Ours does.. but the security guy puts a notice(sticker)on the vehicle if they are not parked in guest parking(we now have to pay extra for our own parking spots). So If they don't move within 24-48 hrs, they get towed

Doing that to a family, who’s child has cancer, that would make it so that if the jury didn’t find the HOA guilty, it would eat the jurors alive for the rest of their lives.

i was thinking the same thing, their lawyers representing and fighting to enforce the ada would have a field day with that management company. in the past i have been diagnosed with a learning disability every time throughout my schooling when i have needed help in regards to that every time you bring up ada or getting the people who represent people under those guidelines involved peoples attitudes change very quickly.

We arrived in Vegas in the late 90's from the East Coast. We had no idea what an HOA was. I left my garage door opened for more than 30 minutes, and I got a warning in the mail the next day that said, "If you leave your garage door open for more than 30 minutes again, you will receive a fine". We moved shortly after that.

Are you for real? You can’t be that paranoid. Think about it, they’re probably the only ones to get towed in a long, long time. Bad news travels fast. Won’t nobody park out front after watching this until a new homeowner, not believing that they will really do it, pushes their luck. Hardly worth it to the towing company to discount, or kick back, any part of a towing fee. I managed a HOA, and we had a problem with people parking in the yard. After we took the first one to court, and he spent a little under $5000, what with his lawyer, our court costs, etc... it never happened again, as long as I was manager. The towing company in this case is not breaking off a piece for one tow every couple of years. They probably charge the vehicle owner AND the HOA because they gotta drop everything and come right now or they’ll miss it.

@@mictza450 I believe the HOA is getting kickbacks from the towing fees. The language in their rules regarding towing is still illegal. It didn't say anything about putting stickers on vehicles 48hrs before towing a car. The Board should be brought to court in that issue.

My family was victimized by an HOA, who's president just happened to live next door, and was a lawyer with his wife as vice-president. He didn't like the fact that my family was taking care of some elderly people, and didn't want his kids to grow up next to them. He resorted to scare tactics like letting his huge viscious dog to roam out front, and when my sister would try to take the trash out, the dog would aggressively rush at her, growling with teeth bared. I had to drive across town just to take her trash to the curb! He and his wife sued my family and lost, the re-sued us and finally won, kicking us out of that neighborhood. The house was always neat and well-maintained, and we never had a problem with any of the other neighbors. It was a case of power given to a bully, who used his law firm to get what he wanted. Such people will never be happy, and spread misery wherever they go. Take away their power.

It's not unacceptable. The family should have contacted the HOA to request an exception based on their son's disability. The HOA would have the right to request proof, since there wasn't a disabled tag or hang tag on the car. In all likelihood, the HOA wouldn't have granted it anyway, but then the family should have sought legal advice.

@The Calming Kind It's predatory towing. They pay finder fees for spies to watch people getting out of their cars for even a minute, then they hook you. I saw this happen in Arlington, VA. A guy was parked at a McDonald's, came out of the store and threw a bag of food into his truck. Then walked thirty feet away to use an ATM and they had a hook on him within 20 seconds. They began shoving the guy away when he was trying to protect his property.

That happened to me in Utah when the new HOA manager hired his brother who owned a towing company. They had no reason to tow my second car. Stated my plates were expired which was not the case. I did catch that car was gone within 1 hr. No information who or where to call. A neighbor gave me info that was provided at recent condo association meeting. Towing company didn’t answer (I’m sure so they could try to add another day). Got cash and had friend drive me over still was attached to truck. Yelled and screamed until driver showed up. Had to argue to let me in to get my car. Back in 2003-2004 cost me $350 as a single parent that’s a lot. Asked why he towed it made him look at license and took I took a picture. Would not reduce price telling me I was lucky he let me in tonight to retrieve it. No money back from condo association. Tow truck was always around trying to catch someone even parked behind garage or carport with doors open getting groceries. Finally got rid of him and I believe the manager too. There like politicians given kick backs to friends and family

