The Australian government banned their citizens from coming home during covid. People were stranded overseas in really difficult situations. One of the reasons I'm happy not to live there anymore, exactly what do my tax dollars get?

Currently, Australian wages: If you make 45K its 32% tax. If you make over $120K it's 37% tax. We also have a Goods & Services tax 10%. and the medium house price is $1 Million. Retirement age is 67. It's not worth it.💸.

I left Australia years ago because of the ridiculous tax system! As a non resident I am taxed ridiculously high on my assets in Victoria! I just hate it, to the point I can’t afford to pay them. For example land tax on a property was approx $600 this year it was approx $10,000, how that is justified is beyond me! I will sell and suffer the exorbitant capital gains tax and get out so they can’t continue to get me. The Australian tax system is designed for you not to get ahead!

@@Killajmj Yep its a disaster!! And just received a letter from the tax office regarding income tax, I need to pay quarterly instalments otherwise they will impose a 15% fine. I think its time to sell and have no assets in Australia I'm done.

@@geoffmerritt That doesn't make it right. I will never move back, because the tax system is designed for ordinary Australians not to get ahead. They think because you live overseas youré a multimillionaire. And its not just land tax, its income tax its takes a third of the rental income. They want you to be self sufficient but they hammer you. I'm done-I'll sell get hammered on capital gains tax and have not assets in my country, living there will not help!

@@fabulouslyK10 I'm not sure when the premium came in for living oversees, if its recent I would suggest that it would have been because of the houses being bought by foreign investors and you have been caught up in the State Govt's plans to slow it down. If the place was your principal place of residence, you're CGT will be less. If you sold your property, the returns will be a lot better getting bank interest that what you would be getting on your property with that 10k land tax bill. I used Vic's stamp duty calculator to workout the 10k, I know what I punched in to get it... based on that property, a multi millionaire you are not.

As the owner of a tax agent business, everything this guy says is correct. We can establish whether you are a tax resident or not, but what few of us (and that includes me) can do is give you the whole strategy of becoming a non-resident.

Are you an Aussie? Been thinking of buying a rental in Oz from nz but though taxation might be too complex for me. I heard kiwis in oz have to pay tax on nz rentals and worse, capital gain tax when they sell their nz property 😢

@@last_samurai6690 In short, Kiwis in Oz are Australian tax residents (taxed on worldwide income), you'll pay CGT on Australian real property regardless of residency. There's a lot more to it than that but if you're an NZ tax resident you'll only pay tax on the rental income and CGT for the Australian property.

@Les Edwards thanks. I will get serious when I get to that. Planning to buy a house and land package in Adelaide. They take close to two years to build. Will get an accountant to walk me through. In the end, if we get scared of taxation we might as well go on the dole. 😆 🤣 but we all know that's not the way to live. Despite taxation and all, I think there are still more opportunities in Australia than the majority of other countries. A sparky in Perth could make six figures and yet modest but decent houses are still under 500k. Not too bad in the current global environment.

Not true, not in the slightest. Yes, we've got a progressive income tax system, but for the bulk of Australians, it's pretty reasonable, considering our population. Yes, when you hit the $180 k mark, you're sticking your hand in your pockets. But at the same time, we've got a wealth of regressive taxes. GST, Stamp duty, excise, government service charges (rates etc.), land tax, fines etc. all favour high income earners. So do the concessions granted to high income earners that make voluntary contributions to superannuation, have private health insurance, investment property, financial advisors, etc. If you're getting "punished" for working 2 jobs in Australia, you need a new accountant and a new financial advisor. The Australian government is very kind to those that are on the "big bucks". Not so much so to those that are struggling.

rent a shed, work from that shed directly with customers as a wheeler and dealer. You work had like the last generation and you keep the fruits. You can no longer apply the 'you first principle' with employment anymore. Your boss, even if he wanted to pay you more drives you into a higher tax bracket with every hr more....The older you get the less time you have left to make working worth your time.

