In this video we go over the hot mess that is the National Firearms Act which regulated the ownership of certain configurations of firearms in 1934 and still is in effect today. There is a lot of confusion out there and even more misinformation put out there by bias media outlets and people who just don't know what they are talking about. Chad and I attempt to clear up at least some confusion regarding the small arms side of the NFA in this video.
We will most likely be making a second part talking about other firearms in a class called Destructive Devices; an entirely different and even more complicated subject, so stay tuned.

Unfortunately, society nowadays accepts everything that media gives them as truth. I don't live in the United States but as far as I can tell these regulations are completely useless. The people that will respect these rules definitly aren't the kind of people that would use their firearms to commit crimes. As if any criminal would register his gun before robbing a store.

Funfackt: in Norway suppressors on both handguns and rifles is a over the counter item you just have to have a gun permit and the dealer will send in papers that they sold it to you.

When my Dad was in elementary school in the mid 50's during hunting season kids would bring their guns to school to go hunting at a friends place after school. Can you imagine a 10 year old kid bringing a shotgun to school now? They would send out the swat team. Even when I was in high school in the late 80's you could still bring your gun to school but had to leave it in your car. During hunting season every pickup truck in the lot had a gun in the window rack.

@@EasilyCringed the brand does not matter. you cannot legally own an unregistered machinegun. The machinegun registry was closed in 1986. Gunsmiths are exempt from this if they have a type 07 FFL.This means that the only legal machine guns you as a non gunsmith can own are those registered before the registry closed.

Any gun law, no matter how large or small, is objectively unconstitutional, regardless of its effect. Whether or not you support gun control, it is true that gun laws are unconstitutional, which you would know, if you’ve ever read the constitution.

@@SashaZvyagin There wouldn't be school shootings if all the adults at the school were trained and carried firearms, do you people ever feel bad for standing on the graves of murdered innocents while chanting for laws that would lead to the murder of more innocents? Why do you think a gun free zone is a magical shield that guns cannot physically enter? If someone wants to take a gun somewhere, they will. Better to have them outgunned on the spot than wait 15-20 minutes for other people with guns to show up. You know there's a black market for guns? Where felons can still get them? Just because its illegal doesn't mean they are going to stop.

my freshman year of college, a kid from the city wrote a paper (for a government class) on how suppressors should be legal for at least hunting. i may have ruined the entire paper when he took questions and i told him that they were completely legal with the proper tax stamps.

Bert Neilson Yeah In my public speaking class a kid was speaking on why college campuses should not allow guns. His example was a true story of how a few football players from different colleges got in a fight and the snowball effect took place and it ended up in a college parking lot there were guys on both sides with bats knives and guns because of this one initiating fight. No one got hurt or shot but he went on to say how guns just can't be on college campuses because we can't let things like this happen... I stood up after he was done and said. Guns are already prohibited on campus and it happened anyway. A lot of good that did and "more restrictions" would do. haha! I later gave a speech where (for demonstration and your an idiot purposes since we had to use a prop) i first pulled 16 very toy looking guns ranging from 25 auto size to larger that full size handguns out of my coat, and pockets as I gave my intro about how all of the ones that i pulled out could be real and anyone can do it with real guns and how easy it was, also quoting the facts, but how yet there has never been a shooting on the campus and thousands of other like it. then I connected gun control and confiscation with mass tragedies like the holocaust, and the hundreds of millions who died under Stalin and Mao Zedong, slavery, the trail of tears. Also illustrating one of the main purposes of the second amendment with the battle of Athen 1946. After my speech the "teacher" said "good speech, I was hoping to see a little more logic and reasoning though." I couldn't believe what I heard. But i guess i should have expected such coming from a liberal 58 year old lady who would rather hear a speech about how weed should be legalized in kansas

Spencer Bird A note on that teacher remark, you'd be surprised how many people who believe gun restrictions/anti-gun laws will work to stop crime actually smoke pot illegally. You'd think (since weed surprisingly doesn't alter your judgement like alcohol) they'd realize that their whole basis for anti-gun beliefs are built on hypocrisy since they smoke weed, but apparently not.

