Alway check if the person you buy from has any bankruptcy (PACER) or IRS tax lien when they lived there before you. Call city to be sure they don't have mowing liens on property. Good video - Title companies usually do a good job.

If you use a title company and get title insurance, you will be covered if they make a mistake. I have a deal we are working on right now with this situation - and the title company is going to get the title cleared for us because they insured it.

You can negotiate the lien. Don't pay full amount. Offer them half of lien you owe. I've done that and it works.

hi. they will often accept less? --even though they have a lien and are guaranteed the full payment from the sale of the house? How does that work? What do you say to them? I'm so curious!😊

​@@tamarunitamaruni4724 sometimes a person can stay in their home for a long time, year's and year's. By offering to pay off a lien for less, the lien holder doesn't have to wait for their money so they'll accept the lower amount, or it's better to get a partial payment rather than have zero for who knows how many years.

I had an unscrupulous home improvement/ bath remodel company attach a lien to my property because I refused to pay double the original price. They had me sign the contract on a Thursday, didn’t give me a copy until the following Tuesday. However they completed the work the previous Saturday. This was in NC. I filed grievance with NC attorney General for fraud raga it this company

Thanks for the info Joe, really liked the real world stories. My kids and I have been living in a one bedroom apartment and looking to purchase a house for cash. I have look at one house and there were so many different items listed on it, i was getting a headache trying to read them all. It is amazing how people use their homes as a cash machine.

@@celiacastro4566 A lien must be recorded at the County Recorder's office to be a lien. So any lien or encumbrance recorded there is what matters. That doesn't mean that a new lien can't be recorded tomorrow.

I know HOAS Cause people to get killed. A couple in Boca Raton lived in an HOA community & they had a deaf son who drove a truck well the HOA didn’t allow trucks and told his parents their deaf son had to park cross gateway blvd which is several lanes wide. Their deaf son parks his truck where they told him to on gateway blvd and he was ran over and killed while trying to cross gateway blvd. very sad. I can’t Stand HOAs either.

You replied to their ??? that it's something 'YOU TEACH IN YOUR', so it sounds like you give smidgets of info AS BAIT but we'll have to pay to see the contractor sample so you make money. We have these contracts in my coursework, but you can usually just put in clear english that if they stop doing the work for a certain amount of time, you only pay them for the line items they have completed so that you can hire another contractor to complete the work they failed to do.

Hi Frank. If the liens are against a property, they will show up on the title work. Just have your title company do a preliminary title report - it will cost a couple hundred dollars. The other way to find an IRS lien is to contact the IRS. They are happy to give you payoff information.

You explain things very well -- almost like a Dad!! Question: So, I have a chance to buy a first position mortgage note that has a $2500.00 lien on it. The property is worth over $20,000.00 and the taxes owed are very little. I know that I can foreclose on it and sell and pay the lien, but do you have any other advice? Is there anything else I should look out for before or after buying the note?

Remember, there is currently a moratorium on foreclosures right now because of the pandemic - and that may extend into the future. That isn't a reason not to buy, but it's something that should be taken into account. Make sure you pay less for the lien than the face value of the note - and that the lien is properly recorded - get a Prelim Title Report to check it out. Good luck with it.

A mortgage lien will be paid off at transfer usually by the money you pay to the buyer to purchase the property. The title company will confirm that you have clear title and give you title insurance when you close. I've bought property before that had a mortgage higher than my purchase price - when that happens, the seller comes to closing with the balance and pays off the lien.

It's no different from what you'd do with a house you lived in and had a mortgage on. Don't sign off on any work that you can't pay for. If you have someone place a lien and you haven't signed an agreement for the work, the contractor is going to have to justify that lien in front of a judge.

Joe, we decided NOT to go solar and the salesman was really upset. I almost had to physically throw Jordan out if my house after insulting my wife. He had Lumio install a lien against our house. I went to property appraiser to see the lien but cannot find it. You said go to County Recorders office. In Polk County Florida we do not have a county recorders office. Would I go online to the tax collector, is that another name for county recorder?