@PhillyWilly in the Philippines I don't have much knowledge of the prevailing circumstances in the USA. In Australia, you are considered unemployed if you have worked less than 1 hour in one fortnight and you are on unemployment benefits (Newstart). Yes, I know that sounds ridiculous, because it is, but that is how unemployment is measured in Australia. This methodology came to practice decades ago when unemployment was unacceptably high and a political hot potato. It softens the real numbers, to say the least. People actively looking for work are not included in Australia's unemployment figures. Nor are those that don't qualify for unemployment benefits due to their level of wealth or due to their spouse's income. Those on a disability pension or receiving benefits due to ill health are not included either. This is a point of contention for many as the remuneration is much higher for this category of welfare recipient and the onus placed on them to remain on benefits is much lower. In years gone by, this category was widely exploited, and, as a consequence, the government has restricted access to these benefits. That is both a good and bad thing. I have two close friends that genuinely should be on disability benefits but they don't "qualify". When I say "don't qualify", it means, they've just been told no and have no recourse. I've known others that have been on those benefits who have really had no right to be. I honestly don't think that we have too many "welfare kings and queens" in Australia. If we do, I certainly don't know them. And I don't know how anyone can live on the pitiful $560 Aud (or thereabouts) per fortnight that unemployment benefits "pay". Two thirds of that is gone just renting a room in a share house, in Australia. Almost exactly thirty years ago, I was on unemployment benefits for several months. It was miserable then, it's far worse now.

I was working a full time minimum wage job, earning about $50,000 per year. I wanted more money so I took a second job, earning about $41,000 per year on top of my day job. More than half of that extra $41,000 was taken away from me in tax.

@@ninjaskeleton6140the total tax on 91k is about 20k. You would have paid just under 7k if you didn’t work the other job. You might have more money withheld from the second job but should have been refunded at tax time.

What I don't understand is that I pay a high-level of income tax, I have to pay an extra $4000 a year for the public healthcare system, and then there are government fees for literally every single government service I use on TOP of the taxes I pay, and monthly bills for sewage, garbage collection, mail, water, etc etc. What do my taxes go to?

The laws concerning the taxing of Australian citizens living overseas having been extending to more situations over the years. Twenty years ago Australians who earned income overseas were not subject at all to tax on the overseas income if they were not present in Australia for more than six months of the tax year. In the last twenty years more criteria have been added to the 6 month criteria such as the ownership of property in Australia by somebody who has Australian citizenship now being subject to Australian tax, even if they did not visit Australia at all in the tax year. The rules in Australia are being added to over time such that it eventually will in effect be a taxation system based upon citizenship as is the case for US citizens.

I think Andrew did a poor job of clarifying in the first video who it was going to affect, and this is where all the previous comments about it's been going on for ages came from that he objected to. As you note there was many changes already for AU citizens over the last 20+ years. I think it's good he released this second video to clarify the new tax laws are targeting citizens who leave Australia but don't setup a new base in another country. So they'll still be considered AU residents for tax purposes.

If you live in Victoria, there are a multitude of new taxes coming your way starting with a land tax for investment properties and various levies and fees. Remember they are billions in debt with billions of daily interest.

As a dual Australia/NZ citizen living in New Zealand, guess which country I have to pay taxes in? That's right, I'm still considered an Australian tax resident, despite residing in NZ. As he said in the video, the international tax laws are convoluted & each person's situation is unique. It's not always as simple as where you happen to live.

Our tax system in Australia is terrible however none is talking about the tax haven of super. If you have $1.9m or less in super by age 60 and retire you'll be happy being an Australian tax resident and paying no tax on your retirement earnings and capital gains!

Living in Australia but making my international structure as we speak, the ATO are equivalent of the modern day Gestapo. Their rule is, your guilty until you prove yourself innocent, good luck fighting them in the courts. This country was once a place that celebrated hard work and risk taking, now the Labor governments federal and state buy votes with welfare and free money. Agree the Ato does operate like that your guilty first and then you have to prove your self second. Not because of saving money but the rules in which this country supports only the “battler”. Fair works commission, unfair dismissal, you need to give employees 3 warnings before firing them. And then being taxed so much to give these people jobs, I’m packing up and leaving this joint before the fire has started

