ဆရာမခင်ဗျား ကျွန်တော့်ညီ အသက်၄၀ အခု visit visa နဲ့ US ကိုရောက်နေပါတယ်။ ကျွန်တော်က naturalized citizen တစ်ယောက်ပါ။ ရှေ့နေကိုမေးကြည့်တော့ I-130 နဲ့ I-485 တင်လို့ရတယ် ဒါပေမယ့် ကျွန်တော့ညီ က မြန်မာပြည်ပြန်ရမယ်လို့ပြောပါတယ်။ ဟုပ်ပါသလားခင်ဗျာ?

အသက် ၂၁ နှစ်ထက် ကြီးသားသမီး တွေ US ကို Visit visa နဲ့ ရောက်လာရင် ကော? I 485 တင် ရင် အစဥ်ပြေပါ့မလား?

I-485 တင်လို့မရပါ. I-130 နဲ့စရပါမည်. ဒီ USCIS link မှာ ရှင်းပြထားပါတယ်. အသက် 21နှစ် အထက်ဆို F1, F2, F3 မှာဝင်ပါတယ်. I-485 instruction page က principal applicant section မှာ ပြောထားတာက I-130 approve ဖြစ်ပြီး visa available ဖြစ်မှ I-485 ကိုလျောက်လို့ရပါမယ်. Even the person is in US. အသက် 21နှစ်အောက်တွေကတော့ immediate visa available ဖြစ်တဲ့အတွက် I-130 နဲ့ I-485 တွဲတင်လို့ရပါတယ်

Can you file I-130 and i485 together online? You can file Form I-130 online even if your relative is in the United States and will file their Form I-485 by mail. Once you submit your Form I-130 online, we will send a receipt notice to your USCIS online account. Provide a copy of the receipt notice to your relative to include in their Form I-485 packet. www.uscis.gov/i-130-addresses

@@MoefromAmerica what I am trying to say is if the relative is an immediate family member, you can file both I-130 and I-485 at the same time when you are in US because the visa is immediately available. If the relative is an immediate family member but over 21 and married daughter and son, they have to wait I-130 approval first and visa availability before filing I-485. You can’t file I-485 right away even they are already in US.
