It's crazy that no one other than the defense lawyer questioned why he had so much GSR residue on him - an excessive amount, far more than you would expect for the crime in question.

@@Azaqa I did watch the show- the lawyer called in the expert witnesses boss and got her to confirm that it was an excessive amount of GSR and that it was due to his client being put into police vehicle that had previously been used to transport a guy who had shot over 90 rounds with different guns. So the back of the police vehicle was coated in GSR from the first guy, and it transferred to the second guy (his client) when he was put in the police vehicle.

I’m thinking if someone was planning to commit a crime or needed to camouflage what had been done, they would do this. Go to gun range and shoot. Reload some bullets at home.

As a real lawyer.. You have 200% my backing on that little piece of evidence. Show writers are stupid. They think judges are handing out prison terms to people because they found some powder on their clothes under a microscope. That's not how the legalia works. Never how it works. The burden of proof lying on the suspect means as long as you can create reasonable doubt in the mind of the judge/jurors, you are good. You can't hang someone on circumstantial evidence. Can't even put them in jail for circumstantial evidence. If a judge does that.. they can kiss their chair and career goodbye that very moment.

I watch the series and I just thought about another argument that could’ve been used to support defenses later rebuttal… the fact that they tested his clothes he was wearing when he arrived for GSR. The same clothes that did NOT have any blood on them despite finding out one of the victims was shot point blank…. Also the amount of residue should have been a red flag for any forensics professional after seeing the crime scene and recognizing there were only TWO shots.

It depends on the time since the shooting. If the shooting was a few hours before testing then you can dismiss trace amounts but if it was a longer time ago where there’s only be trace amounts left then you’d get false positives

Just to let everyone know. The police put him in a police that had a suspect in it before that had a shootout with police. The whole police car had gunshot residue.

I just watched a trial where they called it GSR and even wrote down GSR on their documents. It was in Wisconsin though so I'm not sure they set the national standards.

And transference can happen from being in the back of a patrol car. Let’s say the person who was in there before you had their hands handcuffed behind them and was forced to sit there for a bit, then you’re put in the same spot in the same position. Unless the cleaned beforehand, what was on their hands could end up on yours

Thats not enough. He could have went to the shooting range himself then got arrested and had his clothes and hands tested. Not to mention GSR is detectable for a while after shooting a gun. And soap and water isn't enough to get rid of it at least all of it.

As an actual lawyer.... Gun shot residue is irrelevant to the outcome of the case .. I haven't seen this show, but I saw the original movie when it came out , and if it's anything as that. I would recommend NOT TAKING LEGAL ADVICE from the show.
