The plaintiff says he bought a condo in the defendant’s building and put down a deposit to use the freight elevator. The defendant is accusing him of scratching the brass door frame and won’t return the deposit, so the plaintiff is suing. The defendant says the plaintiff renovated the condo and violated multiple rules and caused damages, so he’s not getting the deposit back. He’s countersuing for legal fees and damages.

Oh man, this defendant should never go to court on his own if he's ever summoned again😓. I really think this condo association is in the habit of lying to keep tenants' deposits. I've never seen a freight elevator without damage, even in a brand new constructed building, so I really believe they are taking people's deposits fraudulently.

I've seen a couple freight elevators, and they have "wall to wall" padding. It's not tricky to install.

John's joke about quarters in the gumball machine reminds me of a childhood memory. I bought some earrings in a gumball machine when I was 4 and I gave them to my mom for Christmas. They were her favorite possession. When I was about 7 I confessed what they cost and where I got them. Her answer was that she knew that because they were in the plastic bubble when I wrapped them. She said the price and where I got them wasn't important. What mattered was the fact that they came from my heart. She wore them frequently until they were destroyed in a house fire when I was 11. She loved those earrings like they were the Hope diamond

Ya, but now we know there’s a path from the plaintiffs apartment to the service elevator. Because if there wasn’t then it would have been impossible for him to have scratched it. If a tree falls in the woods but know one saw it fall and when you get to the woods and there’s no tree there did it actually even fall.

This is scamming. They tell most tenants there’s damage to keep their deposits. That’s the reason they don’t repair any scratches in the elevator. One foot in the grave and still robbing people. The condo board is splitting all money they steal. 😮

JM has been a judge & lived in FL too long to not know that when Caribbean people say “Miss” it’s a sign of respect. I’ve seen her get offended & even go off on people for it without acknowledging the cultural difference. It sounds condescending by American standards & they should adjust, I agree. But, come on…at least know the intent behind it. It’s similar to calling her “Senorita” instead of “Senora.” Just a respectful way of speaking to a young lady. In fact she might justified in being offended if they say “ma’am,” which for us, is reserved for older women. Lol.

I’m a leader & i have an employee from the Philippines who calls me “Ma’am Melissa” instead of my correct title. I’ve simply corrected her without acting like she called me a whore or something because she obviously is being respectful by the standards of the culture she comes from. No need to be an ass about it.

Appreciate this case and Judge Milan’s knowledge. I was able to digest a great deal of information. Sad to hear this is our last season with the Peoples Court. I grew up watching Judge Wapner. It’s the end of an Institution. 😔

​@@ingloriousbetch4302HOAs, um no. I can't speak to CA's but an HOA is your neighbors. And your neighbors are responsible for the money all of your neighbors put in. So, an HOA is passing your money to the landscapers or the painters or whomever. They don't keep a dime because they're your neighbors and just volunteering. Sure, some HOA members are terrible people. So are some of your neighbors. If you don't like them, volunteer to be on the board instead. This is where everyone goes silent.

Did not like this I feel like Milan spent too much trying to find the plaintiff wrong. Clearly the defendant had no proof and there was no damage, I feel like she was trying to be biased towards the plaintiff. In the early days she would have shit the defendant down or if the roles were reversed she would have went off

I love People's Court. I had an event at my clubhouse. When we got there, Sunday, I noticed some damage. I took pictures of everything, damaged and not. Monday I was called to the office for damage. I had pictures!!! One of the damage was from Sat and one was from us on Sunday. How great to have the pictures for me and the management!!!

Judge Milian is annoying in most cases, including this one! She wanted the plantif to stop talking when he had evidence but gave the defendant all the chances to say and show absolutely nothing. But oh well watching her helps time pass by. Too bad the show is ending

Which is true, and she could've corrected him nicely, like I've seen her do many times. For someone who likes to tout living in Miami, she shows she is clearly lives far from the areas that are heavily cultured with accents, and those may have just arrived to the U.S. and don't quite understand the lingo utilized in court. Not everyone has been in front of a judge or watch court shows.

You spoke my entire thoughts! She did everything within her POWER to help the Defendant and to destroy the Plaintiff's case, and this was one of those rare times when it was more than obvious that a litigant (the defendant) despised the other litigant for no good reason because he acted like it hurt him to even have to look at the man. I'll bet that's why the show is going off the air - because all the right people of power were complaining about her biased judgments. I'm glad she's going off the air because I'm sick of her, and she looks like Roseanne Barr now. lololol!

It's so obvious the defendant is scamming to keep not only the plaintiffs deposit but anyone else's deposit that used the freight elevator. He was without the "germane" proof that he was the one who scratched up the already scratched up freight elevator. The judge was on to him from the beginning.

I felt like JM gave the defendant a lot of leeway to prove a his point when he just didn't have the evidence. I was curious to hear the plaintiff when he said that management has been known for going after other tenants for the same thing. I am a bit surprised the judge didn't allow him to elaborate. Also, if this was a freight elevator and the only elevator that was accessible to residents for moving, it is totally understandable that there will be some damages

A freight elevator is made available for exactly that reason. Because materials need to be moved and it is liable to get scratched and dented vs the passenger elevator which you want to remain nice. This whole thing is ridiculous. They were just trying to steal this man’s money.

I remember when someone came in with something wrong with the engagement ring and JM was admiring it and saying her husband asked her if she wanted to "upgrade" but she said no, she loved the one she got when they were both struggling lawyers, trying to make it. But, looks like she has a big rock now.

I understand wanting to sue for a regular passenger elevator being damaged. However, this is a freight elevator, where not just people moving in use, but some deliveries and even maintenance staff utilize. It's built to handle bumps and "bruises."