I think its gone to shit because of our high income government workers who produce nothing except extra hardship and costs to aussie taxpayers. Its also gone to shit because of the waste of money on aboriginal projects that rarely produce higher living standards. Millions of dollars in grants for charities of which we have 54,000 most being top heavy in admin. Giving 290 million dollars of tax money to aid organisations overseas - can you just imagine the waste? I had the gross misfortune of experiencing a couple years of sheer hell when a State of Australia (Queensland) implemented an 'Absentee Surcharge' coupled with a corporate rate equivalent Land Tax on QLD property owners. The legislation was also made retrospective. It created hell for expats and long term travellers out of Australia for 6 months, or even less if the QLD revenue office merely deemed you were intending to be a resident overseas.The QLD State government had Federal government access to immigration records too. My investment property started to become a liability due to the very high tax + surcharge. People were forced to return to Australia and retirees cancel itineraries to get back home. Some owners were suicidal. Truly a horrific surreptitiously introduced Communist style law. The outrage caused the QLD Labor government to scrap the tax, but still retained it for foreign residents. They of course announced it was scrapped for another reason.

Australia has taxes that would make a Nordic nation blush, with few if any of the benefits the Nordic nations offer to their citizens. Nordic nations realise without business you don't have people to tax, Australia for some reason doesn't grasp that and feels it is their duty to destroy anyone who dares become wealthy and open a business. This is why the top 5 highest income brackets in Australia are related to medicine and not manufacturing or being an entrepreneur.

I'll be leaving Australia and investing in Asia where I'll be living. I'll run a business mostly for cash and there is no way i would report to the ATO. I'm under no obligation to payvtax as i never signed a contract. If they think i agreed to something by default then they are wrong. It's about informed consent. I'll still collect rent from investment properties and we'll have to pay tax, only because the government has a monopoly on violence against citizens.. ATO, Australian theft office. Tax we pay is not a fair share

So if you just floated around your still paying tax for the new 3 years. The only out I can see is moving to a country with a Double Tax Agreement. Getting rid of your permanent Australian Abode and establishing a permanent oseas abode. That way 3a DTA saves you

@lukelambert6657 - the 45 day tests (i.e. the proposed new residency rules) do not exist. They were proposed in 2019 by the then Liberal government but those proposed new rules lapsed when they called the Federal election at the time. The government have not brought these new rules in and they do not appear to be on the Labor government's radar as there has been no mention of those proposed rules since.

Unless you mean a marginal 49% rate, you would have to be earning much more then double the average wage. Tax doesn’t reach marginal 45 until $180k, everything under 180k is taxed at a much lower rate.

The average married man in Australia does 16 hours overtime a week & the average married woman does 6 hours overtime. This group on average earns well over $90,000 a year. As the ATO is a Crown agency, and, they are enforcing a law of the Parliament of the Commonwealth of Australia; and, they are calculating the amount payable as a tax... The ATO are now breaking the law. This also applies to State Taxation Offices, Centrelink, and all Shires / Councils and any agency that uses Valuer General valuations.

Bali is. Thailand and Bali are both sick of Russians, Chinese and Ukrainians, not so much Aussies per se (except in Bali as mentioned). I wouldn't want to be in SE Asia during the next lockdowns...those who refuse to wear masks will be dealt with harshly...SE Asia had some of the harshest restrictions anywhere especially Singapore. Expats who calmly refused to wear masks were marched off to court and deported! Foreigners present in Bali who refused to wear masks were in some cases deported too. In Thailand, they were simply fined 1000 or 2000 Baht, forced to put on a mask and allowed to go on their way but still - we're talking medical tyranny here.

Same goes for New Zealand. Never used to be an issue until Taxcinda got in. Good old grubby Labour. Always remember to renounce your tax residency if you move overseas if you're from Australia or NZ. You are able to after one year after you sell or close all your financial interests , close accounts etc, or you will be liable to declare and pay excess tax to those countries.

As an Australian who left...ATO has always considered Australians remain tax resident unless they clearly establish residency in another country. Rulings clarify previous rulings and court decisions. It used to be WORSE, more ambiguous. If you want to leave Australia you have to make a clean break.

