It was the fault of the system, not strictly Liége. If they allow Bosman to leave, then somebody else takes their team to court with the same results.

@@andrew7taylor They could of just offered him a reasonable wage to conitnue playing (instead of a 75% cut) or asked for a much smaller transfer fee.

This is the point where clubs from smallers countries stopped surprising and having european successes. I'm from belgium and regularly teams from belgium reached semi finals or the final of a european cup. Most recently Antwerp FC in 1993, I always wondered what happened between the early 90s and late 90s, and now I found it.

This is why clubs from the Spanish Liga, the English Premier League, the Italian Serie A and the German Bundesliga are ALWAYS winning the UEFA Champions and Europa League. Their check books became much bigger and the competition itself became limited.

I think that Sol Campbell was a poor example because Spurs had offered him a ~£200,000 per week contract to stay at the club but he still moved to Arsenal who, as you said, offered him £100,000 per week. Sol Campbell move was therefore motivated by a desire to move to a bigger club who were competitive for trophies, not because of financial greed.

This is the demarcation line of modern football and world cups. Pre Bosman ruling could considered as classic football, and 98 France world cup is the first modern world cup.

Its interesting to return to this subject. While smaller clubs lost their power to retain players against their will at the end of a contract, they gained the incentive to develop talent in order to maximise transfer fees when selling. This has coincided with - and driven - a wider spread of 'talent factories' and the growth of the professional game in new markets from Japan, Korea, and China to India, Australia and America. Consequently the overall quality of play at all levels has increased exponentially and the depth of the talent pool is much wider and deeper. In theory, the clubs that are best able to develop talent through good coaching are able to rise up the league pyramid with less likelihood of going bankrupt. Many teams have traditionally placed an emphasis on youth and local players, however the rise in transfer fees for elite talent moving to big clubs provides significant additional resources for smaller clubs where one big transfer (or 10% sell-on fee from a sebsequent transfer) can have a transformative effect. Along with FFP, this has resulted in a change in strategy for smaller clubs from 'sell to survive' to 'sell to invest'.

it is exactly as you said, developing good players would raise the level of the league IN THEORY. Argentina forx example has produced lots of the best players in the world, and still is. But with such a great inflation in the country, the league cant grow at all, in fact it gets worse every year.

I'm so confused why that was even a rule in the first place. When my contract with my employer ends, I'm free to choose my next employer. Why did the clubs even have to agree to transfers when the contract already ended? 🤨

There was probably a non-compete clause. Players couldn't go do something that conflicted with the interest of their former employer. aka, don't play for the concurrents.

It was also like that in the NBA during the 60s, but like it changed when Wilt Chamberlain threatened the League that he will not only play for Any NBA team anymore but he will switch to their rival "ABL", of course the NBA didn't want to loose their "Mega star", So they decided that players are free to go if their contract is up

These videos are awesome. I'm a student studying finance and find myself becoming increasingly more interested in the finance aspect of sport. Do you recommend any particular sites or books etc to have a greater grasp and appreciation of finances in today's world of sport? In particular, the top football European leagues? Well the fall also came after especially the late 90's corrupted bank loaning in broad daylight by the uefa. Because in most countries it wasn't allowed or even possible to borrow from the bank... Ajax was 1st in 96 and Eredivisie was 5th. All that corrupted money has ruined so much. Only reason of Ajax almost reaching the Final was good coaching, youth, and the rest of the team that costed in total €58,5mil euro ❌❌❌

mightymoeish The contract ran out so they were no longer obligated to pay the contracted salary (hence the cut) and the rules back then said that they were not obligated to release him or sell him. He basically had to work for them but for a reduced salary and could not go to another club. So he sued them - and rightly won I must say.

@@SonicSP why did they pay him a wage in the first place if the contract had expired? I don't get it. As far as I know a contract is a legal bond that ties player and club, forcing the player to play for the club for the specified amount of time and the club to pay as specified, during that time. When that time runs out, why did they keep on paying him?

Your club was entitled to pay you whatever they want as long as some other club didn't pay your holder whatever they wanted to release you? Did they own your wife and kids too, or just you? Darn

This case is so confusing to me. When your contract is over, it is over. If I sign a 3 year contract with a job, at the end I can find a new job. If I sign a 3 year contract with a gym, at the end I can look for a new gym, if I sign a 3 year contract with a phone provider, at the end I can look for a new phone provider. Why this needed to be a ruling is beyond me.

