1. Conduct due diligence
a. Verify the identity of the grantor
b. Ascertain the capacity of the grantor to deal with said land
2. Obtain the site plan from the vendor/copy of land certificate
a. Don’t trust anyone at this point
b. Don’t trust any document at this point
3. Search process
a. Conduct search with the Lands Commission to ascertain whether there is no encumbrance on said land
b. Conduct search with Land Use and Spatial Planning Authority (LUSPA)
REQUIREMENTS FOR OFFICIAL SEARCH WITH LANDS COMMISSION
• Summit a formal application letter addressed to the Regional Lands Officer or the Directors of the Division
• Site plan with clear grid values
• Preferred scale of the site plan should be 1:2500
4. Site inspection and due diligence
• Ascertain the neighborhood characteristics
• Ascertain hidden facts-litigations, liabilities, unplotted court judgements
• Disclose your intensions to buy the land to the neighbors
5. Draft and sign sale purchase agreement
a. Don’t pay any money unless you are done with the above processes
b. It is a legal contract that obliges the seller to sell his/her property and a buyer to buy
c. Endorse by both parties
6. Negotiation and the acceptance of an offer
7. Preparation and execution of the transfer deed
8. Conduct oath of proof
9. Conduct stamp duty
10. Register with lands commission
