Edit: As I look back, dressing well for court will show respect and seriousness to the judge and the courtroom environment, which might help your case. Maybe not have to do full suit and tie, but dressing better than casual I highly recommend.

Update: I received a Notice of Intent to Prohibit. What that means is that the RoadSafety commission deemed me as an unsafe driver, cancelling the decision made by the judge. They are letting me know that they intend on suspending my driver's license for 3 months. This is exactly what I did NOT want to happen, and is ironically the reason why I went to court in the first place. So now I will be submitting an appeal letter. They should get back to me two months, so I will give another update on whether the appeal was successful or not.

2nd update: Appeal letter was unsuccessful. I have received a letter today from the RoadSafety commission and Insurance Corporation. I need to turn in my driver's license, and I am prohibited from driving for 3 months, dated February 12. Therefore, the clock will rewind... I need to restart the 2 years to obtain my full driver's license. In addition, there are hundreds of dollars of expenses, such as paying $281 to get my license back and insurance fines. Was it worth then, going to court? Going to court helped me reduce my ticket fine from $368 to $50. Moral of the story: If you're a beginner driver, be cautious about the rules of the road. Don't be like me! The penalties are harsh and my Asian mom is not pleased.

Cops are government thugs...not everyone in an uniform is a hero so SUE ME! I posted that comment months ago and recent events will proof me right! Stay in denial

First time I went to traffic court I was asked to approach the bench and got so nervous that I puked right onto the Judge's gavel. He said, never mind, case dismissed and ordered a cleanup.

The traffic judge is great, he’s an old Portuguese man who loves the law for its ability to help people. The Vancouver traffic court is a really awesome space, and I’m glad you had a good first experience in court.

I got a ticket for 102 in a 70 on the interstate. This is my first offense and I’m scared and don’t know what to do. I don’t know what’s going to happen to me, I never do anything wrong ever. I don’t smoke or vape, I keep straight A’s, I work, I volunteer so many hours in my community (I have over 900 hours) and it’s all going to boil down to my one mistake. I am so unbelievably upset you could not even understand.

I’m going to court tomorrow for canceled registration, not stopping and a stop sign, and swerving while driving. My car is on my brother’s insurance and he had switched providers and I wasn’t put back on it for a few weeks because I couldn’t afford the price change. I haven’t drove it while it wasn’t on insurance. After I was put back on his insurance, I had drove to and from work only for four days and was pulled over at 1 am. I had clocked in at 11 am and had gotten off work after midnight and I had drove one of my coworkers home. They were on my way home and I offered them a ride. It was dark, there were no cars on the road, and I was exhausted from work when he pulled me over. I never knew that your registration can be canceled if you don’t have insurance on your vehicle for almost a month, no one ever told me and I had just got my license. I didn’t find out about the registration until the officer told me. When he pulled me over, he made me take a breathalyzer to make sure I wasn’t drunk and then gave me a citation for what I mentioned earlier. I never passed any stop signs that I knew of and the swerving was because I’m a new driver and I was tired. I’m scared to go to court not because of the demerits or anything (I have never been in trouble before and this is my first time getting pulled over), it’s just that I can’t afford any costs. I can’t even afford my current bills at the moment because I had to take a week off of work recently because I had covid. My brother and his wife are struggling to help me pay for what I owe but it’s putting them in a tight spot as well. I’m going to try to plead not guilty and explain my situation in hopes they understand my case. I was pulled over back in December so I’ve been stressing over all this for a while, just more stressed now because I’m even more tight money wise than I was before. I was negative in my bank a few days ago and now I believe I have a good dollar and some change in there. I hope they give me a time frame on when I can pay my court fees and anything else because I literally can not afford to pay at this very moment.

