Anything else requires probable cause. They can't just check your boat, vehicle, bags for drugs or anything else, it's only line of sight for that stuff unless they had probable cause. So. if he decided to grab some smaller bag inside the other bag and open it, now he's overstepping. He can reasonably see there were no fish in the bigger bag and no chance of hiding a large fish in the smaller bag so there was no need to be searching anything else.

@T C If he didn't catch you with a pole in your hand or gun in your hand (hunting), he can't search your stuff. Now, if you're with other people, he can probably articulate reasonable suspicion that you would say "not fishing or hunting" and try to claim ownership of the coolers and bags in an attempt to hide evidence and search your stuff anyway. Their authority without a warrant only extends to conservation duties, which means looking for illegal fish or other illegal animals, illegal equipment if caught using it, etc.. They can only glance in the bag, not rummage through it. Any judge would see rummaging around in your bag as unnecessary for trying to locate a fish or other killed animals. In fact, even opening to glance in to it can be considered extreme if they pick the bag up and it's clearly not heavy enough to contain any animals. But as we all know, these arrogant d-bag ego driven power hungry thugs will ultimately do as they please figuring you won't do squat about it if nothing was found anyway and if something is found, they'll find some reason to justify it all. You can't stop thugs who are willing to violate your rights, you can only go after them later in court.

At one time you didn't need a license to fish on your own property. Not sure nowadays. But a game warden in Texas has more power than a cop. They can come into your house without a warrant and search your refrigerator or freezer. The only person I saw get away with anything was a post man on a rural mail route. He put his doves in a box and put stamps on it and the game warden couldn't do anything. The only person who could check would be a postal inspector. aka Post office police.

Coolers that are being used to hold fish. A cooler on a beach with a family enjoying the sun is not being used for fishing. They would have no reason to search that. Also the backpacks he is searching are not being used to store fish, unless he saw someone or somehow suspected someone of stuffing fish into their backpack then he has no reason to search those.

In California, when you have a fish and hunting license, it clearly states that game wardens are allowed, by law, to search your coolers, hunting gear, hunting tags, so on. This is done to help with wildlife conservation and also to make sure you are not outside if hunting and fishing regulations. Seems like you lost your cool on this one. Fail! 💀

This is one of the many reasons I love living in Thailand; I can go fishing and nobody bothers me. I can park my car at the beach and nobody is tries to collect a parking fee. I can go to a pharmacy and buy my medications without a prescription. I can drive my electric cart along the roads where I live (Not Freeways) and the police don't bother me.

It depends on your state, but the federal law says that any privately owned land that shares a border with public hunting or private hunting land is inclined to searches by the federal or state game wardens. They aren’t allowed to go into your house, but they can search the surrounding property.

The game wardens and park police do have some extra powers in parks and maybe on the piers. How they choose to use those powers reflects on the type ot person they are.

that may be true but I am sure if that was challenged in the court a lot of those powers would disappear ,no law can do an end run around the constitution ,accept when allowed by corrupt supreme court judges e.g. qualified immunity

Yeah, the warden was extremely professional and kept his cool even with all that trash talking. If that warden talked to that guy the same way it would be a different story.

The catch 22 is that to hunt or fish legally, you need a licence, and that opens you up to 4th Amendment violations by the fish cops. They also assume the authority to trespass on private property if they have any suspicion that hunting or fishing activity is going on there. The Game Wardens are seldom challenged and I'm happy to see you doing so. I had one of those SOB's open up my tent and look through it while I was away from camp hiking in the National Forest.

Their ‘right’ to go through your stuff and check everything for no reason or come on your property for no reason might be given to them by the state game codes. However, state game codes do not supersede the constitution of the United States. It needs fought in court though

@@bradpotter6401 I agree brad i was saying in that video he was touching the guys lines and going through his stuff without a reasonable articulable suspicion that he was committing a crime. I had a game warden come on my property once and ask to see my license when i was hunting and i told him to pound sand unless he suspected me of committing a crime. I don't know why people have become okay with just handing over ID to these guys everytime they ask for it

Witnessed wardens black both a man's eyes, confiscated his gear and chased him so he swam across a dangerous river to escape. Ended up two months later, I was jailed for driving on two unpaid traffic tickets, the man was there and had 4 more months to serve for fishing without a license and evading arrest.

When a person is fishing, there is probable cause to believe that you are on possession of fish that are subject to additional regulations.
