The new tax law, that encourages people to rely on capital gains as part of their income and a way to lower their tax liability by reducing their wages is hard to understand. As someone who has a small sole proprietorship I think it is funny that there is a 20 % potential tax break based on capital gains or my income in excess my capital gains if it is less than my dividends. For one my dividends are very likely to be less, secondly if I had capital gains from long term assets, what would be the point of selling them and if I had short term capital gains I would not want to pay the heavy tax. I suppose if that allowed me to lower my BMI (Qualified business income) through a combination of capital gain, revenue loss and low income I could declare a loss and still make money off of my capital gains, but I think if I was at that level I would probably sell my sole proprietorship and buy a boat.

The new tax law (Trumps "Tax Cuts and Jobs Act") wasn't designed for "normal" business owners that are providing a service (construction, landscaping, uber, door dash, entertainment) or product (clothing, furniture, prepared foods, art/craft/jewelry items, direct selling Amway/Lululemon/Avon, online reselling Ebay/Amazon) which most people engage in. The 20% capital gains tax break is for "small" businesses engaged in real estate and financial investing as part of their revenue, something the vast majority of poor/middle-class "normal" small business owners aren't doing. Buy land or building to develop, rehab, or rent and sell it at a profit... capital gains. Buy car, boat, or other vehicle used for the business and sell it at a profit... capital gains. Buy art or other collectible to decorate the business office and sell it at a profit... capital gains. Invest part of company earnings into stocks/crypto to generate additional revenue... capital gains. The business is actually a small hedge fund management company... capital gains. Who's doing these types of small businesses that can really benefit from that 20% capital gains tax break? The rich upper class that have the money to fund these types of businesses not the "everyday common" American.
