I know Merseyrail absolutely shit if aren’t able to buy a ticket at there staffed station, they expect you to pay the penalty fare and new ticket and then contest it in court, but the courts see it as you have paid the fine to admit your in the wrong and very rare allow the appeal, had similar incidents myself with them goons, luckily being a black male they back off when say “look at my skin colour” they just let you buy a ticket and be on your way

The byelaws are really clear and they have every right to lay hands on people to remove people from rail premesis who are travelling without a valid ticket. Railways aren't street corners, railway staff, British Transport Police and Enforcement Officers can enforce railway byelaws.

@@GKSC The traveller provides their name and address details as requested by the officer which is a legal obligation on the person traveling under the byelaws which he refused to do - the only option open to the officer after that is to remove the person from the train. If a penalty fare is issued you then raise the defence that the ticket office was closed. You don't refuse to provide details to the ticket officer, the obligation is on you to provide them, that is your legal duty in law.

The first should be the offer to sell the man the ticket required, there and then. If he refuses, then, the threat of being issued a penalty should be discussed. If the passenger still refuses and makes no effort to offer something in the way of payment, only then should the threat of removal from the train be used. As for following him onto the platform and further ejecting him from the station, that was pure ego and nothing else. He wanted to use his uniform to go hands-on and get away with it. He's a little punk rat in a uniform that's far too big for his puny frame. He'll find himself taking an unexpected walk back to the nearest station after falling off a train if he carries on with that attitude..

I was in the queue for a ticket as the train came in. Yellow jackets gave me a penalty on the train. No ifs or buts. Appealed it and still lost. Twice ive been robbed by them. It's disgusting abuse of power.

Just a got a fine through letter box for putting my feet up on the train, i didnt know it was illegal (no signage). It's almost as if the internet exists where you can buy your ticket online...Or at the self-serve machines...This waste of space is angry he got caught riding for free and had a tantrum. The onus is on YOU, the passenger, to get a ticket before you step on that train. It's not a civil issue it's a criminal issue not having a ticket on a train, he could of just payed the twenty quid fine like a man and faced his responsibilities like any normal adult.

The guards are authorised persons under the railway byelaws - they're actually written into the law, they have the same ability to enforce them as constables who are also written into the law - railway companies are their own prosecuting agencies aswell Your brother is wrong, they have specific power to use "reasonable force" to remove people from the railway - your cleaner brother who happens to sweep railway platforms clearly has no understanding of the actual legislation in place on the railways. If you don't know something Cliff why just make it up? Go research it yourself.

They aren’t, they are wearing a stab proof or tac vest so they are easily identified in public places (like a train station) are wearing SIA (security industry authority) licenses on their arms which a police officer wouldn’t ever wear and they help keep the stations safe. They aren’t dressed like police because they aren’t police at all

Does it make a difference? If you’ve been asked to leave by one of these licensed security members you MUST leave unless you want to be breaching the law, it is a criminal offence to trespass.

Also, not sure if his SIA licence is a just a Blue Security or Purple CCTV stripe and not a Orange stripe Door Supervisor. If you look (pause) he is covering it, so that would be it an offence, if he does not have a Orange DS SIA licence, as he cannot carry out DS duties or be insured on a standard blue or purple stripe SIA badge

You can't defend yourself from a lawful action stipulate in statute such as lawful removal from a train or station under byelaws. The law is written out, signed off by the transport secretary and published, railway staff including security officers have a duty in law to remove passengers who do not pay - if you assaulted an "authorised person" on the railway you are committing assault against them. Understand the law before trying to quote it.

@@donmacrae3855 Yep, because once they have told him to get off the property he’s then a trespasser which means after attempting to persuade, ask and warn him to move on, they can then use reasonable force to remove him just like me and you have the exact same rights to do if someone trespassed on our property, in addition I’m sure there could possibly be railway bylaws giving them powers but I can’t be 100% on that aspect.

They're empowered under the railway byelaws and are classed as "authorised persons" - byelaws can grant members of a workforce, police and PCSOs with additional powers for certain areas not found under general statute, such as a power to use reasonable force to remove someone from a train or property. Byelaws are crucially criminally enforceable via magistrates court and are not civil pieces of law. If you don't know what you're talking about and all that... Why comment?

You can't demand payment for something on private property you are a guest on. A train guard is not a public servant, they are a private employee of a limited railway company. The mindset of people is utterly bizarre. A basic cornerstone of common law is that you cannot impose yourself on anothers property.

Well done young man! Professional and knowledgeable about the law. Gave this numpty fare evader enough chances to get off the train of his own accord and was not intimidated into backing off. When all options had been exhausted he carried out his duty, as he is paid to do, and what we, the honest fare paying public expect, him to do. Respect! Can't stand fare dodgers - they are the reason why train fares are so high.

Not going to argue with who was right or wrong in this case as far too little info ie no evidence if he did try to buy a ticket and nobody there. But train fare dodgers are not the reason why they are so high. The reason is greedy companies greedy share holders and those owned by foreign ie other European services using us as cash cows to keep their fares cheaper.

Yh he couldnt buy a ticket at station. And these wouldnt sell him one on train, or allow him to buy at destination. Only two options, were to pay a fine or leave train.

The byelaws are really clear and they have every right to lay hands on people to remove people from rail premesis who are travelling without a valid ticket and refuse to leave. Railways aren't street corners, railway staff, British Transport Police and Enforcement Officers can enforce railway byelaws.

no they have the right to remove people with reasonable suspicon they that are breaking the bylaws. Beleive it or not it's perfectly legal to travel ticketless if there is no option to buy a ticket at the start of the journey.

@chrisstreet6827 You're the classic example of a little knowledge is a dangerous thing. You can only use that defence if the ticket machine was out of order or ticket office was closed. You'd still need to identify yourself under the byelaws as failing to produce a ticket under Byelaw 18 is enough basis to form reasonable suspicion for an officer. You'd be entitled to use the defence if the matter went to court but you don't have a blanket defence of "I couldn't get a ticket at the start of my journey" unless a ticket machine was out of order or ticket office was closed - missing your train because you were queuing to buy a ticket isn't a reasonable excuse - it's also a specific offence not to provide your details under the byelaws. You buy before you travel.

Sorry I'm not buying this. So there was absolutely no way to buy a ticket at the station, i.e. no ticket machine and the desk was completely shut up, not just the guy had stepped away for a minute to grab a cup of tea or go to the loo? Admit it, you were chancing your luck to see if you could get away without paying. Not slating you for that, I've done it myself plenty of times, but if you do and you get caught out, take it like a man and pay the penalty or leave the train. By refusing to leave until they physically remove you, you're just making yourself look a twat.

You had plenty of chances to leave, you wanted to argue and play the victim, you went up against some guards who knew their powers in law and acted extremely professionally. @@swiftandbold but surely they knew they were going to get the train in advance, it takes literally 2 minutes to buy an e-ticket on line on your phone, it does make you think that even with poor planning, they could have done better and it doesn't seem to be late enough for it to be the last train.

Not everybody is able or can afford data to use the Internet as means to buy a ticket. I get your point though that majority of society are able to do this. But ther will always be exceptions, and this was not acceptable behaviour by so called professionals. Both could of ended up under moving train. Hardly worth losing your life over £3.
