How about kramer. The original mass produced super "strat". If dean is beating gibson it's because they're making better guitars at a better price. Nobody is going to the store looking for an sg and leaving with Dean's ugly ass version and the v and z are Dean's take on those guitars and are vastly better for Dean's mostly metalhead demographic than a stock gibson. I don't believe they even compete for the same market. Gibson is the old novelty brand. Mostly middle aged rich men in suits and ties. I've said this in other threads for other vids. They are the Harley Davidson of guitars. I also happen to own a nylon stringed "hummingbird" guitar that my ex girlfriend's grandfather bought in Tokyo while serving in the Korean war. It looks just like a gibson hummingbird. Anybody wanna remind me what year that war ended? And what year did gibson's hummingbird come out? I thnik you'll find it pretty funny when you look it up.

Jackson has been around since the 80's. Gibson has had the flying V design since 1957. "This isn't about being bullies" Yes it is. Unless Gibson recognises that many brands have made similar shaped instruments for decades with vastly more consistency in quality, and higher quality at that, at better prices - prices that actually reflect the value rather than just a brand name... Gibson has had a period where they produced magnificent instruments. But not all were thát great - and I have played some, including 70s LP Customs and 80s V's. Nothing older as you simply won't be able to afford them in Europe anyway. But that's besides the point. That great period is LONG gone. Point is: simply compare current or recent instruments to similar from peers, regardless of shape. But similar in style, target audience, construction, woods used. You'll find time and time again that Gibson has (or rather had) a great name, but have for ages now failed to deliver - and don't get me started on broken headstocks. The cheapest Chinese brand has that problem long sorted out. Gibson won't, because.... Well, I don't know actually. Can't think of any reason why in the world they wouldn't fix that problem with those amazingly expensive guitars, which, after the inevitable glue-job, loses at least half it's resale value. I have still one Gibson V left, an '85 XPL-V to be precise, and it is frankly meh in every way when compared to my Korean Epiphone V, my Japanese Aria Pro-II, and even my Chinese Aiersi V which I recently acquired. It's been for sale for a while now, and I haven't had an offer over €400, as for that money you can definitely buy something better. Without a has-been brand name. I don't wish anyone to see their company go belly up, but if you value your customers, then start producing instruments that DO deliver on that good name & massive price tag - or adjust the prices to reflect the quality, therefor value, of those instruments. An Epiphone LP is at least as good, so a Gibson should have the same price. Easy.

400% markup emplys that a Les Paul classic that costs $2000 costs only $400 to make. Which is a laugh in itself, welcome to manufacturing. It's not like they took a $1600 profit. That's the final price we pay. Theirs still middles men like Autorized retailers, distributors, holders and other expenses that all take a slice of the pie. And really, 400% markup is reasonable when you consider company's like Harley Benton make half decent guitars for $150 (which probably costs them less that $50 to make) then big name rival brands sell China made instruments for $400, $600... or more.

If I buy an instrument, it is my instrument, the company no longer owns it. If I tape over the brand logo (which I frequently do), it is because I am not being paid to advertise the company, I am being paid to perform. If the company wants to pay me to advertise their logo, I will be happy to display their logo. After the blood and sweat it took for me to be able do TV and live performances in countries around the world, why should the non-paying company benefit from my work? I paid their full price buying their instrument, so I expect them to pay my full price for me to advertise their logos.