I'm sorry to hear about your trouble with the solar salesman and the lien on your property. In Polk County, Florida, the Clerk of the Court is responsible for recording liens and other property documents. You can find information about the lien on their website using an online search feature. Search by your name, property address, or document number. If you can't find the lien online, contact the Polk County Clerk of the Court directly for assistance. Additionally, consulting with a local real estate attorney is a good idea for further help. Can the court or a scammer take your house if the mortgage is still attached and current? Also, are banks, corporations better protected when they hold the ownership from illegal property transfers over an adverage Joe homeowner? If a title is being transferred is the city recorder of deeds responsible to pjusically contact the current owner to insure this is a legit transfer.

Hopefully, when you bought the property, you got title insurance. If you have a problem with how title is transferred, you can contact them to solve the problem. If you don't, get an attorney to help. No one can take a property from you without a legal proceeding to do so... but talk to an attorney if you have a problem that needs to be addressed - I'm not one.

Hi Joe....I had a judgment put against me in court and the judge said I was going to be responsible for paying attorney fees of thousands of dollars. $300,000. I have $175,000 equity in my home...can they legally put a lien on my home in Arizona?

I don't know enough to advise you... and I'm not an attorney. You should probably talk to a bankruptcy attorney to see if they can help you stop the judgement from taking your house. Some States protect your residence. I'm sorry this is happening to you and I wish you the best with it.

Yes. You will need a Warranty Deed, Disclosure, Limited Power of Attorney, Right to Talk to Lender, Right to talk to Insurance company. That should do it. You might ask your title company to do the closing - we started doing that a few years ago and it's been working fine, but you can also do them at your kitchen table - the deed needs to be signed in front of a Notary.

Amazing the things you learned on youtube ! What happens if you buy a property at an auction and you did not do a property title research? You would be in a situation where you cannot exchange titles. Are you in the scenario where you have to convince the lien holder to remove it ? That could be hard to track down who is the lien holder. And he might not even care at all in case his property was seized by the bank.

Typically, you would have your attorney do what is called a "Quiet Title" to clean it up. This could be easy if no one disputes ownership. If they do, then you have to deal with their claim.

Hi Joe, how long is a lien shown on the deed starting when it is recorded? For example, I do a title search today and it is clear, however, there is a lien it started to be filed last week.

It depends on the County Recorder's office and how long it takes them to get it recorded and in the public record. But if you go to the county office, they can tell you if anything is pending on that property.

Call a title company and ask them what you need to do in order to close the deal - they will walk you through it. Yes, you will want title insurance, a deed and a transfer of funds - a purchase agreement is helpful as well. Good luck with the deal!

It will show up the same way - at the county recorder. You can access it online in most areas - or through a title company - or by physically going to the county recorder's office.

I went to the county recorder's website. I can search for records by name, document, case number, etc but not by address. How do I search for liens on an address? Do I have to figure out who has owned the property and search by names? How would I know those liens apply to what property at all that point? They seem to have deliberately made this difficult

Every county recorder has their own website and they are each a little different. So - if you can't get what you need online, worst case is you have to go there and have them pull it up for you or hire a title company to do it for you.

@@joecrumprealestate Thanks Joe! I was able to locate a case number at the auction website and found some kind of result by searching that. It just shows a judgement of foreclosure though and nothing else. No amounts and it doesn't necessarily tell me there are no other liens nor the amounts owed to any parties at all lol. Lots of work still ahead of me it seems. I'm considering consulting a lawyer

Look for your local county recorder website. It's usually under a .gov domain. But if you search "{cityname} county property records and liens" you can usually find a website that will give you what you need for no charge.

They get the information from public record. It's called the "County Recorder's Office." It will either be online (in some areas) or if not, you can go to the county recorder's office and get hard copies.

