Female judges in most session courts and high courts think themselves as the flag bearers of women right i have seen in many cases that they liberally bend the cases in favor of the women even after its found the women is wrong .... What I fear of as law abiding citizen and also a brother that if such type of biased attitude of the courts go on a day will come when even true cases will be assigned or forced to be assigned as fake cases by the society... It's indeed heavily misused and should be dealt with a stricter burden of proof on the accusing side to prime facie establish whether there are merits in the allegation or not. That said a recent High Court judgment (can't recollect the State) has very aptly differentiated with a genuine breach of promise to marry and a beach of promise to marry with malicious intent.

Section 90 in The Indian Penal Code 90. Consent known to be given under fear or misconception.-A consent is not such a consent as it intended by any section of this Code, if the consent is given by a person under fear of injury, or under a misconception of fact, and if the person doing the act knows, or has reason to believe, that the consent was given in consequence of such fear or misconception; or Consent of insane person.-if the consent is given by a person who, from unsoundness of mind, or intoxication, is unable to understand the nature and consequence of that to which he gives his consent; or Consent of child.-unless the contrary appears from the context, if the consent is given by a person who is under twelve years of age.

Koi proof ki zaroorat nahi, sirf oral testimony. But interesting, if marriage was so important, then why she continuously did so, after first event, then again, then again, which shows it was love or marriage was not material. Lets take another case, will the same lady enter with anyone, who promises marriage without emotional connection. It sound absurd. By this logic, if a labourer, rickshaw wala promise marriage, will the same girl will enter into marriage without emotional bond. Another point is, when we say, one has absolute choice to choose life partner till marriage, it means, one can resile from any promise and marry a person of ones choice. Taking it further, how long we are going to presume the specific gender as fools, when we are ourselves seeeing livein, even lgbt, where no marriage can hapoen or aldoscent sex, in all these cases, one does act without marriage, which means, human behavior cannot say, affair is not a license to rape or why adultery in first place exist, if no women worth her honor will enter act without marriage. All goes to the top. Moreover, when we are insisting on personal choices, then the relationship will be forged, break and one cannot say, i was induced as even marriage can break. Taking it to extreme, if tomorrow marital rape is recognized, a lady can say, he promised me to for life tume, now he deserted me or filing divorce, thus committed rape by deception and as soon the divorce petition dismissed, convicted for rape as it will be considered false promise not breach of promise. Our teacher used to say, yes or no are not be inferred from statements as that can be changed at convenience but it should be infrered from circumstances as when we go to dentist, we presume that we are offering out teeth to doctor for treatment and including the necessary procedure.

The fact that these laws are making harder for women to be more accountable for action seem very patriarchal.