Yes and No, it was illegally towed because the HOA acted like a government and enforced laws of their own making when the city already had laws in place. In other words the HOA is not a government and cannot make enforceable laws. If the city sent in code enforcement for private property and deemed the car an eye sore, slapped a ticket of violation of the cities codes on it, then the HOA could have it towed. They were enforcing a city code. They just took it upon themselves to tow before any decisions was made, by someone with enforcement powers, if the car was an eye sore under the law. Yes, the car was on the HOA property but under their rules guest can park there. By law they can not say who cannot cannot be a guest. If they did, no one in their right mind would buy a home there. All an HOA can do is collect fees to help maintain the common areas. They have no other say. They cannot stop anyone from buying a home, they cannot create enforceable laws because they are not a government. They cannot foreclose on a resident because they have not paid their dues or paid their fines. They can place a lien on your property though to collect dues owed but not fines.

When they see a violation they are suppose to call the city/county code enforcement office to get an officer to come out and see if a code is being violated. They aren’t suppose to write the violation themselves or seize property. Yet, that’s what they have done here.

1982 NOT ONLY ARE HOA'S LEGAL, THEY ARE OFTEN REQUIRED BY LAW. Most cities have passed laws mandating that all new home communities with more than 10 homes have an HOA. THIS requirement is a condition of a builder being granted a building permit.

Since HOAs are legal entities and most being corporations, I have a difficult time believing this. By no means am I saying you're not being truthful but rather I'm interested in investigating it further. While I've yet to hear of government; state, federal or local creating a law that requires a community be governed by a corporation or legal entity, I have heard of them requiring established HOAs to maintain things that would otherwise be covered by taxes. For example snow removal from streets, replacement of worn sidewalks, street repairs, traffic sign maintenance, etc. So with that said I guess a further measure to require the creation of an HOA isn't a huge leap but I also can't understand how such a law could be passed. If you would post some further reference information, I'm sure there are others who would be as interested as I am in finding out more about this.

I lived in one that was able to secure a contract with the garbage collection in the area so we only had to pay about $24 a quarter for trash collection. Apart from that they were a terrible organization whose only redeeming quality was that if you recieved notice that they would fine you they also gave 30 days to correct the situation. I will never live in another HOA neighborhood again.

My HOA is pretty good, maybe even a little too lenient. They keep the common areas well-maintained, the fence around the subdivision is nice looking and also well-maintained. Street lights that go out are fixed quickly. When I bought my house it was in violation of some of the terms of the covenant. Things I couldn't fix, such as the construction materials used. I got it in writing from the HOA before I bought the house that I would not be held in violation of the covenant for those violations. However, I actually feel like they need to be a little bit stricter. We have parking restrictions, but they are rarely enforced. You are allowed to park on the street, but overnight parking on the street is not allowed except for guests. However, residents always park on the street to point where it's dangerous. We have quite a few very young children in the neighborhood, some of the streets have curves in them. People park in the street and make it like a slalom course to drive. If you meet an oncoming car, only one can go through, while the other waits. If one of these little 3 year olds was to run out between all the cars, you'd never see them coming.

I lived an HOA never again! They should be illegal. We paid for security and had a real security company. Then the board decided to fire them. The president and his son plus two random guys replaced 10. Break-ins etc. The roof that was part of our fees took two months to get fixed

@@Katarina23 you have no obligation to them. For the most part, it would be a new neighborhood that has HOA. It is supposed to be helpful to keep the streets clear of disabled vehicles, grass growing knee high and trash all over the place. The one I live in is ok, I never hear anything really. We just got letters about bushes and weeds, because the freeze a few months back took the bushes out, and many homes do not put anything down for the weeds. I don't care what others do, but at least cut your grass so the weeds aren't as visible!

@unityisthekeytostrength no, they tried that to, 220 homes in my subdivision, 75% of them don't pay any dues at all been here for 23 years, its still the same, they try really hard to cause trouble, just because they are on the HOA board, they can not enact a law they like, the only law enforceable is the one's that come from the city government, I do pay my dues, because they do keep the entrance looking good, in fact one of them ask me, he said who would pay to keep the entrance's looking good, I told him, the same ones that keep the entrance's looking good at a sub that don't have an HOA he looked at me and said, I never thought of that before, no my friend, HOA's can only do what the people let them, they tried to stop people from working from their home, well with covid what would they do, I know 50 people here in this sub that work from their home, they even tried to make every body park in their garage, no cars showing any where at any time, and they tried to make people sale their trucks and get a car, no trucks allowed, every body got together wow what a crowed, we put a stop to it and now, hardly ever hear from the HOA, don't get me wrong, they do do a few good things,