They Need to do a lot of things.. Contact the NRA and see what they are asking trump to do. Looks like not much at all. Remember the Republicans signed in more Gun restriction than Dem;s ever did. Ronald R is the one that signed the Bill that prevented us for buying new full auto Rifles and pistol's . With the Backing of the NRA.

Gfdf Perte I'm pretty sure the NRA is working close with Trump since they supported his campaign. And I'm sure the NRA has a long list of things they want done on behalf of the US citizens regarding Gun Control and Gun Laws in the US. For starters Trump needs to force the people that create state laws to not infringe on our right to bare arms, such as California. By all definition California state laws are infringing on our rights, and right there clear as day it says in the Bill Of Rights "Shall Not Be Infringed". The government, state, nor law enforcement, did not give us our rights, therefore they cannot change them or take them away. And California is doing just that. And I don't even live in California, I live in Pennsylvania. But that's not the point. The point is, if they get away with taking one of our rights away in one state, they will try with the other states. Then after we are all disarmed, then they will move onto take one of our other rights away. To these people it's all about money and power. And those 2 things corrupt people. And some day soon the citizens will get fed up, and then we will have another civil war on our hands.

The NFA of 1934 was a legislative response to the planned coup against FDR in 1933 called the 'Business Plot'. which, given the way Congress treated it, seems to have been more along the lines of a 'false flag' operation. The plot was impractical, and may actually have been government-sponsored, given Congress's lackadaisical treatment of what amounted to treason. Those named in it never did second of jail time. The only thing the NFA did was to 'underarm' the American public, legislatively placing superior firepower in the hands of government. Which has led to a pattern of increasing, expanding legislative encroachments upon the 2nd Amendment right up to today.

@@EasilyCringed it has to have been manufactured prior to 1986. The least expensive full auto I have heard of was $15,000. They range over $250;000. Good Luck buying one. Actually 1person owns the majority of all fully automatics. He did it to set the market and as long as full auto can no longer been made he still controls it. That is sad !!!!!

MusicWeaponsFood thats because at home you don’t want as much collateral damage. I don’t like it either but I can see why it makes sense. If you’re only engaging one target in a populated place full auto may prove just as destructive as it would’ve been helpful. That’s why cops bring out the full auto when shit gets real. Although I’m a constitutionalist and I do believe that there are too many rules on something that so blatantly says otherwise. SHALL NOT BE INFRINGED. Not “Shall be regulated, controlled, or restricted.” Which it is. Stay out of democrap states.

Dude the NFA was possed because of the 20's. Plus if you knew people that lived in the hood you would know most weapons gangbangers get are gotten by intimidating law abiding gun owners. That can be pretty easy when you can't protect every one you care about all the time. Can't work a full time job and protect your son from being beaten to death over you not buying a hand gun. Most gangs do not use AOWs, or NFA weapons because they are tracked. When i was in film school we interviewed a former straw buyer who just got out of the pen. He laid it out that if you did not buy for most gangs, they would just get you when you cant get your gun or just start knocking off your family around you when you weren't around. Waiting until you are coming out of a car or in a busy area where the risk is too high of hitting someone was actually pretty common for a long time in chicago. In fact, owning guns and having family makes you more of a target if you live in certain neighborhoods. Gangs have simple logic. If there is no proof a gang killed a member of your family and you kill one of them, who do you think will go to jail? The well oiled gangs will make sure there is no proof. The one's doing it for the money are making 3 to 4 times what a gun is actually worth because they charge based on the risk involved. We actually need a national registry to keep track of weapons so we can track down straw buyers and hold them accountable. Or investigate weird purchases such as someone who only makes 30k a year buying 70k worth of guns. This would be you know....a red flag to anyone. By comparing income to purchases, we can actually find straw buyers and put them in jail or find people who are making purchases of things like grenade launchers, mopad weapons and other products and not having the money to buy them. I am all for open ownership of weapons. Any weapons really, but asking for registration in no way infringes on ownership. We just need it to keep idiots honest. Because right now if you get your guns stolen, some states do not require you to report them to make an insurance claim on them.