Dude my fine is like $600 ughhhh. So my police friends told me that the cop that pulled me over is a 50 years in service cop. Old people got nothing to do so he’s gonna show up 😭

Haha I'm in Ontario but we operate the same. You attended a Provincial Offences Court aka traffic court and the presiding Judiciary is actually a Justice of the Peace (referred to as 'Your Worship') and is not a Judge (referred to as 'Your Honour'). The 'officer' in court speaking to the JP as you mentioned is actually the municipal prosecutor, they are the legal representative for the City and they are tasked with prosecuting charges issued by police officers. You and the prosecutor would've had a conversation prior to the JP being called into the courtroom. The prosecutor elected to amend your current charge (driving with a handheld device) to a lower charge that didn't carry demerit points upon conviction but is still a minor violation on your driver's abstract and a fine is still required, so that would satisfy prosecutions - it's basically a win/win for them. They don't care about points on your licence, that's only point system for the ministry or transportation to keep you and your licence in line. The city/province share revenue from fines and they also avoided a trial which can be costly to the city because city prosecutors can be dealing with by-law summonses which would result in a higher fine + more direct revenue to the city. The JP refused the joint position of a guilty plea to an amended charge because the JP felt it was too lenient on young drivers such as yourself and wanted this conviction to result in a lesson learned. The essay is extremely innovative in my opinion, we have yet to adopt that here in Ontario. Anyway, thanks for reading. I am just another government employee :P

@@mingyaoyang7555 This is where a lot of people are confused, demerit points or penalty points as they are called in B.C.. The Justice CANNOT reduce any penalty points. Penalty points are set by regulation and are controlled by the ministry of transportation to keep track of your driving record. Penalty points are applicable depending on the charge. Insurance companies do not rely on points, they only look at the disposition of the case. For example, if you were found guilty in Ontario for driving with a handheld device the fine is $615 + 3 demerit points, the ministry of transportation will ADD the points onto your licence and if you have too many points accumulated it will result in a suspension or cancellation of your licence. Your car insurance company will see that you were convicted (found guilty) of the handheld device ticket. Your insurance company will be not happy about it. This will warn them that you are a careless driver and therefore could prove to be a high-risk customer. Then you may see a dramatic increase in your premiums in the range of 10% or up to even 20%. In addition, if you are convicted for other traffic infractions too many times, then they may review your coverage and even deny renewal. If you cause a collision while driving and texting, then your insurer may increase your premiums by almost 50%. An at-fault accident on your driving record could raise your rates by even 100%. All of this is between you and your insurance company and has nothing to do with points. Thanks Brian. Your comment is very helpful. I got a ticket for not yielding to pedestrians 2 years ago, requested a trial but never heard back from the court. I just got a letter today saying I need to pay the fine because I am sentenced in absentia. I immediately called the court office and filed the documents for reopening. I do expect to have a proper trial, but this timeline is just ridiculous

Thanks Vy! Go to court 15 minutes early. In my case, I first asked if he was the correct officer. Then the officer will speak to you in private. The cop starts the conversation along the lines of: “So I gave you a ticket because you were doing XYZ on this day.” Listen to the cop and agree with him if you’re pleading guilty (I nodded my head to let him know that I understood). Then I admitted wrong by apologizing for what happened, and that I would be pleading guilty. After the cop feels empathy and opens up to you, then you can ask him for help because “I wont be doing it again as I have changed my driving habits.” At the end, the cop said “You seem like a nice responsible kid” and he changed my case. Later, the officer supported me throughout the court. Hope that helps^ in summary: Listen and agree with the cop. Then admit wrong and ask for help.

I agree with the way you handled this except for the fact that I do think it’s important to dress nicely when you go to court. Maybe not a whole suit and tie, but definitely a clean collared shirt and slacks with a tie. I think it shows respect for the judge and respect for the situation. It’s important to present yourself as a respectful and respectable person. Just my opinion though.

Thank you for bringing this up. Looking back now, I do agree. Presenting myself nicely would have conveyed more respect and seriousness to the judge and the courtroom. This is something that I will recommend now for future people going to court.

Every judge wants people to respect the court. Dress appropriately like it is a big deal. It is okay if you have work clothes on that way the judge knows you took time off from work to come to court. * Look like a bum or a lazy or uncaring person then that likely explains why you got ticket. Repeat offenders usually do not respect the court.

I looked at the code they got me for and doesn’t seem to be anything relevant to what I was doing. I’m wondering if getting a lawyer would help me in my case. Just very anxious and scared about this.

