Yes but since it's simple assault and battery since they were no injuries, it'll likely just be a misdemeanor (fine, MAYBE a bit of jail time). And no, it makes no difference that he hit a disabled minor, that's the law in California.

@novajtv Did he really damage it? My understanding is that hood ornaments have to be bendable (to avoid impalings) usually held with a spring or by friction. I mean, still not right for anyone to touch other's property, but "damage" might be an overstatement.

They're not pressing charges because the guy's car was vandalized. He can charge them with felony vandalism and sue them to repair the hood ornament the child bent. A Benz dealership is going to charge over $400 to replace the ornament. I'm not saying he's right hitting the child but looking at this from a legal perspective that's what would happen. As far as criminal charges against the Benz owner he can say he was provoked. I've been through the legal system as a plaintiff in L.A. as a victim, the Deputy D.A.'s are always eager to work out deals with private defense attorneys or public defenders. It's not a legal system it's just a series of negotiations that don't really involve the defendant or plaintiff.

Making excuses for your child's behavior shows bad parenting. It doesn't matter if your child is disabled or not. They're not pressing charges because the child bent the hood ornament, so they can be charged with felon vandalism and the court can make them pay restitution for the damage. Teach your kids respect for other people's property. He shouldn't have hit the kid even though the kid made a gesture with his hand of bending the ornament, that's what pissed the guy off. You could tell that the mother wasn't going to be mother just like she wasn't a mother by letting her child damage something and just walk away. "Oh my child is disabled" .. isn't an excuse.