Yeah our community was like that. There was some racketeering between the hoa and tow company. The tow company was robbing members out of hundreds of thousands of dollars and illegally towing cars. They hired former felons. I wasn't aware until one guy who looked like a Crazy guy had signs on his lawn explaining and told me what was up. They changed tow companies after that and it's good now.

actually , the way Tow Truck Companys operate in HOA neighborhoods is that they patrol them , actively seeking out cars to tow , no calls needed , but they usually do it late at night , not sure what time of the day this happened to them , i would be surprised if it was a day time towing .

I'm all for towing companies because they are necessary, but as with all good things, there are those who find ways to abuse it and turn it into something horrible. Car stuck? Towed. Someone illegally parked on your property? Towed. Accident? Towed. Repo because someone isn't paying for their vehicle? Towed. All good uses there. But then there are petty people who have others towed and refuse to accept responsibility for it. This story is an example, and if you Google "Breakthrough Towing," you'll find an excellent case of why towing companies have such a bad rep.

I own 2 properties, never buy a property with HOA. HOA will kick your pets out if they bark or make noise, HOA wont let you decorate your yards, HOA wont let you put up Christmas light or Halloween decorations, HOA will kick you out the neighborhood. Yeah, that line that said "lawfully towed" is total bullshit. They don't want to admit fault in case someone files a civil case. If they admitted any fault, it could be used as evidence in the civil case against the HOA, kind of like when cops act badly, the dept will always claimed they "acted within dept procedures" so it cannot be used in a civil case against them.

I've lived in a condo for a while. I owned my apartment. Never again. They picked on everything, even where you had your bike. Picked on my little girl, and I mean, they were just assholes. One day, I kept a little dog for a friend who went on vacation. It was just for 5 days. Next thing I know, I have fines out of the wazoo for walking the dog on a leach, and allowing the dog to pee and poop on the grassy areas of the condominium. The pee I could not pick up but the poop I always did. Anyway... To make a long, pathetic story short... They sued me, we went to court. I didn't hire a lawyer. I decided to rely on common sense, and allow the judge to be well... The Judge of the matter. The morning I was to go to court, and approach my car, and I had a huge bird poop in my windshield. What a superb serendipity. During their complaint, I listened patiently, and when it was time for me to tell my side of the story, I just asked the judge to emend my counter suit. He allowed me to do so, and I sued the Condo Association for allowing birds to fly over my car and poop on it. I also brought to the judge's attention the fact that by being close to a natural reserve, several other wild animals had access to the facility, and that the dog I had watched over for a five days was not the only one pooping on the property, and unless the Condo Association were able to fine all those other animals for pooping on the premises, their fines, fees, and lawsuit was frivolous, and amounted to nothing more than discrimination against an animal that had the same necessities as others, and it could not be discriminated against, just because it had the same physiological needs as any other animals. Result: Case dismissed.

When you buy Deed Restricted property, in the purchase agreement you sign that you are aware of the HOA, must abide by their rules, and are given a copy of the HOA agreement. If you aren't happy with any of that, then buy a DIFFERENT HOUSE.

before you join go around to your neighbors, and ask them if they joined willingly or if they were forced to join by threats of fines etc. Most communities require at least the majority of homeowners to sign up WILLINGLY. I've always heard stories about crazy rules when people live in HOA controlled places. Things like you can't paint your house and mailbox certain colors, your hedges have to be trimmed a certain way and you can't trim them into different shapes, the grass has to be cut down to a certain length, you can't plant certain flowers.

Honestly it depends on the situation. Some places where the houses are detached, I think they are a waste of time or useless. If you live in a townhouse or condo they are very necessary especially if the exterior is maintained by the association. The problem comes from power hungry nosy individuals who get a superiorty complex. They should be voted out ASAP, but that means someone else needs to step up. Unfortunately too many people don't have the guts or brains to do that so you end up with situations like this.

