This low-quality video out of Washington (about which I am intentionally not providing much in the way of background information) demonstrates just how challenging it can be for some people to remember that when they are on the receiving side of an interrogation, the only intelligent move is to invoke your rights.
I want to take this opportunity to clarify some things as best I can (while noting that nothing I write here is legal advice):
Some find it strange, but in order to invoke your right to remain silent you MUST speak. Merely remaining silent or using your body language is insufficient. Not only that, but you must invoke your rights by speaking in a clear and unambiguous manner. Again: If you want your invocation to legally count you must state that you wish to remain silent verbally and unambiguously. The only alternative is that you have waived your right to remain silent.
Any of the following should suffice:
“I am invoking my Miranda Rights. I will not answer your questions and I want to speak with my attorney.”
“I refuse to answer questions and want to contact an attorney.”
You can even say, “I am invoking my right against self-incrimination.”
Now, you heard the officers in this video badgering their subject about how obvious it was that his silence implied his guilt. So why would you invoke your rights by explicitly referencing your right against self-incrimination? Isn't that incriminating? No!
Realize that the only reason those officers were legally allowed to do what they did is because the subject in this video never actually invoked his rights until the very end of the video.
At which point - as you saw - the interview immediately ended. That was not a coincidence!
However someone asserts their right to remain silent, it must be remembered that they people are allowed to change their mind. How might that change be communicated? By speaking or answering questions! Therefore, if you ever invoke your right to remain silent it is incumbent upon you to show with your actions that you are in fact invoking your right. Be quiet. Your ambiguity can undermine even your explicit statements.
Don't be the guy in this video. He may be innocent of all charges and he may be guilty, but speaking with the police did nothing to help his case.
In an upcoming video I will show you someone who tries to invoke his rights ambiguously - through his silence - and who would have been far better served by speaking the few words necessary to clearly invoke.
Finally, I would be remiss if I did not note that it can certainly be appropriate to speak with police officers -- if you are the one who called them.
It may seem as though I am trying to protect criminals. Absolutely not! Police interrogations in the United States have a goal, and it's not "finding out the truth." That goal - the purpose of the Reid Technique - is obtaining confessions. From whomever is sitting in front of you.

I’m almost 77...a grandmother of five fantastic boys...Never been in any kind of trouble... church going... baker of fresh bread and cookies. But... as sure as the grass is green, I would definitely STFU, and ask for an attorney. You never know.

YOU ma’am are one smart lady! I’m a middle aged, single, disabled woman living a quiet life on my land out in the country near my family. I have two degrees and had a career in business. I’ve had two speeding tickets that I immediately paid but never committed or even considered committing any crime. Having never been in a police station, if they called me in and started questioning me about some crime I’d say “I’m exercising my fifth amendment right to remain silent and won’t talk until I’ve spoken privately with a lawyer and when she’s present.” Then I’d STFU. Period.

Because it's very easy for us to sit here in the comfort and safety of our homes and say "I'd never talk to the police"... But when you're actually sitting in a station, and are about to go to jail and have your freedom taken from you, you have work and other responsibilities that you must attend to the next day, etc. Then you start rationalizing on what you can do to go out of that situation. Intuition is to "talk our way out" of things, which is what people fall into. It's hard to stay level headed when your life is being turned upside down.

SERIOUSLY! How do they (the police) fall for the whole “hey you know just like I do it’s in your best interest to talk and not retain a lawyer “ routine? They know SFST are bs and not retaining a lawyer as soon as rights are read is also a no no. But they can’t help but tell their story.

In fact, it rules that out. It's pretty explicit that anything you say can and will be used against you... It doesn't say 'or maybe in your favor'. They're pretty explicit that they will not use exculpatory information you give them in a court of law. They consider that your lawyers job.

That’s not the job of a police officer to exonerate, though, is it? Your silence can be used against you in court because it suggests that you’re hiding something or have no credible alibi. You’re fully aware of that so you pipe down. Judge and jury will make inferences from that, like you would if the shoe was on the other foot. It’s not a rocket science is it? Sometimes, people are wrongly arrested and they will happily talk about it so I struggle to see what issues are here 🤷🏽‍♀️🤷🏽‍♀️ The Miranda is perfectly fine.