@@brianbatie6650 Thought the same until i noticed that there was another way to interpret their message - you need to consider that Gibson is completely delusional at this point, and still thinks that people generally hold their guitars in high regard - up to the point where those unwilling to pay the price for an "authentic" instrument would buy cheaper "counterfeit" guitars just to make others think that they own a Gibson (of course we know that's not true, but Gibson being Gibson will view it that way). So what they probably meant to say here is that media people buy "evil counterfeit guitars" and tape the logo off so that nobody will notice that it's "not an authentic Gibson" - the second statement could then be seen as an offer to replace those "counterfeits" with "authentic Gibsons". This interpretation fits the narrative, too, seeing how Gibson is frantically trying to declare all copies to not only be copies, but counterfeits instead. Yes, Gibson is essentially telling us that other manufacturers are trying to deceive us into thinking their instruments are real Gibsons. Nevermind the "Dean Guitars" Logo on the top, for Gibson you are either too dumb to tell the difference, or a very evil person for supporting counterfeits. That's how far the company got it's head stuck in it's own ass...
@brianbatie6650
@brianbatie6650 5 жыл бұрын
@@phirefox93 Doubtful, as they will never replace, say, a "counterfeit" $500 L5 copy with a $7,000+ real one, the price difference is far too great. Also, the delusion interpretation fails, as the general public neither notices, knows or cares what brand guitar is being played, they simply see a guitar being played. Hendrix was not called a "Fender-ist", B.B. and Zappa weren't "Gibson-ists", Vai isn't an "Ibanez-ist", they are guitarists. Yet again, "media people" (who are these people anyway?) don't buy instruments, musicians do. At best, "media people" rent, or buy a cheap generic instrument if it is to be intentionally damaged or destroyed as part of a story, those numbers are minuscule. I've appeared in films, TV, and in concert, either as a member of a band, or a solo performer. I explain to directors and any other musicians why I tape my instruments, IF the subject ever comes up. No one has ever disagreed. 6-string guitars are a standard set way before Gibson, so they are also copying prior design. I play a 7-string bass, proving the number of strings is irrelevant to being a guitar. What Gibby is doing is essentially demanding free product placement, taking a page from trump's "they are all bad hombres, so we can ignore the law" propaganda tactic to do so, even filing the case in a trump-supporting East Texas court district, where neither Dean, or Gibson locate their businesses.

@@lukasstrait9307 Fender made an Esquire, same shape as Telecaster, but one pickup. Then, after a year or so, in 1950, they added a second pickup and the controls and released the Broadcaster. Gretsch pointed out that they already had a trademark on that name, so Fender stopped putting the 'Broadcaster' label on it while they decided on a new name, Telecaster. The Stratocaster wasn't released until 1954. Dave GIlmour's White Strat that sold is rumored to have had serial number 001 before it was refinished, indicating it was a prototype (early 1954). Blackie was Clapton's guitar which he auctioned off years ago. Gilmour's "Black Strat" was his touring guitar and was used in recording. Spanish guitars are called spanish due to them being played stand-up or hung around neck, that name started in the US to differentiate from Hawaiian style of playing. Spanish as the Spanish speaking guitar groups from south America played that way (the way we all play now). The acoustic guitar as we know it is from central Europe, not Spain (Martin learned the trade there ffs). The name guitar for what we call guitar was coined in Italy. I've personally witnessed SG's and Les Paul's which had their headstock break while hanging on display. I Once had an SG in the factory approved HSC. Case handle broke while carrying it and guitar fell roughly 2 feet to the ground while in the case landing on the lower bout area. Opened the case and the headstock was broken. When a guitar breaks while inside of the factory HSC from what could be considered a fairly normal use drop and breaks, that's a weakness in it's design. It's common knowledge that the Gibson headstock Truss Rod cutout weakens the neck and makes it prone to breaking.

Carl Montney How many percent are we talking? Just currious cause a lot of people make it seem like the headstock design is an issue when it comes to headstock breakage for every single Gibson Les Paul. Which it clearly is not, I can to some degree agree with lack of or bad quality control. Besides, a lot of other brands use the same design, where are the issues on those? I only came across one Gibson Les Paul and one Firebird that have been broken in my lifetime, which ranges from late 50’s to new models. I worked in a music store too, but quality control might differ on models being sold overseas? On a site note, I also think that Gibson tries to shutdown everyone who makes something that could look like isn’t the way they are going to sell more, quality and new inovation that benefits the player while offering the old stuff to the purists is the way to go, besides working on their prices. It seems more to me like Gibson and their siblings want market monopoly rather than being competitiv.