The whole NFA act needs to be repealed, and ALL the taxes paid under it refunded with interest to those who paid it, and if they are deceased, to their heirs. It was unconstitutional when it was enacted and is still unconstitutional today. The Second Amendment says "shall not be infringed", yet the NFA act was designed to infringe on the second amendment rights of citizens. The argument that it didn't outlaw anything but rather imposed a "tax" on certain items is nonsense. In 1934 very few could afford to pay a $200 tax on anything, especially as the country was in the middle of the Great Depression! That onerous "tax" was a backdoor INFRINGEMENT and nothing less. It was illegal then and is illegal now. The second amendment gives us the right to buy all the items that are covered under the nfa act without infringement, without having to get "permission" and or to be "allowed" to own by the government! WITHOUT PAYING AN ONEROUS TAX ON!

Update note, as of 2016 a signature from the chief law enforcement officer is no longer required on a Form1 or Form 4, you just send them a copy as notification. They don't have to actively approve it anymore.

You guys should do a video on what the requirements are of possessing an NFA item once you have the stamp. Such as penalties for not having the stamp with the item, or who can and can't shoot the items. And what possession truly means when someone else fires the weapon.

The treatment of suppressors annoys me a bit. I don't care about barrel lengths all that much (other than harmonics of various calibers), but I do care about suppressors. Partly because of hearing safety and partly because noise pollution is harmful to the ecosystem. I own this property and I take good care of it (down to the lead-less bullets I use). Suppressors aren't some sort of 'gangster toy' to me. They're a mandatory part of a plinking system. They should be treated with more dignity and respect than they currently are by the general public. Honestly, I think they should just be stricken from the NFA.

You could make a petition, hell, make a case that explains how the NFA is against the Constitution. raider762 I don't think abolishing would help repair the 2A. It's more of a classification of certain weapons, although there are certain things that should be adjusted. My opinion would be to remove silencers (yes I know they don't SILENCE a gun, just SUPPRESS, but that's what the Class III lists as) off the Class III listings, make them OTC purchases, and to lessen the tax stamp on SBR's, SBS's down to, say $50. AOW's have only a $5 transfer fee, so those are fine. This is just my opinion.

NEVER ASK LE FOR LEGAL ADVICE. NEVER. Most in LE have to look up statutes AFTER making an arrest. Most know nothing about firearm laws. Speak to an attorney knowledgeable in firearms in your area and research for yourself. Outside of this the information was spot on and invaluable. A very quick and comprehensive introduction into the NFA and why it is absurd.

We have an NFA in Australia. It stands for 'National Firearms Agreement'. Our Gun Control laws are soooooo much worse than the United States. We have to register ALL firearms, including air rifles. Ours are also categorised into A,B,C,D,H,P (paintball markers), R (Restricted)

Yeah, That is EXACTLY what is said in the 2nd amendment of the U.S. Constitution. A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. Ohh, wait . . . nothing about the govt determining what arms & munitions the Citizens can and cannot own is not there. In fact, Its not supposed to be infringed upon at all. BUT, Many states have taken upon themselves to infringe on that natural right to self defense and defense against tyranny from the very govt we have elected to protect us. Can you point out where in the national or state Constitutions where it is lawful for the NFA or ATFE to exist AND be given lawful authority to make any law contrary to the Second Amendment? I would like to see that.

Just a heads up In order to convert an AR 15 to a select fire weapon you must have a M 16 bolt and a low shelf lower receiver. The AR 15 bolt will not work without some serious modifications. Thumbs up on the information in this video