The really messed up thing is that anything true and honest your say in an interrogation can't be brought up in court, because it's considered hearsay. So if your defense attorney wants to ask the interrogator about something true you said in interrogation that helps you out and was proven true, the interrogator can't say it, because it's hearsay.

@@HvacHeathen idk man, sure he's a cop...but if they had all this evidence then they wouldnt be interrogating him. All they have is a girlfriend that's refusing to talk, and a cab driver that says he yanked his girlfriend out of the vehicle. That's hearsay and not substantiated. They're trying to get him to CONFESS to putting his hands on her because that's all they will have. Btw, I havent finished the video, but I can tell at more than half way through, they dont have any evidence whatsoever. It is perfectly reasonable to think that a disgruntled cab driver that just got cussed out would spin the story one way, or if he seen how irate the boyfriend was, he could've been worried something could unfold. It was all perception. But perception isn't evidence.

I've been in his shoes, always envoke your right to remain silent and ask for an attorney. YOU CAN TALK YOURSELF INTO HANDCUFFS; BUT YOU CAN NEVER TALK YOURSELF OUT OF HANDCUFFS!! Detectives already know before hand whether or not they're going to arrest someone before an interview & whether or not they've got enough evidence to proceed & charge you with something. Envoke your right,be clear,be Stern, & STFU. The cops tell their own family to remain silent and lawyer up. That speaks volumes!!

@@JoelBulger Remember, they have the upper hand with sealing off all the roads, collecting their evidence, doing their investigation, getting a hold of people (witnesses) before they (the witnesses) even get a chance to have lunch with their own mothers! Not only that, but they also make sure (if you're the accused) you don't have access to any of this investigation, you don't get to know who they've spoken to already, who they haven't spoken to, and how much evidence they really need still. But for every witness, the stronger their case is, the more people know the accused, the more details they have about you (the accused), the stronger their case against you is. On top of all that, the police are allowed to lie to you in the interview---which can throw you off to what they have for the case against you. And so when you go into that "interview" room, that is the most dangerous part-because your statements can be used as evidence, and so if you speak, they can seal the case right then and there. But if you lawyer up, you have a better chance of having a lawyer have the same access of what the police had gathered, and it's more of a fair game (though not by much I'm afraid). The accused is still left with a burden of evidence stacked against him, but if had lawyered up, the evidence of this interview would not have ever been placed on their laps. They would have had to work to find other evidence, which is more work them. That's why it's tough to be in that room. These departments have at least one interviewer that is a senior in this game of deceit and trickery used during their interviews. You can really never ever talk your way out of a charge, ever. Every sentence you make is recorded and transcribed for evidence and for the court proceedings. You have no chance. But you may have a chance if you lawyer up and let the lawyer go head to head with what is now You vs. the entire State.

Myself being a former cop, I can honestly say that this is the BEST advice I have seen someone write on here. You are absolutely 100% correct. Most people that talk are intimidated and scared that they will be arrested right away. Like you said, they already know before hand, if you are going to walk out of there or not. A LOT of people that would’ve gone home had they invoked their 5th amendment, went instead to jail, because they were coerced into self-incrimination. Great advice!

@Kyle Castloo Technically he didn't lie....he just didn't explain that case files are open to public scrutiny.... One of the reasons rich people and large companies make "settlements" is to avoid going to court...you always hear it's due to costs....but most people don't realize that court cases (and ALL evidence and files involved) become public record.

I was arrested several times back when I was young and stupid and while I was almost always high or drunk (and usually both) at the time, I always remembered to do three things: 1) Cooperate with the police at all times -- regardless of whether I thought they were being unreasonable or unfair. 2) Treat the officers and jail staff with courtesy and respect. 3) And make one official statement: "Respectfully, I wish to invoke my right to remain silent and speak with my attorney. " Simple as that. The police would usually spend a few minutes trying to convince me to talk (instead of ending the interview, which they are supposed to do at that point.) They tried every line in the book: "Now's the time to help yourself"; "I promise you'll feel better"; "Don't get left holding the bag"; "We already have all the evidence we need," "Your girlfriend told us everything," "You know not talking makes you look guilty, right?" (actually, guilty suspects are far more likely to talk to the police than innocent ones); and my favorite, "I'm here to help you." Most cops are decent folks, but they're trained in the art of deception. Remember, once an interrogation starts, they're not looking for the truth -- they're looking for a confession. I ended up with jail time twice -- for 6 months and 3 months. My lawyer told me years later, after I'd cleaned up my act, that cooperating and not answering questions probably saved me a total of 2 to 3 years incarceration -- time I would almost certainly have had to spend in prison instead of the county jail (where sentences of less than a year are usually served.) So bottom line? If you're ever arrested, swallow your pride, be respectful, follow directions -- and keep your mouth shut.

