The fast-food business was invented by two brothers who replaced carhop services with take-out windows.
But the McDonald brothers never got a piece of those profits.

Some people have a tendency to see the best in people and always give them the benefit of the doubt when they make promises. I suffer from this tendency myself and have been conned out of things on a few occasions. It's clear to me that it was the combination of the McDonalds brothers' trusting nature and the cunning of Ray Kroc that led to the final outcome; one or the other by itself would not have sufficed. There ought to be laws to protect people from such abuse of trust.

The moral is not don't trust others, but rather do your due diligence. If they had done their due diligence, things would've ended up differently for them. One, it was in their contract, they probably could've shut down the one across the street. Two, it doesn't seem that they did their due diligence with the initial contract as well as making sure that both parties had a favorable contract. If they had done that, it would've removed the need for Ray Kroc to go to such measures to try to continue developing the business. Thirdly, issue was breakdown of communication between the parties. Without communication, it lead to such an event happening. And lastly, NEVER accept anything by word of mouth or handshake. It's not legally binding unless it's in a contract. If they had used any attorney, the attorney would've known this and warned them. I'm not defending what Ray Kroc did, I'm just merely stating that there's a lot more to the story than "it's all this one persons fault". There's wrong on both sides (one man tried to take advantage of their ineptitude, and the other brothers didn't do proper homework and due diligence)

@aqua3418

Exactly!!!! So much could've been solved had there been more communication on the details of contracts so it would've been satisfactory to both parties, as well as doing due diligence by hiring the proper professionals to handle and take care of details. An attorney would've told them that verbal contracts aren't binding.
