My understanding is that nobody can be 'prosecuted' under the Equality Act, as it is Civil rather than Criminal law. So, people are wrong to talk about 'hate crime' then use the Equality Act to back it up. For a 'hate crime' to be worthy of investigation by the Police, it must be based on a crime, that is to say, criminal law. Police do get involved in the misuse of electronic communications (Communications Act / Malicious Communications Act), which is why these type of cases are often based on what somebody wrote on Twitter. My religious beliefs tell me to address people by their birth gender. Religion is a protected class, can’t prosecute me for acting on my religious beliefs.

Even trans individuals slip up with each other every once in a while. I watched a trans gaming marathon on Twitch, and while introducing themselves, one of the participants referred to another as "he" because she had a deep voice. Misgendering someone is not on the same level as leaving a banana at someone's doorstep. The banana would've taken a conscious effort to be racist just as calling someone a derogatory name would. Messing up a pronoun mid-sentence is nothing like that. I call people by the wrong pronouns sometimes who aren't even trans if I talk fast enough.