Hi Croup, it appears they cited you for the wrong offence. In that case, pleading innocent may be an option, as the current ticket you have is not valid. Some lawyers have a free consultation call, so do ask them.

I'm curious. Once your fine is given at the end after the sentence, do you have to pay the fine on the spot or else you are not allowed to leave? Or are you given a certain time limit after the court date to pay?

The judge will give you a certain time limit after the court. The pay date can be discussed with the judge as well.

I just got pulled over for improper erratic lane change and fail to obey highway markings. So the police offer said my bill will be 100 dollars total. But, I had no gas so I was trying to get their quick. I’m nervous I have a court next week

Al Obeid Hey I was in the same shoes as you. A good way to actually get rid of the nerves is to check out the court beforehand. It’s not as big as it is. Chat with your officer next week. There’s a good chance you can get it reduced.

She should have a chat with the officer. Not having a license seems like it might be less negotiable, but she could still save money on the ticket by being friendly with the officer and judge.

Hi Kevin, thanks for your video. My question is, I have a stop sign ticket worth $200 with 3demerits while I travel to Gatineau(Quebec) with my Ontario driver’s license last week. Due to the pandemic, I have to contest my ticket with an online form that has just 2 options “guilty or not guilty “. The incident happens at a stop sign during a heavy snow and my brake couldn’t hold the car to a complete stop so I have to move on to avoid being swerved off the road, immediately an officer pull me aside and issued the ticket. What’s the best way to approach this as the amount of the ticket isn’t my issue but the demerits? Should I plead guilty with the online form and see if I can get the demerits dropped? I have a clean driving record and this is my first ticket ever.

Hi Isaac, I had to fill out a form like that too, but not online. Not sure why yours only gives 2 options, because in BC we have additional options that allow us to go to court. I selected the option that says "guilty and go to court." Best way to drop your demerits is to find a way to go to court. (I'd maybe call the courts that issued your ticket and ask about that). Then negotiate with your officer there.

@@jaelind5061 well in the end it wasn’t as bad as I thought ( referring to the court scene ) was very quick. I pleaded guilty. My fine was about 900$ and they did suspend my license for 30 days so I won’t be able to drive until 28th of may

I also just got a texting ticket and disputed it. Did you hear of other's results during court for this issue? I wonder if most or all cops just drop the fine and lower the points from 4 points to 2 or zero?

I did not hear other people’s results but I’ll tell you what happened with me. When the cop and I were negotiating before entering the courtroom, he told me that he cannot lower or remove the points. But he immediately agreed when I asked to change the ticket to a Registered Owner (which drops the points from 4 to zero). The judge did not allow that, so I was stuck with the original ticket. If you work with the cop, he or she may change your fine to a less severe penalty. You don’t get what you don’t ask for. Best of luck with your dispute

@@kevinkang4427 Weird cause most of the time when people dispute, the officer lowers the penalty and possibly the points. Thats why people dispute tickets. Maybe your officer was just tough. At the end, your process of having to go court did had no results and you were stuck with original fine/points?

John Tran The judge reduced my original ticket from $368 to $50 after. So not bad, but not what I was looking for. Where I’m from, Vancouver, Canada, the point system might vary from yours. RoadSafety BC- which is separate from the court, makes these penalty decisions regarding demerit points. Along with our one and only Insurance Corporation. So after court, the two agencies likely assess what our fine was. Then they deduct points and insurance hikes as follows.

I looked this up and honestly your video kinda helped. But I’m stuck and idk what to do. I got cited for an accident that happened, I got careless driving plus collision with a pedestrian because the pedestrian crossed into my lane on a state road. There were no crosswalks and I have witnesses that told the officers the man that pushes her everyday took her purse from her and she was following him to get it back. Plea guilty?

Thanks Lexie. Seems like a bit of a complicated case, but I would start with: why are you pleading guilty? Do you want your ticket price reduced? Are you trying to reduce the penalty/ points on your license? Because it does seem like you are admitting guilt and are taking responsibility for it, such as when mentioning glancing at your phone. If you talk with the officer, he will most likely lower your ticket or penalty. And the judge will too, in the courtroom.

