Ok so my mom passed several years back but my stepdad is still living but had a stroke & he can't tell me if there is a will but they both told my son they had one made & everything goes to him so how do i find out if there's a will & he also needs his bills paid but can't do anything about that either. What do we do?

To contact someone's attorney for information, the attorney would have to be irresponsible for giving out any information. It seems to me that if you're on a Living Will and try to find out the probate court should simply tell you just by making a phone call to them, yes or no if you're on the Living Will. What am I missing here?

Blessings to you this morning i just sent a friend request on face book, i also sent you a voice mail messages we need your help. my partner and i went to see a house that is in pre foreclosure, only to find out that she is not the living trust, she is an older women not at all computer literate and has no idea who her father left the house to, the house will be acution off on the 14 of april. can you provide some info on were i can start , thank you so much

I loaned a friend some money for which I have a promissory note. She died unexpectedly and had a living trust. Her son, the beneficiary, says he won't honor the note. Should I sue trust in small claims court?

My mother recently died intestate, perhaps. I say perhaps, because I also know the possibility that my sister found it, didn’t like what it said and destroyed it. However, I found my stepfather’s Will in county records, along with his probate paperwork. I don’t know how if that is recognized and suffices. Two of the provisions appear to name me as successor executor to my mother and that I inherit all and distribute, as I see fit. My 2 questions are: 1. Does my stepfather’s Will carry any weight? 2. As I am also in the midst of creating my own will probably se, while I know there is a Will registry in my state, which I know some lawyers are unaware of and I know one YT lawyer says it’s a bad idea to file a Will with a lawyer, I have no trusted family members which I’d entrust a PoA, Living PoA, or Will with. So, should they be filed with the Surrogate Court or is there another place to file these documents?

I'm sorry to hear about your mother's passing. All of the information about your situation will be dependent on the state you live in. I recommend contacting a probate attorney in the county in which your mother lived in for help on this one.

Wat I the trustee is a family member than u don't get along with. Do they have to tell u that ur a bennifituary? Wat if they dont?

In California a trustee has a duty to notify the beneficiaries when the person who creates the trust passes away and they are going to inherit something. If they do not, then you possibly have a reason to change or remove the trustee or at the very least have them follow the rules but it will likely involve court. I would find someone who handles trust administration and litigation to speak with.

What happens if the lawyer who helped my dad set his trust up is retired and firm is closed for business? Where else can I find the information?

Is your dad deceased?, if so, his will should be filed in the court in the county he lived in when he died. The tip off would be how the executor is. If the executor is the trustee of a trust, it would state that. Trusts are private, so if you are not a beneficiary your not entitled to any information.

There should be forwarding information on the California Bar website. If he sold his practice, then information about his past clients should be with another firm.

Hi, a friend of mine emailed me asking for my info cuz he said he is filling out a beneficiary. He didn't tell me if it was a life insurance or anything. He passed away last year and I have no way to find out if I am really a beneficiary on anything or not. So what should I do now. I still have those emails. Thanks

I'm so sorry to hear about your friend. You should check with the court in the county that he lived in to see if a probate matter is ongoing. If so, you should contact the executor or administrator of the probate matter about this. If there is not one, your options vary by state. You talk if trusts and I know who would have a copy of it and I was told a house was bought for me that I have been living in for the past 4 years but he is no longer and the person who has a copy of the trust we don't speak what's your advise on seeing if this person truly trusted me this house

You can go to your county recorder's website to see if your name is on the title to the house. Some counties still require you to go in person. If you are not sure if a trust was created, and the person is still alive, the only way to find out is asking them. If they have passed away and there was no evidence of a trust in their belongings, the best you can do is check on the title of the house and if it wasn't in trust, you might reach out to the Bar Association in the area that the person lived in to see if they can help you.

The trustee will be able to give him information if he knows who that is. If he has the information for the bank, he should contact them. If he has information for the firm that helped set it up, they should be able to tell him who the trustee is if he is actually listed as a beneficiary.

My ex husband never got married again who never married after we divorce told me many times he was living me the house and property. When pass away his brother took all the documents and sold the property to his daughter for one dollar. How can find information in reference to this issue. They did not ask me to be around for supposedly when they read his will. He left me an annuity only when I hire a lawyer. He did not work my case due to he was eefer to me by my ex-husband lawyer.

It's dependent on whether the local bar association has a listserv. It's worth asking if you think you are a beneficiary and that someone made these documents and they were not found.

I'm so sorry to hear that. I would definitely start with the bar association nearest to her residence and ask if they can send a message to their Trust and Estate section to see if any of them have information for you.

Living trusts file a certification of trust with the same county office. It only lists the name and the grantor and date of formation. Also, if the grantor funded the trust with property, that transfer will be in county records. Property tax records of the home will also list the trust and trustee, usually the owner of the home that set up the trust. If no records exist, possibly the grantor never funded the trust. It is not uncommon. Then you would not have a paper trail except at the attorney. I do not know if the successor trustee has to contact a beneficiary if the trust has no assets. Is there a will and does it mention a trust? Very few trusts do not have companion wills. Did the decedent have any deeded properties and what do county records show about the properties’ disposition? Yes, trusts are private, but they leave a lot of clues.

In a revocable living trust, you will only find out when the person who created the trust tells you about it, or if they pass away. Once they pass away, the trustee has a duty to tell the beneficiaries about it. In CA (maybe other states but I am not sure), you have a right to have a copy of the documents once the person passes away.

Trustees are not always honest and don't always provide beneficiaries the documents, copy of the will or trust. It is fairly simple for people to take what should legally have gone to their heirs. It would be nice if there was one central database for wills, trust and insurance policies. Some people are greedy and evil and will not carry out your wishes when you die, but ypu won't know that. What I have been dealing with makes me want to give everything away before I die.

Thank you for your question- if someone is named as a trustee then they have a duties to follow that are assigned by law. If an executor or trustee is suspected to be mishandling their duties then they can be removed.

can a trustee kick out a family member of a house if they are not the homeowner? My mom lived with my grandpa for several years (she was his caregiver) and when my grandpa passed away, my uncle kicked her out, remodeled the house, & is now living in it. The Grant Deed states my uncle is only the trustee. I don't see anywhere showing that my uncle is now the homeowner. We live in the state of California.
