I dont know about USA laws, but the 75cm pak 40 have a maximum range of 8km, while the pak 43, aka "the 88" Maximum firing range 15,150 m (49,705 ft) which mean it could take out planes who fly at 10k meters, ofc I dont know USA laws. Also they always seem to fire solid core projectiles from tanks or anti tank weapons, maybe the explosive is too dangerous to handle?
