What you need to win in eviction court when your home has mold. A Mold Inspection report and the inspector must be at court to testify or you will lose the case!

I just lost an evicting hearing as a tenant with two kids and mold in the drywall and insulation from a chronic leak. The texts weren't printed when I told him. He acted like it was his first time hearing it. The judge also did not allow the mold test or doctor's report of my health condition to enter evidence

I'm sorry to hear that. An attorney should have been able to advise you on this. Normally a mold inspection is needed with the report and the inspector there to testify. Otherwise they don't have to accept the report into evidence. That may be the reason the judge did not allow the other evidence you mentioned. If you still have access to the property you can still get an inspection and perhaps sue the landlord in regular court.

So I was evicted and lost in eviction court because I called code enforcement who then made a report and case and the landlord empire retaliated . I’m waiting for my lockout date. Let me repeat code enforcement came took photos made a report and case. I had to be my own lawyer.

Hi Breanna, Sorry to hear that. Code enforcement is not going to be of help since they are not trained to deal with this matter very well and don't have the expertise. You need a 'mold inspection' by a CMC or CIH ( if possible) as I have mentioned in other videos that shows there are issues for the landlord to fix. That report, sent to your landlord asap, and testimony from the inspector in eviction court will normally win the case for you. There have been repeated leaks of the pipes in my rented home over the years. Someone is sent to “ patch things up” and replaster the ceiling. A couple of weeks ago we awakened to busted pipes, a collapsed ceiling and a flooded home, damaged belongings etc. later the living room ceiling collapsed. The property manager told me we’d have to move because the home was uninhabitable but has refused to follow California law and provide us with safe accommodation. He lied and said it would take 3-4 months to fix the pipes and ceiling and no one could be staying in the house when they did it. Walls are water damaged as well. It’s all been so STRESSFUL!! I want to sue. The place smells HORRIBLE & bothers my sinuses. I need to pack my things but it’s hard to breathe in there. I feel like all public offices are giving me the run around. Do I need to pay for a mold inspection myself?

You can take the cost of the inspection off your rent in this situation and even stop paying rent and landlord cannot ask you to move legally unless he provides a place for you to move to in that situation. Those inspector experts who testify usually will charge a fee to do so which you can ask back from the Judge from the landlord. Most inspectors have not testified in court but a subpoena will help that happen.

Do you think the court will allow code enforcement to validate the mold report by the inspector? , if I cant get ahold of the inspector, the code enforcement was present during the inspection which is noted in the mold report

@@sugabay I cannot say on that. My feeling is that they will not. However, having code enforcement to testify that he was there can help. Ask your attorney on this as how to address it.

I called the Code enforcement they never show up!!! I am going to put my 3o day notice in I am sorry but this inspectors don’t not do a good job at all!!!! I am very clean person I can’t live like this