I have telephonic court, so I am doing it over the phone. Which makes things a little more complicated in terms to speaking with my officer.

Very possible. In my case, I didn’t ask for a fee reduction but got $300 shaved off. The judge will empathize with you if you plead guilty. For the most part.

Told him I was on my way home & and the weather was nice and I just been enjoying the empty road lol, was literally 5min away from home. As soon as he came to my window I apologized for speeding and told him once I aaa him I slowed down, and knew that I was speeding!

@@nickthelad23 Np man, love the candid conversation with the officer. One thing to note, however is that you told him that you were speeding. If you fight the ticket, the officer might use this as evidence against you in court. Do ask about this with your aunt/ attorney though. But truly, you are an honest guy with no bad intentions. The officer/ judge will be lenient towards you in court.

Looks like you got this figured out. In this case, I would follow your intuition. Regarding fighting it in court, it might take a couple months of wait before going to court. During that time, I would also consider the worth of your time attending court and preparing an argument.

Thank for sharing I m in Ontario Canada really worried had 10 yrs clean driving record its my first ticket in a construction zone there were no signs when u enter the road. So long story short I got disobey sign tkt turning right on red light I even stopped at right light for yielding traffic. Hi I don't reside in Ontario but what I can say is that disputing your ticket never hurts. Then, if you are concerned about demerit points, you might be able to negotiate that with your officer. They will be much more lenient due to your clean driving record.

I chose Option B. "I agree that I committed this offense and I want to appear in court." In truth, it didn't matter what I selected. The judge still asked me if I was pleading Innocent or Guilty.

I just got a ticket for not displaying an “N” and overloading, I told the officer my coworker took my N 3 days before the incident and I yet didn’t have time to pick up another N sign because I was off those next three days. For overloading, I told the officer that my buddies helped me replace my headlight bulbs that went out the night before so I treated them for food. I was completely in the wrong but do you think it’s still worth giving a shot to dispute it, what is it like?

I definitely think it’s worth to dispute, as it is your first offence and you are taking responsibility. I’m not sure what it’s like with COVID and online hearings, but if you go to court, show up 15 min early. Then you can negotiate with the officer and reduce/ drop a ticket. If not, the judge may reduce the cost of your ticket... The worst that can really happen is you spend 1hour of time.

When did you submit your letter? I think they’ll send you a letter late as it may be 6 months out for you to actually attend trial. Calling the court or local police department for an update might also help. I also found that going to outside of the court before your actual trial helps calm the nerve-which was also helpful during my trial.

I got a 615 fine ticket for handheld, when I pay it right away then I got a letter of 30 suspension. Now I'm waiting for the demerit points and insurance fees and suspension record on my license for 3 years. Insurance fee could go up to 50% higher. It means I was paying 280 per month and now +50% 140 going to be 420

TTV Z3X4L Depends where you live, for here in BC I believe a speeding ticket is $196. But sounds like your dad got incorrectly slapped with excessive speeding. This is something that should be fought in court or negotiated with the officer. Also no there is no death penalty for that.

Hey, so im required to attend court in person, *sigh*. I was recently caught doing 96 in a 50 mph interstate in staten island (nyc). I have to call the dmv tomorrow and schedule a hearing. Now im focused on searching for the things to say in presence of a judge. I've never been to court before this my first offense EVER. I plan on saying something along the lines of " goodafternoon your honor. I stand before you today in hopes that theres a chance of me mitigating the impact this may have on me obtaining my future license and to reduce the fine price". Bro Im essentially a beginner driver driven 7 times with my friends car. I currently do not own a license but i have a permit. (Dont worry i committed the offense with a licensed driver in the car which is my friend). I was using this opportunity to drive me and my friend back home as practice. We live in Brooklyn was comjng back from Philadelphia. it was my first time ever driving on an expressway/ freeway. It was 2 in the morning, we were tired and the road was vacant. Im new to the whole driving thing so i didnt think the act i committed can be thos severe. Now im facing 11 points before i even obtain my license. Hey man, I been through your same thought process. I also wanted my points to be reduced, and pay the full fine. I used to be overwhelmed by the whole thing. First, to answer your question: If the officer isn't there, the charges are dropped. You can plead innocent in this case. Now if your cop DOES show up, have a chat with him. Negotiate with him to reduce the points, and let him know you're pleading guilty. Once you get the cop on your good side, both of you can get the judge to reduce the ticket. Now your script of saying "good afternoon your honor..." is very respectable. From my experience, you are taking accountability for your actions and the judge will see this in a good manner, especially due to the fact it's your first time getting a ticket.

