Thanks for the quick reply. This happened to me in Green Cove Springs, FL, the cameras do not have pictures of the driver. What if I told them it wasn't me driving the car at the administrative hearing, and that the burden of proof to provide evidence is not on me but on the law enforcement? Or I could tell them, I forgot because I let a bunch of people drive my car.

Hi Dale. I've seen this happen a few times. I would suggest you call the police station of the City where the violation occurred. Ask them to transfer you to the red light camera enforcement department/division and speak with someone about the error. They should be able to clear that up for you without you. Hope that helps!

Malcom, great question! If you were unable to make a stop before the "stop line" on the pavement but were still able to avoid crossing the intersection, it would be a valid defense. If you were forced to cross the intersection on a red because of someone behind you following too close, it would make it more difficult but still possible. Good question! Because the $158 notice of violation is not a ticket yet, you can't do traffic school for it. In fact, even if it WAS a ticket, traffic school is not an option with these tickets. If you want a chance of not paying the fine, you should consider fighting it, but only if you have a chance of winning! Typically, once the violations turn into tickets, the court will schedules the hearing on the same day for reach if they happened around the same time. I appreciate the question! The issue date on the Citation is not when it happened, that date reflects the day the first notice became a citation. In your case, the actual date that the alleged violation occurred was August 26. The reason he did not receive the first notice is likely because the car is under a company and the notice is mailed to the address on the registration of the car. 30 days is typically the average but it is not uncommon to get it later too. To avoid missing it, make sure the address on your license AND registration are up to date!

However, even if it WAS already a $277+ ticket, you still wouldn't be able to do traffic school for red light camera violations, only tickets issued by an actual officer. American Traffic Solutions, the company who send these Notices of Violations, are required to send the Notice of Violation first. This notice will be sent to the first person listed on the registration and to the address on that registration (which isn't always the same address on the license if it hasn't been updated). If the address is not up to date, you will never receive it. If the Notice is to answered, they will notice the County clerk and they will send the UTC to the address on the license. At this point, I would suggest you fight it, as paying would result in a conviction on the license. Hope this helps!!!

Hi Xitra! Unfortunately there is a lot of bad information out there on red light camera tickets. As of today, May 16, 2019, Miami-Dade County has not banned red light camera tickets. However, there are many cities within the county that are no longer enforcing them, including the City of Miami. Your best bet is to contact the city where you received the violation to confirm if they are still enforcing them, if they are, then considering whether you want to pay or fight it. Hope this helps!

Fernando, this typically happens when the address on the registration is different from the address on the license but can happen but can also happen when the notice gets lost in the mail. Unfortunately, once it becomes a ticket there's no going back to the initial Notice and if you pay the ticket now it will go on your record. If he paid the initial notice of violation at $158 she will not get points nor will it show up on her driving record. If he paid the $277 ticket, she will not get points, but it WILL show up on the record, which may impact her insurance.

If it has already become a citation, I would suggest fighting it since CDL holder are held to a higher standard and you don't want this affecting you later.

Second, although you are right from a common sense point, the law in Florida isn't written that way :( If you receive the Notice of Violation and you were not the driver, you would need to mail an affidavit in.... hopefully these red lights will be permanently removed soon.

@@TicketFit I hope so I heard a house bill was submitted. So in the affidavit do you have to provide a name or can you say you’re not sure who was driving? It seems to me that those are cash cows for the city.

@@frontlinepfknr Yes, a bill was introduced not too long ago! In the past, you could have simply stated "I am not the driver and I don't know who it is" and most municipalities would accept it. I guess they quickly realized they were losing money so they changed things to where you now have to identify the driver or they won't accept it. Nonetheless, these can still be challenged in court.

If you want to fight the initial notice of violation, you would have name the driver in the affidavit. If you want to fight the citation, you don't need to name the other driver.

@@TicketFit hello I just received an redlight ticket and didn't know I got one but if you look at the picture you can clearly see 2 cars in front of me with all evenly space between us but apparently since I was the last car through the light must have changed instantly as I went through not realizing that it changed red since everyone was in perfect spacing but I have a feeling that's how they get multiple people by changing the last few seconds so whomever the last person through gets a ticket and I have so many other things to worry about bill wise family company etc so a $158 charge out of pocket is not something I can really afford so really would like some advice on how to defend it based on the fact that the lights timing is way off so any advice would be greatly appreciated thanks Rob

HI Omar! If you pay the first "Notice of Violation" it will NOT go on your driving record since it's not a Uniform Traffic Citation (a ticket) yet. If you get the Citation and pay it instead of contesting/fighting it, it does go on your record.

Hi Grace, thanks for the question :) If a $277 Uniform Traffic Citation (UTC) hasn't been issued yet, here are your options: If your primary concern is her not finding out, you can pay the $158 Notice of Violation and it will not go on her driving record. If you want to fight it without it going on her record, you mail the Affidavit of Liability transferring the violation to you. However, you would need her to sign and notarize the affidavit. **IMPORTANT** Before deciding wether or not to fight it, or if a UTC has already been issued, I suggest you contact us or a traffic ticket attorney of your choice to review the violation first.
