In order to arrest, you have to convict or have convincing evidence. They don't have that yet, and Brian is still just a person of interest at this point. They also have to have proof that a crime was comitted by the parents that justifies an arrest, and an arrest warrant has to be issued. If they went around arresting people who might be involved, our jails would be full. I know what you're saying, but it's easier said than done. There is a procedure and set of conditions that must be met to arrest someone.

Maybe the police didn't see him leave the parent's house because he was never really there. The parents picked him up somewhere and had a picnic family reunion at Fort De Soto park and that's likely where they plotted/planned how/where he would hide but wherever they left him from there, he had all the provisions/tools he needed to get a head start in hiding as a fugitive

He might be in the Utah wilderness, California or Colorado and likely moving around the Western states but he wants people to think he's out East in the Florida Carlton reserve or Appalachian Trail, so he pretended to drive Gabby's van home but it was likely someone else driving it there or they paid a transport company to drop it off at the parent's home on the advice of their attorney who likely talked to Brian, and told him to keep away from Gabby's van. He wants police/FBI/people to think he's anywhere but where he actually is to avoid capture