@Phoebe Friday Right you are, Phoebe. I don't know if the police in Australia are as aggressive as they are in the U.S., but I think they can only question you for a limited period of time, is that right? Something like 4 hours maybe? I'm not positive on that. In the U.S. they'll keep you in an interrogation room for 12 hours to try to wear you down and get you to break. The U.S. has come a long way in the last 50 years when it comes to suspects' rights, but some police still try to get around them.

Trust me, if I feel I need forgiveness for something, I will go out and humbly seek it myself. Vicarious redemption through human sacrifice isn't really something I'm in to. Neither, for that matter, are religions whose "holy" texts condone -- and even order -- genocide, misogyny, bigotry, slavery, forced conversion and the eternal torture of innocents, especially children. Wally Banter what country are you in? Interrogations are about a confession because in these interrogations the evidence is typically there that the person being questioned is there for a reason. If it was just about pressuring someone into saying they did something they’d pick people off the street and start asking questions

@@tomerph Hey Tom Anything After the person's Miranda Warnings/'Rights' have been presented (and the person understands the rights) can be used in court. If a person initially waives his/her rights but during questioning decides to exercise his/her rights ~Anything said between Warnings and the Request can be used.~ When the person requests an attorney or states that he/she wishes to remain silent all questioning stops. Investigators are not to continue asking questions regarding the circumstances of the arrest. Hope this helps 🙄

I caught so many lies and half truths just from this chat. He said he didnt know the time, but later says 12:30 or 1" He keeps saying "I didnt beat anyone up...i said some things" but doesnt say "I didnt touch her" over and over. Then says "I mightve helped her out" That right there is enough to put him away. Along with the witness and search of the home, slam dunk case all made possible by his testimony.

Those interviewers gave him several chances to get out of that and call a lawyer in. They tried to help a fellow cop simple. They repeatedly basically said we dont gave enough evidence until you tell us more. He missed the signs.

No, he emphasized that his favorite right is being able to say no at any time, which assumes the person is already responding to questions (what he really likes about it) and instills a false sense of control over the situation, of which the suspect has none.

He also was emphasizes that particular right because he wanted to redirect the suspects attention away from the the other miranda rights. The right to an attorney. Asking for an attorney immediately forces all questioning to cease and the interview to end. Whereas when they try to stay silent, the investigators can usually “talk” them into eventually opening their mouth.

No matter what anybody thinks about this guy's guilt or innocence, it's important to understand that the Police are NEVER EVER, trying to help you out when they are interrogating you, they ARE completely aloud to lie to you and they absolutely will. It's clear in this case that the Police were under the impression that they were dealing with an alleged abduction/kidnapping case where they took some sizable enough measures that they are concerned that they may be asked to justify them if nobody gets charged. In order for the Police to ensure this guy is charged, they must meet the standards of domestic violence because it sounds like the girlfriend is not cooperating with them, domestic violence does NOT require the cooperation of the victim for the Police to charge and prosecute.

After 15 years in a law office, I tell my friends and family, if you get yourself into a situation where police are investigating you and you are detained, forget how to talk beyond saying you want an attorney. You are not going to talk yourself out of the charge right there or out of going to jail. You will only make your attorney's job more difficult and reduce your chance of proving your innocence. It won't be easy, you may get pressured to talk but close....your.....mouth!

I did a ride-along with my local police department at the beginning of 2020. I asked one of the officers that I was with, "What is the biggest mistake that people make when they get arrested?" The officers response: "Talking to us without an attorney present." He didn't even hesitate. This guy didn't want this being recorded because he didn't want everyone to see it. The police told him that this would only stay in his case file but here it is on KZfaq
