There's no labour immigration laws it's just the immigration law which he clearly has no knowledge of! The critical skills list was singed and implemented in 1st of February 2022 so he clearly knows nothing. So sad

It is very shameful to hear Thulas Nxesi saying NEDLEC is sitting with some draft, whereas the problem of unemployment has been with us for a very long time. This government has failed us. In situations like these the masses will rise and do as as they please. It is time this country wakes up and mandates another party to take this country forward.

@@jayjayn007 you just hidig behind the finger, its already beyond none south africans, some work places demand locals first thats is not from outside the province i experienced a situation whereby locals were sourced from gauteng to work in mpumalanga and there was commotion.Again let there be a law to reserve certain jobs and businesses for locals only.at home affairs the are quotas we do not expect to see artisans with recents permits unless they have perm res becoz we have local artisans,as we speaks none south african it engineers,doctors, and more scarce skills personnel are already flocking out of RSA, zimbabweans inclusive and no one is replacing them because of the skills.

Am listening to the Labour Minister ( whom I was not even aware he existed)...It was so insulting to listen to his comments. Now I understand why we have such labour related problems in the country. He's not in sync with the labour laws of this country. I Have worked for big corporations. These companies were taken to task or even fined if they had given preference of a position over a local professional. They had to prove beyond doubt that they had explored every avenue to fill a critical skill before importing that particular skill. Yes the current minister was not in this position then. but that law imposed to the corporate companies then still exists. If a local citizen applies for a business licence or tender locally, you are expected to furnish how is your business going to benefit the locals where the business venture is proposed. In the light of this, how much more then, when it comes to foreign employers ? are they exempted to this law? Does it only apply to SA citizens only ? It has become a norm for foreign business owners, Chinese, hospitality industries to employ foreign nationals because the Dept of Labour (Minister) is ignorant in this portfolio♪, that goes for his predecessors as well. He needs to tell SA what processes are in place for a foreign national applying for a business registration in SA.? Most of these Chinese businesses only accept cash. Why? Do they pay tax ? SA citizens have to be subjected to a hectic process to register a business, let alone applying for tenders. Young people pursuing business opportunities can attest to this. These foreign owners are the ones who incite xenophobic violence among Africans. Not against any African but every country should put the citizens first in accordance with the ratios stipulated by the labour department. Am sure our sister countries have the same laws, their tax paying citizens first. Just how is this country going to be sustained if the young brains aren't part of building SA economy ? Does the minister understand the serious repercussion of this SA for all, where will the upcoming generation fit in tomorrow? Grants are NOT the solution but permanent destruction to the young people. To address this issue further for a breakthrough, a dialogue is needed with the minister and the other stakeholders, not just a 2 minutes TV interview SA youth is owed that much . EFF and PA would not have taken the matter into their hands if the labour department enforced the laws. Take a stand minister for the SA masses who voted for your ruling party ... SERVE them. That also goes for the relevant unions in this industry....Where are they anyway ?

That’s why youths of those African countries nearby western countries are fleeing to western countries and risking their lives on the oceans 🌊 because their countries are not putting them first and this foreigners coming to exploit the youths in their own countries or continent. Now Chinese foreigners are illegally taking land on Zimbabwean because the leaders are not putting their people first. Africans will always struggle because their leaders are not putting their specific citizens first.

What do you want him to do? Break the law! Get an education and drop the emotionalism. SA will soon need the rest of Africa as trading partners if it is to survive as a strong economy. As the African Free Trade grows, there will be plenty of jobs for everyone.So do not burn your bridges my friend. Just be patient. Listen to your advisors and learn. Open a business and then ask for contracts. You will be rich within 10 to15 years

Tjo the interviewer is frustrated, she had to level down her questions in scenarios because the minister does not know the law. She also corrected him that a critical skills list is available but it being reviewed. The minister does not understand his job.

The Minister is not answering the questions put to him. He can't put legislation to accompany his answers. This is where Cadre deployment is a major failure. The high levels of unemployment in our country can directly be attributed to placement of incompetent politicians and highkey tenderpreneurs.

Its surprising that the minister says only now they are realizing that SA has an issue of high unemployment, I mean after 28 years they only trying not to deal with the migration issue laws and polices and I also hate this victim act of refugee nonsense I believe that if u are refugee u can not come in and out of ur country and the host country like u going to holidays, this shows that we are a banana country where immigrants do as they please and I know most of South African are skeptical of change and I also believe that ANC lead government is too soft and we need someone else to lead this country they have failed.

Can we vote out the ANC, these people don’t even know SA law. This is a disgrace where our fellow South Africans are sitting at home and fools like the Labour Minister don’t know the law. The Constitution has section 36 which is the limitations clause, we can preserve unskilled & semi-skilled jobs for locals.

