Legal malpractice and excessive billing. Hi, I'm attorney Neil Burns. I've been practicing law in Massachusetts for over 35 years. Today we're gonna talk about excessive billing. What is excessive billing? Well, you get a bill from your attorney and it seems excessive.
What do we do? First, we look at the bill. Then we look at the fee agreement. Is there a written fee agreement? What does the fee agreement say? Was this type of bill anticipated? Is it a written engagement letter? Even in a contingent fee case, the fee can be determined to be excessive by a judge. What if there's no fee agreement? Well, in that case, no written fee agreement is problematic for the attorney. We still have to review the case.
Another huge problem for attorneys is if they've tried to get you to resolve your case, to settle your fee with them by discharging any malpractice that they may have, this is wrong.