Thank you guys for all of your time and info, I had never really thought about becoming a gun owner prior to your videos but with all the info from you guys I bought my 1st pistol last year (Beretta Px4 Storm 9mm) which is a joy to shoot, I took my son to the range and he had gotten quite good with it as well, i picked up a Ruger 10/22 and began shooting with my daughter as well. Today I am going to buy a Maverick 88 this will be my 3rd firearm and I know it will not be my last. Thank you very much for getting me and my family informed and armed. Question on pistol carbine conversions + suppressors: A design in my head right now (that I haven't figured all the details out on yet) is taking a Glock 21, a 460Rowland conversion kit, a CCU like the Roni or KPOS G2 in order to build a pistol cal carbine. Adding a pinned and welded SilencerCo suppressor to achieve the ~16.5" total barrel lengh so that only one tax stamp is required (for suppressor) instead of 2 stamps (suppressor + SBR). This would be even better if Polymer80 had a G-21 based frame... Now one issue I come up with is that pinning/welding the suppressor in such a build will prevent the barrel from being removed from the slide (Maybe machine the front of the slide and machining in some sort of removable retainer to pull the complete barrel/suppressor unit out the front somehow while still retaining the recoil spring function, etc.? IDK). Another issue is cleaning the suppressor in this configuration, how would that work without inadvertently creating an SBR as soon as you pull the suppressor apart to clean it? Basically, I want a Glock 21-based, 460 Rowland, integrally-suppressed carbine, without being classified as an SBR. One freedom tax is enough for a single firearm. The reason other than because I haven't seen one: I'm curious how well a 460 Rowland out of a 16" barrel will do against wild boar. (Using as many parts that are already on the market as possible - which means a longer permanently attached suppressor that adds ~10" to the barrel length).

I was at the Indy 1500 Gun & Knife show last year and the ATF was out in force, armed with dowel rods, tape measures and their spec sheets. They were confiscating all kinds of shit, being brought in and on the way out. Folks were bringing in their home built AR's and selling them, but they had no stamps for anything. Into the hold it went. There were some pissed off folks in that place. Cops were everywhere. It was very tense.

By this definition, as cited by the author of the "opinion", any entity attempting to convict a citizen, during proceedings of adjudication must then prove, beyond a reasonable doubt that the pistol was "designed or redesigned, made or remade, and intended to fired from the shoulder.....". The simple act of actually firing from the shoulder does not, in itself, indicate that the pistol was configured with that intention.Along these lines, 18USC.921(a)(29)(A) defines a handgun as: (29) The term "handgun" means - (A) a firearm which has a short stock and is designed to be held and fired by the use of a single hand; and (B) any combination of parts from which a firearm described in subparagraph (A) can be assembled. So, it should then be the ATF's official opinion that because many pistols are designed with the clear and indisputable intention to be held and shot with two hands (ie. stippling on the fore end of it's trigger guard, etc) and are employed in this manner by every LE agency and LE agents who moonlight as firearms/self defense instructors who teach civilians who'll pay, that those pistols are no longer pistols but would then be classified as AOW's. I would welcome any agent of LE to initiate an arrest based on the lettered opinion. While he/she would likely be protected by qualified immunity, their agency or sponsoring gov't entity would probably pay a large sum in the ensuing civil lawsuit.Please don't base your knowledge of the law on youtube vids. Go to the source. And for god's sake, stop posting vids labeled "skirting gun laws", or "getting over on the ATF", etc. You're inviting the attention of idiots; idiots that could make your lives very uncomfortable.Iraqveteran "et al", is obviously very educated on this and similar subjects and provides a great basis on which to form your own educated opinions. If you like to wade around in the gray area of any law, do your research and be prepared to defend your actions with black and white. As a LE agent, myself, I'd much rather be surrounded by armed, responsible and educated citizens.

the bit about going to buy dynamite for dad is so true. back in montana cousin would send me out at 12 to buy ammo in his 67 mustang every monday when i vissited. he used to own both the gun stores in town now only 1. i got em from his shop obviously. even sent me in to get my own 22 to use once haha. they didnt allow that 1

all these laws are completely absurd. either you can own a firearm responsibly or you can't. wtf does it matter if you have a bolt action or an apache. you either obtain it with the intention to use it responsibly or with the intention to do harm to others. i honestly pity these people who make these laws they must wear velcro shoes because shoelaces are too complicated.

One point about the origin of the NFA, the NFA put in the provision about the sbrs only because at first they wanted to just target handguns, because those were the main crime guns, but people questioned what about people cutting down rifles and shotguns into "pistols." Later on, they got rid of the handgun part, but pretty much forgot about the sbr rule, so there is no reason they are being taxed, and the criminals were not really using short shotguns and hiding them, they were using riot length guns when they were using them.

