Have anybody in here seen the last The Big Mountain Show , they had a lawyer from NC on there and they tried to paint us in a negative light but he had some things in there that we might want to look at

As I understand and given that if a team (Florida State) leaves the ACC before July 1st the Grant Of Rights no longer is enforceable. If that is the case what if 6+/- schools get together and pay a portion (100k +/-) of the current exist fee. Would it then be broken and the rest of the teams be able to just leave. If possible this seems like and exit strategy if it could be done before July.

How can the ACC demand media rights payments beyond 2025 since technically the contract ends with ESPN unless they agree to extend to 2036. If there is no Guarantee ESPN will extend the contract, how can you inforce a wish and a prayer. In fact a Journalist from Tampa Bay Times and Yahoo sports claim that an insider at ESPN has told the ACC they are not going to extend the contract.

Not sure you understand the option. To make it easier to understand use common sense seeing as no one gets a copy of the ESPN agreement unless Clemson just received it. Not hard to understand. If the contract end date was 2036 with an option to terminate early in 2027 but had to be exercised by Feb 2021 which ESPN did not do then WHY would Phillips extend that option for ESPN to get out of the contract fours later in February 2025. That makes no sense. In 2021 had ESPN wanted out they would have said so. The ACC hired Phillips to get MORE Revenue not less revenue. If the media deal was bad for ESPN (i.e. paying too much money) they would have exercised the option. If is a bad deal for the ACC then ESPN would keep it, but didn't opt out. It would have been stupid to allow ESPN an;other shot at bailing on a bad dealing for them. On the other side, which we now know from ACC's responses in Leon County the ESPN contract terminates June 30, 2027. The 2016 agreement include an option for ESPN to exercise extended the agreement to June 30, 2036 but that option expired Feb 1, 2021 (Phillips first day at the ACC office). ESPN did not exercise that option. Later in August 2021 Phillips took it upon himself without membership approval to give ESPN a modified (new) option to extend the contract to 2036 if done before Feb 1, 2025. Again this make perfect since for the ACC to try and keep the current contract in place to try and keep the ACC members from leaving. However, ESPN knows without FSU and Clemson the ESPN/ACC agreement is not worth the money ESPN would have to pay the ACC. ESPN fully understands their agreement that ACC teams' media rights are only valid to ESPN as long as those members are also members of the ACC. Thus ESPN will not extend the agreement in Feb 2025. Again, it is not an OPT OUT it is an Option to extend therefore ESPN can ignore everything and do nothing just like they did in 2021.

Almost along the lines of a non compete which is now invalid in most cases.