I have a lien on my property from a credit card that has been charged off to a lawyer(collection agency). I am in the middle of a refinance, and of course I cannot close until the lien is cleared. Will the collection agency settle for a smaller amount, usually, if approached to? also do you recommend getting the lien off another way? If so, what would that way be? the debt is 10,000. Also this charge off happened over ten years ago, so it is an old charge off. It is not even showing on my credit report any longer.

It's possible they will negotiate, but when they know you are paying it off to get another loan, they know they have some leverage. I'd suggest calling them and asking. But before you do.... it might also be possible to do a quiet title action and get it removed. Talk to a real estate attorney and get their opinion. You could probably get that done for less than $2k if the company in question doesn't dispute it. Good luck.

What if the company that put that lien on the property is no longer in business? What do you do then?

I would suggest you talk to a real estate attorney. They will probably suggest doing a 'Quiet Title' action. I did one recently and the attorney charged me $1500 and it took a couple of months to complete. If you can track down the lien holder, that might be quicker and cheaper - depending on the situation.

Thank you so much for your quick response! An attorney was involved but this issue happened back in 2005 and we thought it was taken care off until now we found out that the lien is on there for a refi that wasn’t approved and the lawyer has since passed in 2016 it’s a huge mess 🤦🏽‍♀️🤦🏽‍♀️🤦🏽‍♀️

How can you avoid those scenarios where after you got a subject to deal sign the previous owner gets a HELOC on the property?

Record the deed when you buy it and the seller won't be able to get a HELOC. The bank checks title before they make a loan.

Wondering about your interesting story -the one where the remodeler disappeared before finishing and then returned wanting to get paid on the unfinished work and then filed the bogus lien! How did you get him to remove his bogus lien without suing him first? I'm soo curious!!!!! I had a talk with him and we worked things out. Most of time people will see reason if you explain your reasoning - and if you show them how a judge would see the situation. hey I file bankruptcy a couple years ago and I still have liens on my house they are from a hospital bill and from a loan company was a lawyer not able to get them off through the bankruptcy

A BK will typically wipe out any debts except for certain types (eg Student Loans) or ones created after you filed. You might have to get an attorney to write a letter to get them removed from your property. Good luck with it.

It will stay on there for a year if you don't pay it. After that, it gets removed. The contractor would have to take you to court to take the property and get a judgement. If they didn't do the work they promised, you have a good chance of winning a case like this - just make sure you take an attorney with you to court - don't do it alone.

I don't know about all States, but in Indiana, a mechanics lien is good for one year and the filer of the lien would have to take action in superior court to foreclose on the property (expensive). Also, all liens (mortgages included) that are already on a property will take precedence in a foreclosure action (they would have to be paid first if a foreclosure sale happened), so it's not easy to pull this off if you are a contractor and trying to get paid. If you are the homeowner, you might just wait out the lien and see if they file in superior court. If you don't have much or any equity, it won't make sense for the contractor to pay an attorney to get in front of a judge. They may just settle for scaring you with filing the lien, which is cheap and easy to do. ALSO, if the lien is bogus, the contractor would have to prove to the judge that they did the work.

When you have judgement against you and it puts a lien against all your properties, does this lien need to be recorded? Will i be able to see this lien if i go to county clerk's website and search for a property owned by the person against whom the judgment was? If not then how can I search for judgement liens?

All liens against a specific property have to be recorded and will be on public record at the county recorder's office... or online if they have an internet portal. Because of the nature of databases, there may be some variations on whether a lien shows up on a property record. The best way to find out is to do a title search and find out.

Thank you Joe, I pulled the title of the property but I am afraid I did not know how to read it, report said there are 3 unreleased mortgages, one in 2013 for about147000, one in 2015 for about 80000 and one in 2018 for about 47000, does that mean there are 3 unpaid mortgages or there has been a transfer of mortgages and I should go with last one ?

