We don't know where the boy was holding the gun when the cop fired. Did he have the gun in his hand? Was he raising it? It's hard to say. Certainly if the thought to be real (replica) gun was not in his hand or he wasn't trying to pick it up, the cop should not shoot. We just don't know at this point.

He literally pointed it at them during the chase and it looks identical to a real gun. He’s 13, and the cops were defending themselves. The police made an illegal stop and search in the first place. They had no lawful reason to detain and search those boys just for being on the sidewalk. They had observed no illegal acts, nor had they report of one. It was just a random stop and frisk, which is illegal. While I agree they have the right to shoot when confronted with what they perceived as a gun, the kid dropped the gun about ten feet away when he was tackled. They shot him in the back anyhow while pinning him down.