@@ronaldseyez Np bro. My friend was excessive speeding recently, and his cop didn’t show up so the judge told him “go slower next time” and dropped the charges. They don’t really have evidence to convict you if the cop doesn’t show up, aside from maybe driving without a license... But do ask others around your city, see what happen to them.

@@Fiddlestackss Nah, i never went to court yet because they kept postponing the hearing date presumably due to covid. As of right now my next hearing date is in july. Im thinking about just paying it off in full, i still have no idea as to wat the exact price of the fine is, but i spoke to someone at the dmv and they said some where around 500 😅. Though the fine stated that the offense i committed requires me to attend court, im now not to sure how accurate that is because when i called dmv the same person stated that i could speak to a judge over the phone and just pay then. Honestly not to scare u or anything but i HEARD that the judge at the traffic court in staten island is horrible and has one of the highest like convictions in ny state i believe. It’s very unlikely they will take away your privilege to drive. You can certainly ask for reduced points, as your record is clean. I’m not sure about lessons though, we don’t have that where I’m from.

@@jakobabrahamssonortiz7060 Np up to you to plead guilty or innocent, I’d ask a lawyer if you want to plead innocent. But the key is to talk with the officer-by going to court 15 min early. By negotiating with the cop (to plead guilty), they can reduce your points or modify the ticket.

Hey Jaay, You don’t go to jail from traffic offences. The worse they can really do is suspend your license and make you pay fines. Now because you are pleading guilty, it will help you lower your fine amount if you do it right with the judge.

There’s two violations I see there. Speeding and no license. I’ve heard cases where you can ask the officer to drop one charge. But I’m not sure about the severity of your ticket and where you’re from. Are you pleading guilty?

Having a clean record is good when you’re going to court. If you’re pleading guilty, there’s a good chance your ticket will be reduced and you’ll pay less. Go to court 15 min earlier as well and talk it over with the officer.

Hey bro me and a coworker got caught racing. We both lined up and the cop seen us and as we both pulled away he sped up and knew we were racing but didn’t know how fast we were going. He wrote in the ticket for the both of us that we were going 85 on a 65 and Monday will be my our court date. This is a tough call. The judge will ask you quite a few questions, so I think being real with the judge will serve you well, as you can confirm the stories. That might also lead to a reduced ticket since you guys are honest.

@@KingKongDill it was nerve racking at first. My best advice is to dress well, which I coulda done better to show additional respect. By arriving a bit earlier you may also see the officer and chat with them.

I got a ticket for a Disobey Stop Sign here in Saskatchewan worth $230 and 4 demerit points. I'm taking it to court and chose Option 3 which is a Plea of Not Guilty Form. that being said, I could use your help. So basically I was wondering if you knew the steps from here on out. So am I correct in thinking that my next step is to mail this ticket back with the Option 3. Then wait for a response from them for a court date? Sorry, if that was a dumb question but i'm new to this and all ... it feels a bit intimidating.

Hey that’s right, you need to mail in this Plea of Not Guilty Form or go to a physical Driver license location and give it to them. Within weeks (sometimes months) they will send you a court date. And you just have to show up then.

Melanie Roselle Yep. I witnessed it as well, one of the people in the courtroom had an officer that wasn’t showing up so the other officers told her she’s lucky haha

Not true. Some cases you also have to pay court cost if you accept it ALOT of people say well if you are going to accept it then why take the time to just go to court?