Hold up, here there is the discussion of foreigners vs South African employment. Please define a South African because apparently if you are white you are a foreigner therefore not meeting SKIN COLOUR quota. So how does this apply to dischem? The law on work permits actually indicate that South Africans must first be considered before foreign nationals hence we have unemployment registrations. Quottas are for scares and critical skills. The Department fail us by not instilling and prioritising on inspections of workplaces.

NxesiThulas 2say SA doesn't have laws prohibiting non-scares job offers. Both s19(2) of the Immigration Act & s8(2) of the Employment Services Act prohibit job offers 2migrants when unemployed SAns r available 4such. Please tell Nxesi to read the laws of this country

The minister/ ministry is not even reactionary. They don't understand that they are against time. Unlike Home Affairs Dept. who have done damage control. They can't have that mentality with the likes of this minister. He doesn't understand that he's against time to do damage control. As for the EFF, they are trying to do damage control but are too late because even now, they don't prefer that entry and minial jobs that can be done by South Africans be solely reserved for South Africans.

When police fails to stop looters minister Cele responded exactly as Thulas Nxesi looters were many then all security authorities him Nxesi said they are dealing with many employers that's why they fail regular inspection as a labour department ... this people are tired and very old to handle anything in south Africa . Now even if they are facing media they are struggling to answer even a simple question no no no is a shame.

The ANC doesn't care about South Africans. Why is it so hard to pass laws that protect rightful citizens. What's the point of belonging to a country, what's the point of having an I.D, paying tax, following the laws when the country's laws won't protect its citizens. We are forced to follow rules as South Africans, but what do we get in exchange for that. We are not defended, we are not protected.

We have a labour and employment minister? who would've known? Where has he been for the past years? In China, Cuba Russia reading up about marxism? FFS with an annual Salary: R2,211,937 and all the extra perks and pension- he has no qualifications in labour, economics, business, project management etc etc - sure he is a teacher - I love teachers- but come on he is clearly a cadre appointee- this is precisely why we are in the sh$t. The "vision" of the department of labour as per their website is to : Regulate the South Africa labour market for a sustainable economy through: Appropriate legislation and regulations. Inspection, compliance monitoring and enforcement. Protection of human rights. Provision of Employment Services. Promoting equity. Social and income protection. Social dialogue. I see a lot of "social" and human rights " this and that- fair enough but what about creating job opportunities for all?- zero about that except to bloat the public service like some kind of Chinese hybrid model FFS the Chinese will lock up any minister that doesn't do their duty yet here we want to follow their model - a bunch of morons

From what I know, business owners and employers in general are in the practice of running businesses and making profit so as to meet operational costs including the payment of salaries. Therefore they become averse to nursing headaches caused by constant demands of pay increments, absenteeism and unlawful Industrial action (strikes), that is why the status quo subsists in South Africa.

From experience as an entrepreneur, The restaurant business has so little profit margins, which have already been exacerbated by the covid crisis. The reason there is a lot of foreigners as waiters is bcz in most instances there is no basic pay and the waiter only depends on their lucky to get tips from patrons as income. There is no other business model to use to remain viable as a restaurant unless they pay like that. The only other way is for gvt to subsidise these business by taking the resources used in deportations etc, subsidise the industry and make a condition precedent of hiring only locals as waiters with some form of basic pay. Gayton Mackenzie himself knows that running a restaurant is tough and thats why himself and friend the King of Sushi closed down their pub which resulted in job losses. It will be interesting to find out how Gayton and Kenny were employing and paying at their pub to establish credibility in the sense that they practiced wat they are preaching.

Restaurants s profits is on beverages especially ALCOHOL. Carte blanche found that restaurant profit margins on one bottle of wine is 40 times what the wine farmer makes since they sold it in glasses rather than bottles

However, it also depends on many factors, location, rentals etc, plus there are just too many restaurants and very few customers for those wines. The rich that afford expensive restaurant wines normally buy their wine from liquor shops and keep it at home. A typical example of how tough this industry is is that pub that Sushi King and Gayton with how rich they are, but still closed down..how then do you expect a normal working class entrepreneur to survive if even the super rich chickened out. However, from my initial post, I am agreeing with the call of South African citizens to be considered for jobs in the industry first. However, such a proposition will only work if the industry is subsidised in order to enable basic salaries.

It is so interesting to watch the same opportunist politicians exploiting the same pertinent, but divisive issues found all over the globe. These SA politicians behave and sound like right wing parties like UKIP, the English complaining about the Poles and other eastern Europeans. Are the parties going to deal with all the people who illegally and immorally gained citizenship through the crime of colonisation, and by extension their descendants as the offspring of illegal immigrants? These are interesting questions.
