driving too fast, following too closely, not paying attention or a combination of all three. In any event it was the driver moving from behind the car in front of him and entering the opposite lane of traffic, that was the direct cause of the accident. Regardless of your personal feelings about cops, there is no legal justification for the other driver entering the opposing lane of traffic.

IF you drive according to weather and road conditions, everyone gets pissed off. The speed limit is 65 dang it. Several years back, driving home when an F1-F2 tornado was crossing the road. I pull over onto the shoulder far enough away from the dang thing. What happened? People got pissed off, flipping me the finger and drove straight toward the tornado. Why? 'Cause there was no posting or warning saying you shouldn't drive into a tornado. Can't make this shart up. And don't get me started on planting and harvesting season. (Too late.) Every time I come up on cops like this they wave their flashlights in the exact same way constantly but expect you to magically know what they mean. Wave up and down means go forward, wave up and down means stop…what do you want from me??? I’m not psychic.

This serves as a reminder - don’t be in a rush if you’re in snowy/icy conditions! The extra, what, 20 seconds max he would’ve saved on his trip by going around the person in front of him… look what that cost him 🤷🏽‍♀️ and don’t be pulling shit on the roads if you don’t have insurance!

He wasn't trying to overtake. He couldn't stop, so to avoid a collision, he went into the center lane.

At best both parties are equally liable. Realistically the "officer' has greater liability as she had no right to enter oncoming traffic, even less so during those weather conditions. Take it to trial, and take their insurance money.

Technically the civilian did not have a driver license so he should not have been on the roadway period. If he had not been driving there would have been a collision.
