Pepper spray is SO dangerous. I personally do carry it with me, but I am 1000000% aware of how potent this stuff can be. I’m personally against the whole “cops need pepper spray training via being sprayed in the eyes”, cause some people have no joke died to inhaling the vapor from the spray. Capsaicin in the lungs is DEADLY.

Assault is kind of a thin line when it comes to oc spray and mace considering their a self defense weapon same as if you had a firearm. It is case by case. Also, it's not safe to assume you'll never see these people again. Especially if you're in the midst of your daily commute. They very well may be as well. Not only did he assault the guy with pepper spray, but he vandalised the inside of the vehicle by spraying in it. Pepper spray is tough to clean off. Is the guy who hit the windshield legally justified? No. I'd say morally he is justified, though. If the cops got involved at some point, they would both be in trouble probably. The pepper sprayer would have it way worse though.

The prosecutors would likely look at the excuse the defense uses for why the guy had a baseball bat in his trunk because that's when things become classified as weapons. So the burden would be on them for demonstrating its use or else its classified as a weapon. Similar to pepper spray in canada, its illegal, but bear spray is legal, however, you can't carry it around with you in the middle of the city for example, girls would be committing crimes by buying it and carrying it because that demonstrates intent for self defense. Same with a baseball bat or gun. because let's be honest, people don't commonly carry around baseball bats in their cars. So unless he plays on a baseball team, he likely has a weapons charge. Just like you had better be a park ranger if you have bear spray on you in canada or be in an area that has a real threat of bears. In the UK you can't even carry around a pocket knife.
