15:42 According to my gov. class and textbook, Miranda Rights don’t have to be read until right before the questioning/interrogation begins. So, she didn’t actually make a mistake. Movies have just made it a habit to read them when the arrest is in progress.

You forgot to sin the fact that Claire didn't know what a "flash drive" is called (referring to it as a "sticky thing"). Given her line of work, you'd think she'd eventually know that the thing you stick in your laptop to save info is called a flash drive. Like, what happens if she needs to buy another one, does she just tell the Office Depot employees "I need another... I forget what it's called, that thing you stick in your laptop to save stuff", and the employees just get it for her without explaining to her what it is? (ding)

It is a common misconception that cops have to read Miranda Rights when a suspect is taken into custody. The trigger for a Miranda Warning is being in custody and interrogation or questioning. So the police officer in this movie is not in the wrong. Just thought I'd put that out there.

15:45 didn't forget, just isn't actually necessary right now. Miranda rights are only necessary prior to questioning, given they're getting carted straight off, based ona pre planned bust, they aren't going to questioned at the scene about anything, and will be questioned later at a police station/precinct. As long as they give him the miranda rights before they question him, nothing is wrong there. Miranda right do not need to be read immediately on arrest.

@@michaelgoodwin80 Fun Fact: Not always. Look up the difference between a detention vs. an arrest. While they may appear to be the same thing, they are actually very different.

@@harpoonist123 is correct. An arrest is made when they suspect you of committing a crime. A detention can be done when they want to question you about about a crime but you are either not a suspect or they don't have enough evidence to formally arrest you. There are other difference like time limits and other things as well. Also if you are a mental health suicide risk they will detain you to take you to the hospital. They cuff you etc if needed but don't formally arrest you.

15:40 well you should know that you only need to give the Miranda admonishment if there is custody + interrogation. The detective character wasn’t asking him any questions related to the crime, she was just reading him his charges. Therefore, the Miranda rights didn’t have to be read

I will say, even when a couple has been together for a long time, they do sometimes miss obvious nonverbal cues. No matter how many times I've used the squeeze hand signal (and then later had to explain it when we resorted to finding another way out of a situation) my partner will probably never get the hint... love him, but some guys are actually that oblivious.

Reading someone their Miranda rights at the time of arrest is pure Hollywood and TV. The only time they're required to advise you of your rights is right before they question you at the station house.

15:40 or so-- An arrest isn't invalidated by the lack of Miranda. It's just the information you get from the arrestee that can be compromised. You only need to give the warnings if you need information from them that you plan to later use in court.

Lucario007 yeeah but they didn’t prove it on a wet slippery ass road if you’ve ever floored the gas on a wet road you’d know that definitely wouldn’t work 1. Your tires would just spin like crazy for a full 30 seconds before you even moved 2. The car would fishtail like crazy ( move side to side) whether it’s front wheel drive or rear

Crimson Light Actually, if you saw the Mythbusters episode, they did it both on dry pavement and wet pavement.

Lucario007 ah well I did not see the episode but I have driven drag cars and I can tell you for a fact that putting your foot down in 400+ hp of car will spin like crazy on a wet road.... then again I’ve never tried it while pushing another car so hey what do I know :/

Hey. I only want to thank you. I am going to tough times. I am suffering from a depression and I feel nothing most of the time.