I wish you would cover homemade firearms, and 80% lowers, things like that. I'm kinda starting to get into that stuff, so I would like to hear about the laws around those items. Just the thought of shooting a gun I built myself is awesome to me! I still really enjoyed this video though!

Michael Anglin it is legal to manufacture your own firearm and use it yourself with no serialization or registration. so long as it is not covered under the NFA or gun control act. and you are not allowed to sell, transfer, gift, the weapon, and i believe it must be destroyed or turned in upon death, cannot be inhereted either. *** depending on jurisdiction.

I know this is an older video, I love your guys videos. I found the conversation near the end of the video interesting how fast forward 5 years to today the changes in the suppressor market and public view. Although I watched another video you guys mentioned a company called Huntertown Arms that made suppressors that's now unfortunately closed due to a fall in suppressor demand and sales. I just wanted to mention I learned things from this video and appreciate that you guys put this great information out there for people to find and educate themselves.

here in Canada, we have non restricted( can be shot anywhere it is safe provided you have the proper licencing and landowners permission), restricted(shooting range only), and prohibited(unlawful to posses unless you are lucky enough to manage to get a prohibited licence) The PAL (Possession Acquisition License) which you must be 18 to have, and must go through the firearms safety program. Generally, all semi auto rifles are limited to 5 rounds, and to be non restricted they must have an overall length around 26 inches with a barrel at least 18 1/2". Like the SKS rifle. However, the ar-15, even if it meets non restricted length is automatically a restricted firearm like any handgun and can only be discharged at a licensed firing range. Y'all should host some Canadian gun owners on your channel! A great voice for Canadian firearms owners is Rod Giltaca (CCFR, Civil Advantage). There are lots of Canadians who wish they had the same rights as our neighbors to the south.

I think the community that the school is in has a big role in what teachers say about being anti gun. For example we just had our friends of the NRA meeting at a local middle school. Where around 300 people showed up. And over half were open carrying. ( probably the safest school in America at the time) And I know it's not like that everywhere. But the community has a big influence on what goes on in schools. And by the way Eric I can save you some tickets for next years meeting if you like.

Thanks. We raised a ton of money for kids in 4H and Jrotc. And we're building a shooting range. So that helped out a lot of people. Plus seeing well over 150 people open carrying in a school...... God I'm proud to be an American.

It took place in Kentucky. Or what's left of free America. And no it's not impossible. Just get rid of all the anti gun politicians. Educate the liberal democrats with some real common sense and take a kid shooting every once in a while. And before long things will improve.

Iron Donkey Being a Liberal, I agree with this. I think the Left has misunderstood the fundamentals of self-defense, which I think is the bigger issue here than just guns. I mean in Britain, I've heard cases of one defending themselves with a baseball bat and getting either arrested or even convicted for it. That is nonsense and must stop.

The NFA didn't "equalize" the playing field it made it so pretty much only gangsters and bootleggers could afford a full auto Thompson or BAR.

If trump gets the hearing protection act through I'm going to make a semi auto 9mm smg I designed based on the luty design with a wire telescoping stock with 10 1/2" barrel with a 6" suppressor pinned and welded to it (maybe make a video series on it hopefully).

I see it coming now. I just watched it happen in the drone industry. There are people that LOVE the legality of a thing that they are willing to go thru more so than the THING itself. HAM Radio is another example. Most HAMMERS love the feeling of Superiority over others more so than actually using their radios! There is this breed of Do-good er out there now that love going through the legal process and will agree to passing new laws just to make them BETTER THAN YOU!!! They actually love the feeling of having a power over you so although they may be “gun people” they will support more gun laws just to maximize their elitism over you. I will NEVER support any new gun law of any kind and I would encourage you to do the same! They will never STOP! BTW this applies to CCW to. I fight to keep Open Carry laws in place as it’s you most basic gun right but those that have their CCW don’t give two shits about preserving your OC rights! You can see aLOT of what I’m talking about in this vid!!!They appear to be on your side right? But aren’t they so much more legitimate, superior and MORE ELITIST THAN YOU?
