2010 my grandmother passed away, she had a living will in place. It passed onto my grandfather who kept it in place until his passing in July of last year. This sent my grandmother's will into probate. I understand that the will is finished and out of probate and all debts have been accounted for and cleared, leaving behind a still sizeable inheritance but, the trustee, who is my uncle and grandmother's youngest son, is still not fully distributing the inheritance. My grandmother's trust includes property, stocks, and investment accounts, which was specified to be divided among her three children. Unfortunately, my mother passed away before the trust became available and it is stipulated in the will that in the event that a beneficiary is not alive, their portion of the inheritance should be distributed to their children per stirpes, which would include my two brothers and myself. I'm wondering if there is any way to legally compel the trustee to distribute the inheritance as per the will, or if there are any other steps that I can take in order to receive my rightful share of the inheritance?

I fall into this category. My father (primary beneficiary) died 6 years after the trustor. My father and uncle were co-trustees. Now that my uncle is the sole trustee, he has been stealing the assets and refuses to distribute houses and money. He wrote out a small 25k check each to my other aunt and uncle and pretended to write out a 25k check to my siblings and I. The problem is that he wrote it out to my father's name. "In The Estate of...." I told him to rewrite the check into individual checks with our own names. He has refused stating that I must open up an estate in my father's name. Am I correct or is he? It appears he is trying to play games and force us to probate my father's share of the trust. He also tried to apply survivirship to this, but I told him survivorship has no application to our scenario.
