From 25 November 2023, ALL 482 visa holders (including short-term) will have access to Permanent Residency after 2 years
From 25 November 2023, Permanent Residency pathways will also be available to short-term 482 visa holders through the Temporary Residence Transition (TRT) stream of the Employer Nomination (subclass 186) visa.
The current eligibility criteria for the Subclass 186 visa in the TRT stream is that you must work for your sponsoring employer for a total of 3 years in the same occupation while holding a 482 visa. From 25 November 2023, this will be reduced from three years to two years.

IMPORTANT UPDATE: To prevent inefficiencies and additional costs, the department will consider 186 applications in the TRT stream where lodgement has occurred a few days prior to the applicant meeting the 'Work Experience Requirement'.

I'm currently in a 2 year 482 visa, set to complete two years in Feb 2025. Am I eligible to apply for a 186 visa? Can I submit my 186 application a few days before my current visa expires (my 2 yr mark), or must I renew my 482 for another year to have an exact 2 year requirement , before applying for the 186? Your response is appreciated.

Hi Tech Visa. As a family we have been on Australia for 18 months on a TSS 482 visa so we are obviously VERY excited to hear this!.. however we are both 50 and wondered if this would apply as it seems to have been 45 as the cut off age! Thank you, 😊

As labour agreement also included in the new changes, can on-hire companies also offer Nomination of 186 visa under TRT. I am on 482 for last 3 years under labour stream sponsorship by OHLA

Hey guys, that's awesome as my occupation is on the short-term for 482! How does this work entirely? For example, I do my 2 years then I can't legally work or live in Oz so would I need to return back to my home country then will I still be obligated to apply for PR?

Hey guys, I started working for my current employer 1 week after my 482 was granted. In theory I wouldn't be completing 2 years exactly. Do you think that we can still apply for the nomination or do we need to renew another 482, wait for 7 days and then apply for the 186? Thanks heaps! Love your channel.

And where is the help for the 408 Covid visa holders who stayed in AU in hard times during the Covid helped in critical sectors work for the same employer 2 or more years?They visa were ubruptly scrapped without previous announcement Gov.recommended them find “another “way to stay…but what way?482 sponsorship hardly to find and Student visa - possible refusal…is it fair???and grateful and polite?

Hi, these new changes only relate to the Temporary Resident Transition Stream not the Direct Entry where you will still require a skills assessment.

@@cgunarathna9157 Our absolute pleasure! The Transition Stream does not require a skills assessment - you need to meet the work experience requirement (among other eligibility requirements).

Hi Mikhail, thanks for getting in touch - a bit strange that your comment is no longer there but its come through now so lets go from there... An employer just needs to be an approved standard business sponsor in order to sponsor you (it does not matter if they are accredited or not). The minimum income threshold is $70,000 excluding super. I’ll have 2 years with the same employer on February but only 8 months whilst on a 482 visa. Can I apply to PR in February or I have to wait 2 year with the 482 visa? (I was on the 485 before). In other words, do I need 2 years with the 482 visa or 2 years with the employee?

I've been with the same company for almost 1 and a half years (first Year and 4 months I was on a visa 500 as I was allowed to work full-time until July 1 this year even on 500 visas, since then I've been on 482 visa with the same company, do I consider time spend on visa 500 with them or only time on 482? @@techvisa_

If you work for 2 years on covid visa with a company then get sponsored short term 482 with the same company will you get the chance to apply for PR before the 482 2 years are up?

As per immigration policy, the department is allowing short-term 482 visa holders to lodge their application for PR (186 TRT) a few days prior to hitting the two year requirement. Please note, the time spent on the COVID visa does NOT count towards PR. Hi there! As this is an employer sponsored visa, there are essentially two seperate parts to the application. The Nomination and Visa application. The employee can only pay for the visa application, the company must pay for the nomination application

Yes, you can. 189 EOI does not need your employer to nominate you, it is an independent visa. Apply for 189 EOI, once it is approved, you apply for your visa immediately.

Hi Kishwar, you do not need a skills assessment if you apply for Permanent Residency through the 186 Temporary Resident Transition stream. You only need a skills assessment for the 185 Direct Entry pathway.

From the information we have right now, the department are allowing applications for the 186 TRT visa prior to reaching the two years BUT only 'a few days' prior i.e. 3-4 days short of the 2-year mark. Therefore, your company would need to sponsor you for an additional 1-year 482 visa to cross the 2-year mark and then you can apply for PR. Hello mate! Great content as always, 2 quick questions, 1- For 482 to 186 TRT Stream, you need 2 years of working experience under 482. However, 482 STSOL visa granted for 2 years already, Can you apply for 186 visa when 482 visa expires on the same day? 2- Let's say, you applied for 482 STSOL, and worked for 7 months (Briding A Visa) then 482 was granted. 17 months you worked under 482 visa under the same employee. In this situation, can you apply 186 TRT when you have 2 years of working experience? Thanks mate!

Hi Mert, thanks for the kind words and glad you found this information helpful! 1) As long as you have 23 months of sponsored employment in the 2 year period not including any periods of unpaid leave. 2) If you previously held a 482 and applied for a second, then time on the BVA would count. And then only if both 482s are sponsored by the same sponsoring employer.