But when Les Paul's came out in '52, I think they really came into their own, commercially and artistically. The whole Guitar has a clear, crisp sound, and a new sheen of consummate professionalism that really gives the songs a big boost. Gibson's been compared to Fender, but I think Gibson has a far more bitter, cynical sense of humor. Potential customer: Hey, Agnesi? Mark Agnesi: Yes, Potential customer? Potential customer: Why are there copies of the Style section all over the place? Do you... Do you have a dog? A little chow or something? Mark Agnesi: No, potential customer. I just took the time to read through the appellate decision from 2005 that reversed the original injunction that Gibson was granted against PRS regarding their singlecut guitars. One interesting fact, Gibson did not even apply for a trademark on the LP until 1987. But the basis of the lawsuit was that the similarity of the shape could cause confusion in the buyer as to who actually made the guitar. If the guitar in question was labelled as a Gibson, so that the consumer thought they were actually purchasing a real Gibson, that would be an issue. But it would be unlikely that the person buying a PRS, or in the current case, a Dean, would continue to be confused at the point of sale that they were actually buying a GIbson. There was also a question in the case as to whether the trademark actually applied to the whole three dimensional object, or the two dimensional outline they actually included in their trademark application. The other part of GIbson's argument was that if someone was playing a PRS guitar on stage on the far side of a smokey bar, a patron might think that the person was playing a Gibson, and this would somehow diminish the Gibson brand. From the decision: "As Gibson concedes that PRS produces high-quality guitars, we do not believe such an occurrence could result in confusion harmful to Gibson. If a budding musician sees an individual he or she admires playing a PRS guitar, but believes it to be a Gibson guitar, the logical result would be that the budding musician would go out and purchase a Gibson guitar. Gibson is helped, rather than harmed, by any such confusion." The Gibson vs PRS case sets a precedent, so I do not know how Gibson maneuvers around that. Personally, I saw a guitarist playing a Dean LP style guitar in a bar last year. The headstock shape did not make me think for a second that it was a an actual Les Paul. In fact, I moved closer to the stage to see what it was, and was actually surprised it was a Dean.

Brad... this is likely why Gibson's claims against body shape similarities doesn't seem to hold up in court. This excerpt is from a google search that I did, and it totally makes sense. To your point... if the shape of the guitar requires a certain feature (like the waist of the body between bouts) to function properly... you can't trademark it. "If the shape is part of the function of the goods, then it’s not registrable as a trademark. LEGO bricks, for example, are not registrable as a trademark (even though everyone, when presented with the shape, would say, “That looks like a LEGO…”) because the shape of the brick is inherent to the function of the brick itself. If it’s to interlock with other bricks, then it needs to be that shape."

Gibson has to only prove three unmistakable similarities to the neck, like pi ratio for arcs in several places and they win their suit. The design is more than "the look" it has to do with very precise tapered measurements. If the designers at Dean used a Gibson template for their necks it will be clearly evident. Thickness of the neck at the base versus at the top, width, depth, height. I doubt that Gibson's lawyers would draw up a lawsuit without clear grounds for it. If Dean used Gibson guitars as a template they will get caught. Dean would have to show that these precise measurements were used by them or someone else before Gibson used them. When it comes to "exact measurements" that may be impossible for Dean... Guitars today are measured by computers so the necks don't even require glue they fit so perfectly to the body. That fit alone could be a deal breaker for Dean.

It is actually a trademark violation to show a trademark in a movie or photograph unless it's considered news. I have no idea if that would apply to the guitar itself though. In stock photography you have to blur every sign or logo unless you have a signed contract from the owner of the copyright. They are kind of shooting themselves in the foot though. It's basically free promotion for them.