This is what killed the south american clubs football. Now, brazilian is recovering and i see renovation in Ecuador. Argentina clubs are still better than ecuatorians, but if they don't reorganize, they will lose their spot. The other countries here are in deep dificulty at club level.

This is what football has broken, no fair football. Bosman arrest should not be accepted. It's not a normal 'job' and it's sad for people who have less money, season tickets are way to expensive and NO PLAYER SHOULD BE MORE WORTH THEN 80 MIL EU. I hope one day a political discussion will come and break down this rule. Max 5 foreign players just as in the old days, but say substitute 6 or 7 players instead of 5. It's really boring everytime the same clubs😩

contracts now run until either the winter or summer, they end during a transfer window. So probably less easy to challenge, companies don't have to cancel your contract either. free agents can still sign outside the transfer window.

@@Ldoggmillionaire It is a great rule when considering personal freedom. It just sucks it killed the competitiveness in the sport, it made the bigger clubs almost undefeatable. The solution is probably stricter financial fair play rules, but who want's a fair and equal sport when you can make money instead.

Lol.. refusing to let someone leave while he wants to go, but at the same time cutting his wages... quite strange we needed an ECJ judgment to find that that was not compliant with (EU) law. Seriously, every normal labour law will state that, if a worker is out of contract, the employer either has to let that person go or has to continue paying that person the salary that was agreed when signing the contract. So it's completely logic that this was the outcome of this case. However, I do wonder how the situation that even players who were out of contract couldn't just leave their clubs came into existence in the first place. Why was such a bizarre rule ever introduced and who did this? Maybe you could make a video on that... (if you haven't already of course ;) )

The question is not whether he can leave precisely, as it was never literal slavery, but whether any other team in country (or within Europe) would be allowed by the officials to put him on the pitch. Lots of professional sports were run by league officials who catered to the team owners preferences to treat players as chattel. When players made enough money to hire good lawyers, these systems collapsed.

Does anyone know how Brexit might affect British clubs use of the Bosman ruling, since the court ruling relied on European Freedom of Movement... Something that British clubs wont be constrained by after 2019. I imagine at least 1 club would fight it to regain some power over players?

There's always been a correlation between wage bill and on field success for decades in English football using data going back to the 70s - way before the EPL and Bosman. In a sense, the richer clubs have always won more. There is also very little correlation between transfer spending and league position/games won..

True, but compared to now, there was very little difference between the clubs financially in both in an absolute and a relative sense. The Football League contained the first four divisions and shared the money among all of them. There was also no Champions League, and the globalisation, the monetisation and the commercialisation of football was nowhere near where it is now.

The thing I don't understand is why would a player not be free upon expiry of contract at first place. It's supposed to be a simple idea.

Because the league officials and most team owners supported the concept that the clubs "own" the players, regardless of contract status. It does not make any sense in terms of contract law. But it makes perfect sense from the point of view of owners who preferred to keep players under their thumb, and had the power to get league rules written as they pleased. Most sports went through this. It was not until the circa 1980 that players in the big American sports had clear unfettered rights to find a new employer, after their contract expired. Same story.

@@Ldoggmillionaire That is ridiculous indeed. I don't even know why was that even the accepted practice in sports when it wasn't in the "civilian" life and shouldn't have been anywhere. But if you look at the bigger picture, its other effect made football predictable, elitist and boring. When importing foreign players were limited to a max of 3, clubs and leagues were on a much more equal footing. In the decade before ruling, you had Ajax, Marseille, Crvena Zvezda, Porto, PSV and Steaua Bucharest winning the European Cup. Videoton, Göteborg, Dundee United and Austria Salzburg reaching the final of the UEFA Cup. And Dynamo Kyiv, Mechelen, Lokomotive Leipzig, Royal Antwerp, Anderlecht and Austria Wien playing for the CWC. But when the Bosman ruling also made that limitation obsolete and clubs were able to become World XIs, you have all the best players in the world only ending up at the same 4 leagues and 10 clubs who dominate national, European and international football. It's been a decade since only English, Spanish clubs or Bayern München won the CL. Not even Italian or French teams could, the financial domination is so complete. And if you're not a fan of those 10 clubs but the other 1000s, your club has a minuscule chance of ever tasting success and no chance of ever making it last. Not because your coaches or players suck, but because the minute they get any good they are snatched away.

