Businesses and land owners can put road markings down and any other road furniture. They just don't have any legal force if they are ignored. Though it might be against company policy to ignore them. To really check if something is public, check that lamp posts (or other road furniture) have ID markings that match up in style and format to known public ones.

The crossings have yellow knobbled tactiles either side for blind people to detect through their feet. These are council property ergo a public road. I am a construction general foreman of 32 years experience and you can take it the bank I'm right about this.

After taking redundancy and retirement from a management position in the oil industry I ended up at 50 working as a prison officer in a G4S (cat A at the time) private prison on Merseyside. The pay was two thirds that of state prison officers and staffing levels were about a quarter, 2 officers to 95 prisoners. Don't make the mistake of thinking that because the bulk of G4S staff are low paid they are thick. I'm also a former police sergeant with a degree, however at 50 jobs are hard to come by on Merseyside you take what you can get. G4S treat their staff as mushrooms, keep them in the dark and feed them loads of BS. Sadly those security guards appear to genuinely believe the tosh G4S has fed them. I retired for good at 55 and live comfortably on my pensions and investments, happy days.

I worked at GSK in Ware Herts. I was surprised to learn that the road (Harris's Lane) to town before the turn off into the site access road is private. It belongs to GSK but has full unrestricted public access. You wouldn't know to look at it. It is probably because it cuts through and borders 2 sites on land owned by them.

A zebra crossing, keep left signs, double yellow road markings, street lights all look pretty public to me. Also, there were no no-entry signs, keep out signs, private property signs, fences or barriers blocking the way, so how can they tell you it is private property if there are no indications to confirm it?

It's perfectly legal for the public to go on that land under Section 3 of the Ken Dodd - Diddy Men - Jam Butty Mines Act of 1972. That's in the G4S training manual.

All you need to say to any security guard is, you are out of your jurisdiction, you are paid to watch and observe. If you do see anything or anybody acting suspicious off the property, your duty as security is to stay on the property and ring the police. While waiting for them to arrive, you haven't any authority to go on public land to question a member of the public or threaten, approach aggressively, or demand identification. And your sia badge must be visible at all times. Well done Matt, next time tell them to kick rocks, you're dismissed and do the walk of shame.

Somebody's going to tell you that you need to report the security guard to the agency that issues security licensing and also sue the company. He has no authority to even approach you or give you directives of any kind unless it pertains to the area in which he is paid and insured to work in. In other words he should not go freelance as Johnny on the spot.

Even on private road you can film. Only if the private road owner set out the conditions of entry so that you know before entry what you can and can not do can you be trespassed for not following the rules. Ignorance of the law is used by police to catch people, but it's a valid defence in civil cases.

A security guard has no more powers than a member of the public they can’t forcefully remove you due to filming if there is a public right of way They can call the the police who won’t do anything as it’s a civil matter so if the company want to stop you filming the will have to take you to court

@@macsmith6216 The most the police can do in such situations is a breach of the peace which means they can arrest you, move you and then release you once off the site. No details need be given. But to do that they've got to have evidence that you are committing a breach of the peace whilst they are there. An angry security guard upset at being ignored is not causing alarm or distress, it's the guard doing it to themselves.

@@TheSadButMadLad They cannot arrest anyone, no security personnel have the power of arrest They can only perform a citizen’s arrest, the same as any member of the public Certainly not for this, they have absolutely no power over members of the public on public accessible land If someone had climbed over a fence into site then that’s a different story but it’s still a citizen’s arrest

It's the police that can perform the arrest, but a breach of the peace is not a criminal offence and they have to release you as soon as the peace has been restored, ie. you are off the site.