The problem is, you can't live a trifecta lifestyle abroad anymore, even if you're tax resident in another country as all Australia has to do is say you didn't stay in that one country long enough - your centre of life means nothing when they say you didn't stay there long enough. At least prior to this as long as you genuinely lived abroad and your centre of life was there, you could have one or two 2 month holidays somewhere else or travel a lot for business. That's now all risking you being declared tax resident in Australia. This is the opposite of the ability to have a clean break - this muddies the waters.

@@person.X. Five Eyes Alliance, CRS, global passport database, other data sharing between allied govts. Its very easy for governments to track you everywhere you go. The ATO can check any passport issued to you by any country as if you've paid taxes in Australia or moved money out of Australia you've had to legally give the details of every passport you have - all they need is your name, passport number and its expiry. Plus the ATO have literal datacentres performing transforms of link analysis where every bit of data in the world that they can access about you is linked to you - this includes data shared between governments.

Im a USA permanent resident now! After being an Aussie out of there nomad 15yrs! Wife got a Greencard applying to me getting one as well so yeah no idea. We got up to 7 years to duck that permanent worldwide USA tax system but its cheaper than Aus anyway and we will make bank. Covid thing and the exit ban finished my birth country for me for a while at least but it seems that AU is going to go more and more of the way of my convict ancestors rules.. EDIT: I did spend only around 60 days in AU last 10yrs

You must seriously ask yourself, once you become financially independent (or at any time), is it worth being a citizen anywhere. Would it not be better being a national/sovereign ? No, not a 'sovereign citizen". Simply a sovereign, not a member of a legal entity, which countries are. The Australian Citizenship Act says the benefits of being a citizen are: a) you can vote (I don't want to vote for criminals), b) You can serve in Australia's armed forces (No, I don't want to get myself killed protecting the profits of a corporation), c) You get Australian government to represent you if you have problems overseas (I have bigger problems caused by the Australian government than overseas governments). Not to mention that to be an Australian citizen, you have to have an oath of allegiance to the Australian government. There is no oath of allegiance for the Australian government to us, interestingly.

You are very correct about Australian's reaction to when you explain the tax laws. They always say "Aww they've been doing this for years, nothing has changed".... Well, Aussies who care more about football & going to the pub will think this way. Canberra is ALWAYS changing tax laws. The annual tax return used to be easy to do, was able to be done by a person by themselves. NOW you need an accountant who specializes in tax returns because the tax laws are always changing & not for the better. Many Aussies who don't own a home & earn money over AU$120,000 a year are moving to Malaysia, as what you spend on a week's rent for a Sydney studio apartment, you pay for 1 month in Kuala Lumpur & get a 3 bedroom apartment with a pool & garden plus still have spare change to send the kids to private international school where the English teachers are Aussie, Kiwi or English & teach your children how to speak WINDSOR CASTLE ENGLISH... Oh & have enough to fly back to Sydney & visit the grandparents for school holiday 2-4 times a year. If I wasn't so established in Australia today, I'd think about Malaysia or Brunei too, lots of oil jobs in Brunei. But, I'm an 80s Baby & many of us used our British ancestry to live & work in the UK, that was my generation's way of MAKING BANK was to work in the UK to help their tradesman-starved & nursing-starved economy. Germany was another country those of us born in the 80s & even 70s hoped to live & work in if you were qualified in an engineering or robotics or mechanical field. But now, it's Malaysia. The only Aussies who get any benefit living in Singapore for tax purposes, are those who earn over AU$300k a year, while Singapore taxes are cheap, the real estate prices to live in Singapore are not. Australia's tax system is very complicated & is there to keep accountants in jobs & to provide loopholes for all the corporates who lobby Canberra & run MARTIN PLACE to maximize their super-profits while paying no tax. Meanwhile, the working-class in the MORTGAGE BELT believes they are "beating the tax system" by thinking they can reduce their tax by claiming that Ryobi cordless drill & Sidchrome socket set on their tax return if they go to Bunnings & buy it before closing at 20:59hrs 30 June to claim it tomorrow on tax. The way the ATO burns Aussie's hard work, no wonder Aussies are "slacking off", no point working when you are taxed half of what you earn (ATO tax rates '24-'25) $190,001 and over......$51,638 plus 45 cents for each $1 over $190,000.... And we are told we live in "The Lucky Country".