My buddy had this problem with his HOA. He got a ticket from the HOA for parking on the street. He then sent the ticket along with payment to the parking enforcement of the city he lives in. The city enquired of him why he sent them the check and he explained that only the city has the right to enforce ordinance on public streets. the city then contacted the HOA and the HOA contacted my friend and told him they were sorry and sent him a letter of clarification and resolved the matter. Most states have enacted laws clarifying that HOA do not have domain over public streets.

Many HOAs own and maintain the streets within the HOA which gives them every right to either ticket you or tow you for rules within the CCRs that are not followed. When you purchase a unit within an HOA, before you sign on the dotted line, you are given a copy of all the governing documents AND you are given 10 days to review the documents before your purchase. If you decide to purchase the unit after reviewing the documents, you also agree to follow all of the rules within the CCRs. Parking on the street is a very common rule within the CCRs of HOAs and the association has the authority and every right to enforce any and all rules that are listed.

I cannot speak to this particular situation; however, I moved out of a Florida community because while the residents have their own garages and driveways, they park on a very narrow street. Not being from Florida, I discovered that a majority of Florida homeowners use their garage as storage area and park multiple cars in their driver, and/or other large items. Personaly, when your street is very narrow and people park on the street, the street automatically becomes a one-way street making it difficult to get into the neighborhood. What's even worse, is that they park on their grassy yard which is even worse.

That's hard to believe you would NOT take people to an HOA governed subdivision as most HOA homes are required to keep a pleasing "curb appeal' and many HOAs provide pool, tennis courts, street lighting, garbage pickup, drive-by security, street cleaning. lawns and shrub maintenance. i can't imagine a "pride in home ownership" person, including millionaires would be satisfied in an area that would NOT restrict junk cars on blocks, 3 foot tall grass and weeds, and run down streets, sidewalks and homes.

if you agree to it and sign the contract you get fined the hoa didnt apply anything to this family that everyone is not subject to as well. if u sign a phone contract that says each month your bill will double u dont get to be mad after you need to say thats crazy and never sign

HOA’s are far from being all bad. They actually protect home values. If the neighbor from hell moves in next door they can reduce the resale of your own home by $100,000 or more unless there’s an HOA to have them comply with reasonable standards. In this case it sounds like Code Blue Towing is mainly to blame. People are all for increased freedoms until they’re personally harmed in some way and then they suddenly want less freedom for the person who harmed them. Many want the police to leave them alone but are the first to call them if their car is hit or home broken into. It’s no different with HOA’s. Like the police their job is to protect homeowners.

@@adianchowdhury9016 The HOA did take some responsibility by issuing an apology and picking up the $800+ impound bill. I’m not saying this HOA is without blame but that doesn’t mean all HOA’s are a bad thing as many are saying.

HOA rules and regulations are part of the closing documents when purchasing a home. It sucks to get towed but it's easy to read.

@@BackSeatJunkie HOA's is no comparison to what a city does. If they were the same you would not need HOA's because all towns, cities, villages, etc have ordinances on what you can and can't do on your property. HOA's goes even further.

I have never heard a single story about a good HOA experience. All the stories about HOA's I have seen and heard are like this one; hellish, dark, evil. Things like this are why I will never willingly move into a house trapped under the arm of an HOA.

If folks move to a HOA --- abide by the rules. That is the purpose of an HOA to maintain an "image" which is the reason these folks moved there in the first place. Rules are to be followed and HOA minions are to be worshipped. If folks want to move up to an HOA neighborhood there are rules to follow. Otherwise they should move somewhere else.

We lived in an HOA neighborhood and they had one of our neighbors who was a former prosecuting attorney on retainer. He actually verbally attacked and threatened another elderly neighbor who was in a hospital after surgery over an alleged violation involving the color of new roofing.

I have two homes My residential one is in a hoa, my other rented is not. My hoa is cheap but maintains the price of the homes and looks. No street parking is common but in my neighborhood I can see why. Some owners are inconsiderate and clog of the road. Other than that it hasn’t been too bad. It at least makes sure my property value will not be drastically affected by others. I will say that I wish they had more rule when it come to fencing In my area. Like only wood or vinyl. I’ve seen some people put clear and all kinds of stuff and it just looks like the odd one out of the collective. Keep that creativity mess in the house.