Now that you know which loans are still unreleased, you need to contact the lenders and find out what the status is of each lien. Usually, lenders remove liens after they have been paid off, but sometimes that doesn't happen and you need to ask them to remove them or file a Quiet Title action to get them removed.

Thanks for this information. I had a contractor that did not complete the project and left it unfinished but demanded I pay the remaining balance. I obviously did not pay and held back 5%. he is threatening to file a lien. How do I dispute this? I was told one way is to file a section 34 notice. is this a thing?

If he files, you will either need to settle with him or file against him to get it removed. Get an attorney for advice on this if you can't come to an agreement with him first. Good luck. Are properties sold at upset or judicial sale free of liens? Supposed a property valued around 150k is been auction because of delinquent taxes and debt amount around 15k, and supposed no lien on property….would that bring total payment to acquire property around 15k even though property value is more?

Yes. Typically, the judicial sale wipes out any subordinate liens on a property. But check with the agency you are buying from. I purchased some tax lien properties not too long ago and they required us to do a quiet title on the properties. It was easy and not expensive, but took a couple months to get done.

If someone invest in tax sale overages for ex homeowners who’ve lost their property due to back taxes what would be the best way to go by researching debt and ownership on a property before talking with the homeowners telling them they have unclaimed funds?

If people lose their property to back taxes, there won't be any unclaimed funds for that property. If you are just looking for people who are behind on their property taxes, there are lots of ways to find people who are delinquent on their taxes or going to a tax sale using the county recorder and buying lists from list brokers.

The deed doesn't protect you from liens. It secures your position in the line of title. So a lien can be placed on any property by anyone who thinks they have a claim. When you buy, it's wise to get title insurance so that any liens that are on the property before you buy are covered. Any liens AFTER you buy are something you will have to deal with and get removed - you may need an attorney. It's rare for someone to file a lien just to give you a hard time... and if they don't have a real claim, it's not that expensive to get removed... most of the time.

We did it through negotiation. The lien holder released it. It would have required an attorney if he had wanted a fight. In this case, he knew he was in the wrong and he backed off. We aren't always so lucky. Sometimes a gentle word can calm an angry beast. We have to resist our urge to fight sometimes... at least until we don't have a better option.

My ole man is discussing with another individual on purchasing 10 acres from them ....He is waiting on paperwork from this individual or actually the person who is the old owners ... I am getting a uneasy feeling about this purchase... the people who lived on it or bought the property was out of town and while being out of town their house was burned down.... from what I am understanding is the individual my ole man is wanting to purchase from... supposedly had conflicts with another individual about stealing their lumber on their property.. now we are being informed that there may be a lien on the property.... I'm trying to find out how or what would you suggest??

Good info! Question for you: In the case of an HOA lien where the HOA files a final judgement of foreclosure for an amount of $5k in unpaid dues for example, but there is a mortgage on the property with a balance of $100k. How does a third party auction bid winner who paid $20k on the auction sale come out with the property if the mortgage has a 1st position lien?

This is a question for an attorney. But a few notes... because the mortgage would have priority on the liens, the HOA would have to get in line for the money. So that would be determined by how much equity is in the property. Whether or not they try foreclosure would depend on all those things.

Yes, that is absolutely normal. The closing agent or title company will pay off the existing loan with the proceeds from the sale of your property and that will clear the lien/mortgage.

If it's on a property, it works the same way as other liens. The trick is how hard they are to get rid of. An estimated 530,000 families turn to foreclosure and bankruptcy every year because of medical bills, according to NBC. You gotta wonder if there is something wrong with the way we do healthcare in this country.

I believe you are talking about a "Subject To" deal. With a "Subject To" deals, we DO record the deed to us - so we get the tax bill. We don't transfer the loan to our name, all we do is make the payments. We have the seller sign a change of address form so the bank communication comes directly to us AND we get their online access to the account so we can make payments online. I hope that helps.