Oh hey only 3 years late on this video (thanks KZfaq for the random recs), but if you're cited for texting and driving, the only way you could be guilty is for actually texting and driving. You weren't cited for "looking at Google maps". So you can contest these simply by showing the time stamps on your phone that you were not in fact texting, and the officer's claim that they saw 'blue light' is just hearsay.

All States have a Motor Vehicle Code within that Title you can find what i have found = Washington State...... Title 46 RCW MOTOR VEHICLES RCW 46.98.030 = Title, chapter, section headings NOT PART OF LAW. Title headings, chapter headings, and section or subsection headings, AS USED IN THIS TITLE DO NOT CONSTITUTE ANY PART OF THE LAW. [ 1961 c 12 § 46.98.030.] All traffic tickets in Washington State fall under Title 46 I did not break/violate any LAW...... Case Dismissed...........

Are you had to deal with request traffic school and it will not show up on your record. The courts will always great to traffic school because it is money for the city, in the same way that's why they wrote you that ticket because they have a ticket quota to meet.

That sucks I do not know the justice can reject a plea deal and why is he doing that if the prosecutor is willing to accept the term then he is not. Can you appeal and ask for another trial instead?

Even though I negotiated with the officer before the court started, the judge rejected our plea deal because it would have eliminated all my points. The judge said it isn’t fair to the legal system. I had to be held responsible. To my knowledge, there is no re-trial. Once the decision was made, I had to go down and pay the fine immediately.

@@kevinkang4427 I mean if there is a victim in the situation or your action have cause some damage to the public then it is fair to say it is not fair to let you off easy. In your case it is just youself not one else is harmed. I think the legal system supposed to correct and teach people in the purpose of making us safe. If you learned your lessons and will not do it again in the future then it serve its propose. This justice basically cause you to lost your license and the rights of driving and leave a premnant record on your life for a small mistake you made when you young. I think that law doesn't simply mean to punish people like this. And you plea guilty because you and the officer established an agreement. If the justice is not going honor it then you should have a right to have trail proceed like normal rather than just let him impose a harsher sentence.

@@GiftOfSpiff The court reduced my fee, gave me a probation order NOT to get my license suspended. But then, ICBC (our government driving insurance company) suspended my license lol. And I failed the appeal, even though I showed them the court documents of my probation order. So I did my 3 months of driving suspension and it’s all good now.

Only 440? No court summons or anything? Man you’re lucky. I did 78 in a 40 (was late to work and I wasn’t paying attention to my speed) and right when I noticed my speed and began to slow down, a cop got me on his radar. I’m 16 and might get a misdemeanor and confiscated license.

I am going to the court next week for disputing 2 tickets as using electric devices. I was holding my work phone and charging my self phone besides the passenger seat. The cop caught me and saw the 2 phones. Gave me 2 tickets with the same reason. Mine is about 720$. Wondering if I can reduce the fine to half or 50$ as you?

2 tickets from the same offends? Never heard of that one before... that’s messed up. I think you can negotiate with the officer to drop one of the tickets, or reduce the fine of at least one of them. Otherwise, it is hard to believe that you were using two phones at once, and I’m sure the judge will side with you for that.

@@kevinkang4427 yes, from the same offends. That’s ridiculous. My goal is removing both but that’s only happen if the officer does not show up. My plan is arriving there earlier (30 mins). If I see the officer, I will call the court immediately and reschedule to another time. Not sure if that’s doable?

@@kevinkang4427 just an update for today’s hearing. A good news and a bad news. The good news is I finally rescheduled to another date even though the officer presents today. I prevented that I have cough and does not fell very well. The JP tell me i will have a new hearing after 3 months. The bad news is the officer is retired. He definitely will show up in the next hearing.😂

I just got a speeding ticket for going 10% above... So did you just call and say you wanted to Plea Guilty at the cost of removing points? People are telling me to plead innocent that Houston cops don't really show up, especially during these times and weather..

Not sure if it’s different in Houston but you can call in and ask. I'm thinking for a demand like that, you will probably have to appear in court. 15 min before court started, I was able to negotiate with my officer to change my ticket and remove the points. And there is a chance that your officer will not show up and your ticket gets dismissed.
