Always bringing the facts. Subscribed. One of the better channels for veterans. Question: what if we have filed an initial claim for conditions (12 in my case) and still waiting to hear back? However, I have some additional conditions I need to file for because I am learning so much now. What’s the process to file for these additional conditions? Do I wait or file right away? I’ve not been able to find anything related. APTTMHY

They actually combined IBS & GERD and won’t rate them separately anymore. I just went through this and everyone I’ve talked to providers + VA said they combined them, which is dumb since they affect different parts of the stomach. To get 60% you have to be bleeding out basically. They said rating each separately is considered pyramiding.

I like the videos, question about P&T if I may. Are you awarded P&T status because of an accumulation of all your claims or the severity of a particular claim? Example if I have a bunch of claims I’m well over that 100% mark, boom I get it automatically? Or is there something else in particular the VA is looking for to grant you that P&T status? I know the book answer but have you seen in your experience?
@jdminn4
@jdminn4 Жыл бұрын
As Hill & Ponton explained it, P&T is that you are rated 100% for static conditions (i.e. not expected to change/improve). You can be rated 100% for non-permanent conditions, e.g. surgeries, cancer treatment, heart attack. After a certain period, your rating drops and you are then rated on residuals. To find out your static conditions, call the VA and ask for a copy of your code sheet.

1. Write a compelling personal statement describing your IBS symptoms through the lens of 38CFR and why you believe your IBS was caused by your prescription from your service connected condition(s) 2. Get a nexus letter, preferably from a specialist in their specialty that concurs 3. File the IBS claim

When combined with a bulletproof personal statement and a credible nexus letter, absolutely it can boost your case over the edge. The key is scratching and clawing until the VA concedes it’s a toss-up; which is automatically rated in your favour. Respectfully and tactfully presenting findings from relevant peer-reviewed studies is a great way to know you are doing all you could to max out your odds
@dougbergren8035
@dougbergren8035 Жыл бұрын
@@vaclaimsacademy I agree, but my experience is that even with the most credible nexus letters, I'll get an ignorant denial. We'll keep trying though.

So how do you go about getting each one of these diagnosed from a doctor without telling them out right... so they dont think you're gaming the system. Everytime I go into VA they look at me like im crazy and or lying when I've been on Omeprazole since 2015 because of acid reflux. But I dont have this rating for anything at all. Even worse I've stop using it off and on because from reading it can cause kidney failure so I dont want to more screwed since im only in my low 40's. It's horrible having to swallow and it feels like im throwing up. I had to stop taking tramadol and meloxicam because it was causing me severe hair loose and I didn't even know it in my early 30's. VA in Hawaii is Horrible and they aren't really into helping VETS and you end up giving up and just dealing with the pain and suffering because they act like you're just there for handouts. Im beyond frustrated with this system but your video just gave me some hope to push a bit more. Also how do you ask for a Nexus letter and request for diagnosis that VA didn't give you right out the BOX since its been years?
@vaclaimsacademy
@vaclaimsacademy Жыл бұрын
You know, this is smart question. I have a very specific strategy to tactfully solicit a diagnosis that I’m keeping under wraps behind the course paywall so the doctors don’t start hearing the same thing over and over. But the general technique is understanding that medical professionals have egos and if you employ the 48 Laws of power and do your best not to outshine them while still asking for what you want, this works best

You being in Hawaii, then you need to look into the Pearl Harbor complex superfund clean up that started in '94 and is scheduled to be monitored through 2045. It's a toxic wasteland. Over 60 known chemicals have tested positive in the soil,groundwater,and sediment around the complex. The Navy was told in 1984 that Pearl Harbor was toxic and was compared to Love Canal, NY. Of course, they denied until the Honolulu Advertistor ran an article, and they admitted that it was contaminated. The EPA added Pearl Harbor to the national priorities list, and clean-up started in '94. This is the military's best hidden secret. I stumbled on to it by accident. My unit was damn near on top of the Ford Island landfill in the 80s. Everybody needs to hound their representatives to add this shit to the list of presumptive areas. Pearl Harbor complex makes the crap at Camp Lejune look small. Look up Pearl Harbor superfund clean up. There's a ship load of EPA documents that you can download.