Talk to a real estate attorney. They may need to file a quiet title or some other appropriate action depending on the details of the situation. This isn't always that expensive. If Stewart is insuring it for someone else, they have no reason to try to help you win a case against them. If your lien is recorded properly and you have an interest in the property, you have a good chance of winning a lawsuit. Good luck.

Most liens are removed by paying them off or negotiating with the holder of the lien for an agreed upon price. Once that is done, you get a release in writing from the lien holder and use that to get the lien off the record. I'm not sure what you are referring to about the city coming and taking your property, but I suspect you are talking about eminent domain. Municipalities have the right to appropriate property for public use as long as they pay a fair market value for that property. That is how roads and parks get built. Unfortunately, a lot of public works hurt individuals in economically disadvantaged communities more often than affluent communities. Talk to your elected representative and vote for those who are looking out for the community rather than big business interests.

Hi - could you help with someone in California who has been in a dispute with a contractor who did some work on a residential property and have been served a mechanics lien that was sent by Construction Notice Services, Inc. The link appears to have been recorded on the property as per the letter. The amount of the lien is roughly $1,000, which is what the contractor believes they are still owed. Homeowner believe this lien to be invalid both because the terms of the contract have not been fulfilled by the contractor, and the deadlines for filing the lien has passed (the job was substantially completed 9 months ago. Questions below. Thanks in advance for any insights. Questions: 1) How can one check to see if a lien has actually been recorded properly? 2) Is it worth it for the contractor to enforce the lien given the monetary value ($1,000) of the dispute in question? How much does it cost the contractor to actually try to enforce the lien? 3) They also put an interest charge from when they believed the payment to be due of just under 2%. Are they within their rights to do so? 4) Assuming the lien is invalid, what are the next steps one should take to try to remove the lien from my property, and how long does this process take? 5) Are there any repercussions for the contractor or the company that they used (construction notice services, inc) for filing an invalid lien that doesn't meet the required timelines?

I'm not an attorney, but it sounds like something that could be resolved in small claims court. I would suggest filing a claim if you think you have a good case against the contractor. In the meantime, your property will have a cloud on it and if you are trying to sell it, you won't be able to get title insurance until after the lien is removed. Ultimately, you have to look at what position hurts you the least and then move in that direction despite who is right or wrong.

People don't always tell the truth. That is why most transactions use title companies and get title insurance. BUT if you are doing some forms of seller financing, you may not use a title company to close or flip a property. So, knowing how to check liens yourself if very helpful.

Yes, it's called a judgment. You have to go to court to get it, but if someone breaches an agreement with you, the court will usually find in your favor. Then you get a judgment against them that will stay on their record until it is paid - or for 20 years - whichever comes sooner. Judgments are often hard to collect.

First I'd check to see if your county has a website with this information. If it doesn't I suspect the only place to get it will be either the county recorder when they reopen or from a title company (which will charge you). My guess is that a title company will still have access to the recorders office since they are considered essential services, so call one and see what they charge and if they can get the information you need. It won't be too much - my guess is $250 or less.

Hi Joe, I have a family member (we do not communicate) who has not paid his taxes for the past 4 years, exactly what you speak of in this video. The property was originally in a trust (transferred to family member 2013 after the death of our father). At that time there was no mortgage on the property. Can I found out if there are any other liens besides back taxes on this property, and how much they are (if any) before moving forward? Unfortunately, I cannot trust the word of my family member if/when I speak with him. I already have an attorney and real estate agent lined up, but would prefer to find out more info before retaining an attorney and moving forward.

I've also already contacted the Tax Assessors Office and County Clerk in that particular county, in addition to the HOA for the condo. Was more interested in other liens that would possibly be in place.

Hi Elizabeth. The county recorder will have all the lien information on the house. You can go there personally and have the records pulled or you can call a title company and ask them to do a 'Preliminary Title Search' for you. If there are any liens against the property, they will show up there. If you are looking for judgements against a specific person, you can also do a judgement search - but they won't matter to the sale of a property unless a lien was filed against that specific property.
