Nice explanation. Put details like Deed of succession and Deed of Relinquishment. Because many Non goans are not aware. Specially bank employees who are non goans but they work in Goa.

Thanks a lot. Nice video very crisp and upto the point covering all the possible condition. Thanks for sharing the knowledge which would otherwise be known by layman after multiple lawyer visits. Only one suggestion try to include some specific Konkani/ Portuguese/ marathi legal terms that are inherited from olden times that are mentioned in our laws.To have holistic understanding to veiwer.

1.Are these laws equally applicable to persons domicile of other states buying property in Goa? 2. When a married person buys property, his wife becomes 50 percent share holder. In that case can the husband and wife indipendently sell their half shares?

Hello sir. Good video. One clarification required. I am from Cortalim Goa. we are two families staying in common house with open space on sides. ploat area is 688 sq. MTR. Presently we want to make partition deed to get individual titles. To register partition deed sub registrar wants NOC from town planning which town planning refused me to give. Court option is last as we want to make partition by mutual consent. What are other legal ways to partition same property with registration in sub registrar office for which NOC from town planning not required.

Nice advice sir I'm buying a house in Goa. The land is 700 sq mtrs and house is built on 150 mtrs. The sanad is only for 150 sq mtrs., the portion of land occupied by the house. Is it valid ?

What if the person doing a gift deed is single..? Does the donor need any ones concent or the receiver needs to take any once concent ?

Hi Keshav, technically, if the donor dies even without children, and if his parents or grandparents are alive at the time of his death, they can claim their mandatory share in the gifted property. So, if the person had no children at the time of his death, the mandatory share of parents is 1/2. If there are no parents but the grandparents are alive, then the mandatory share of the grandparents is 1/3rd. If there are no children, parents or grandparents, the gift is safe. So ideally, you should make all such persons confirming party to the gift deed.

Hi Rilynn, In your case it's always advisable to insist on a Deed of Succession for two reasons: 1) in case there is an excluded heir who subsequently shows up to challenge the sale, you will be able to claim bona fides for having acted on the deed of succession. 2) all banks will insist on at least a Deed of succession for title clearance before sanctioning loan. Property was sold in 1997 due to busseness lose n in depression n did know what to do bank also cheated us for without experience he had gone forward by giving bribe of 20ths as he was asked for we have four children without their consent, n now cildren r of major age n have nothing n depressed. Is there any option pls advice..

Which act is it that you're referring to? And also isn't the disposal and non disposable quota 75% & 25% respectively?

Hi Farzan! Very nice question! The Act is Goa Succession, Special Notaries & Inventory Proceeding Act, 2012 (caption shown at 1:00 in the video). Children, Parents and Grand-parents are considered as forced heirs and have a mandatory share in the inheritance which is called as legitime. Legitime is what determines to what extent of the estate of a person is disposable. Disposable portion is defined in Section 83 of the Act. If a person has children, their legitime is half, so disposable portion is half. If he does not have children, but his parents are alive at the time of his death, their legitime is once again half, so his disposable portion is also half. If he is survived by neither children nor parents, but grandparents are alive, the legitime of the grandparents is one-third of his estate. If none of the above survivors exist at the time of his death, it means that his entire estate was disposable! :)

Hello Leena. Goan law applies to persons born in Goa prior to 19/12/1961 and their descendants. Also, Goan law would apply to a woman who marries a Goan man.

Things are getting bad in Goa, now we got people from Maharashtra and Delhi grabbing land illegally, there should be a law where only goans are allowed to own land in Goa, Kerala has something similar that protects Kerala environment and culture

Since 2023, the land price in Goa is rising very high. One square meter is minimum Rs. 25,000/- under panchayat registration. Under municipality registration it's minimum Rs. 75,000/- to buy one square meter. So Goa is really a hotcake and blessed and peaceful and loving place to stay.