Great content btw. I can't believe I just discovered your channel. Great work. Few notes on this, 1. It is a tax ruling. IT Ruling is just an ATO interpretation of the act. It can be challenged and while do hold considerable weight, it is not final. High net worth individual can challenge this ruling and as you have quoted when reading the new ruling. several preceding tax rulings on this same matter that are overruled by the Australian High Court. 2. The core axiom, rule of thumb, and IT IS ALWAYS THERE EVEN EVEN BEFORE JUNE 2023, is that there must be direct connection [including intention] between the tax entity and Australia,. In this context, if a digital nomad has an intention to flee to Australia as a back up plan then that intention establishes a direct connection to Australia. This is because he/she is accessing Australia as a service be it tangible or intangible, in this case an Australian protection as a service, thus be subjected to Australia Tax Law because that very tax is paying for the infrastructure that establishes that protection. Though why would someone adopt this strategy especially in light of COVID Border closure is beyond me? This new "consolidated" ruling and all previous rulings merely reinforce that axiom. 3. The content does shows a rather "simplistic analysis" of the Australian tax law from a Digital Nomad point of view. It failed to cater for International Tax Agreements between Australia and other countries but again why take such a headache when other places are much simpler.

In Canada, there is claimed non resident and deemed non resident tax status. Having your tax status officially deemed non resident by the tax authorities entitles you to not be taxed at all in Canada on world income. It is not something you assert and then receive. You must convince the tax authorities that you have met the criteria for qualifying that status. A superficial glance at some of those qualifiers for being officially deemed are non-residence. No ownership of anything that might qualify as a residential benefit. This includes clsoing all bank accounts and related material, surrendering your driver's licence, club memberships that assume physical attendance such as yacht clubs, golf clubs etc. Naturally that includes many health plans such as those connected with retirement benefits as well as any goverhmnet plan, of course. I am under a claimed non resident staus because I have not been in Canada for years. So I claim on my tax forms that I am filing under the non resident status and am subject to the rules associatd with that status. Canada has a shared system of procedures with some countries on how to tax Canadian residents of a particular country but who want to stay under Canadian tax jurisdicition. It is a very complicated affair, highly dependent on the individual's unique sittuation. Unless your accontant is an international tax type of accoutant, he neither knows nor cares about all the myriad rules connected with international tax. The best way for you to judge if he is qualified on the issue is wheher you have been paying the extra fees assciated with employing accountants who speicalize in the field regarless of whether they bring those skills to bear. It is impossible to have an income at all and have it any simpler than my personal situation with a non-resident tax status. Yet I have to file multiple forms with hundreds of line items that must be responded to. Over the years, I have gotten pretty quick at completing it. But if your accountant hasn't done it before you will have to pay him to learn that. He will have to consider every line item on your unique form and look up many of them for an explanation of what they mean exactly. I have no doubt that the tax authorities are just as bureaucratic and complex in Australia as in Canada.

First thing we should ALL do is have a Trust set up , forget about the costs its for the advantages over the long term .Dont agree, Ask yourself Why well off families and individuals do it? Australia has become a tightarse of a country you can't even keep the aged pension if you choose to live overseas , there are plenty of country's that pay pensions even when the applicant doesnt live in the country of orgin Malta being one. Liked the video its important to know the tax implications if you choose to live elsewhere .

Issue with Australia is the mandatory superannuation system which makes you a tax resident regardless of citizenship. And the process to move that money out of Australia is hell...

Simply having super shouldn't make you tax resident, don't have it invested, let it stagnate and slowly drain away courtesy of fees. Also, don't pay into it if you're not living in Australia. Unless you qualify to access your super I don't think there's any way to move it out of Australia as even NZ won't let you withdraw it.

OK, ATO still regards super as a financial interest paying tax. ATO does have a super payout scheme (DASP) which requires you to denounce citizenship or PR and leave Australia permanently, it is meant for holiday workers but should apply to departing citizens , ATO will receive the funds and pay them to you after taking top tax rate first.