I favour freedom over competition. It would be bad if a person suddenly starts earning 1/4th of what they used to earn and they cant even do anything about it.

i see football history and see that the bigger clubs always had the money and higher win percentage also before the bosman , the clubs who had better money would make a deal with a lesser money club and would have been the same. at least the players are getting a fair say in that its should be like this and this rule made football better imo.

Bosman rule was necessary- makes no sense that a club can still demand a fee even once a players contract is up. Surely that just defeats the purpose of a contract.

No he simply did what he had to do to save his job. If the club didn't abuse him that hard he probably wouldn't have sued them. Also it's fairer to the players as they aren't bound to one club that way. A lot of talented players never got the glory they deserved because they were kept hostage by their clubs.

Players weren't bound to the club. If a club came in with the right offer, it would be accepted. Were there transfers before the Bosman Ruling? Yes. The freedom of movement part is a good idea, IMO. The PL, for example, should be able to accept as many players as they like from wherever in the world. However, players being allowed to leave at the end of their contract severely hurt the smaller nations and domestic football within bigger nations.

@@izdatsumcp so if a player breaks through somewhere at 16 and has a good 5 years the club should be able to decide hes never allowed to leave and now his contracts up were going to pay you way less too and your stuck here as long as we say. Absolutely ridiculous

Great video but your club having lots of money is also a function of how you run your business. Man United is successful because of how they build their business. Sure, these business tips are whispered into the ear of the board as they are bent over taking the Devil's willy in the bum, but good advice often comes from bad people. Arsenal are successful not because of the saintly qualities of the club and supporters, but because of the way they build and run their business. Newcastle should be a top, top club, but they run their business like hell. My point here is that it's disingenuous to ignore the effect quality of business planning and management on club success.

Man United really is an example of it really doesn't matter how you run your business at the top after you get there. The "rich getting richer" effect of the Bosman ruling, the Premier League, the Champions League and the globalisation of the broadcasting of football will always keep them among the richest clubs. Currently the are the most valuable, ahead of Real Madrid and Barca even though they haven't won their own league in five years and failed to triumph in the CL for a decade. Them having the best manager of the world, being their most successful when those gamechangers were implemented (and the decade after that) set them up with so much following that for as long as this system lasts, they'll always have audience -> sponsors-> talent -> money. The Glazers can only do what they do because of Sir Alex's success. If they took over Newcastle for example, they wouldn't have corporations like General Motors, Vodafone, AIG and Budweiser fighting for place on their shirts, so they would have no chance of taking Ł750 million out of the club either.

Tbh I still prefer the old transferred rule where only 3/4 foreigner player allowed to be played with every club from different country league.

When I watch a German football match, I want to see a considerable number (at least 6 per team) of German players. When in Spain, a considerable number of Spanish players. This leftist liberal ruling has deprived leagues of their national character. The premier league no longer feels like an English championship.

@@NeutralDice Generally, the left is not always strictly against free market principles, sure. But the general gist is that the left favours a more regulated market and the right favour a more laissez-faire market. So, a ruling that makes the market more free, is certainly not a leftist thing to do. And for the most part, most leftist parties oppose a fre market economy, favouring mutualism, socialism or a mixed economy. If your "leftist" party where your from favours deregulation of the market, then they are not leftists. The US American Democrats are a good example. To a certain degree, Blairs Labour as well. Both of those follows the neoliberal economic principles of Reagan and Thatcher, hardly the leftist revolutionaries. The fact that you claim "liberal" to be a leftist thing, tells me yoy live in a place where our garden variety Liberal party is not considered on the right of politics, which it is in most of the world. Clinton or Blair are not leftists, despite them governing as the left-most parties in their respective countries. Macron, for instance, is just as liberal as Clinton, but is in the French centre or centre right.

Taeerom So you think that a ruling that allows filling a nation's championships with foreigners is a rightwing thing to do? Nondemocratic (i.e. communist) left parties oppose a free market economy, but this doesn’t hold true for the democratic left, which will favor such an economy, as long as it serves its liberal internationalistic principles. From a leftist perspective, the Bosman case is that of a wage earner treated unfairly by capitalists, and so the demands, farfetched or not, of the wage earner (the weakest link) had to be fulfilled for his sake and that of internationalism. From a rightwing perspective, the ruling enables businessmen to freely invest in football, despite the huge inevitable alteration of a league's national character. At the time it was adopted, it harmed the right's principle of preserving that character, but was not contrary to principles of the democratic left. Now however, that many football wage earners earn extravagant salaries, it harms leftist ideas too.
