If your car is #dented or dinged on a car park, you need to locate the registered keeper - but how? Also, is the #DVLA in breach of #GDPR by disclosing registered keepers' details? Let's find out.

Drivers who hit your car always say a dry duster will take out the mark. The last dry duster cost me £1100. The garage told me that when one car touches another the bill will rarely be less than £500. My dry duster guy was all sunshine and light by the side of the road but when I called him to ask for insurance details he turned into a very different animal.

That’s great if you have the VRM. A DPD drive crashed into my car and drove off after a delivery at my address. A neighbour witnessed it but didn’t get the VRM. I contacted DPD numerous times and refused to give their driver’s details. I went to the police in West Mids and they did nothing, refusing to act even though the driver drove off without reporting. My neighbour believed the driver must have realised he hit my car. The Police did not do their job. I feel very let down.

Yes, it would have been easily traceable had DPD or the Police helped. It appears the police have other priorities these days. The police response was to go through insurance. The insurance company wanted a VRM and told us to go to the police. Went back to the police and they still would not assist as we didn’t have the VRM and they were not interested to getting it from DPD. I know it was a minor crime but you’re right, it’s atrocious.

This sort of thing makes me glad that I chose to live in Germany. Firstly if you damage another car you must attempt to inform the other driver. If you cannot do that you most inform the police. Just leaving a note is hit and run, that means 3 points on your licence a hefty fine, and a 3 month driving ban. If someone hits your car and leaves you just inform the police and they take care of everything.

I'm confused by this. I used to work for a large insurance company and I know for a fact you can register a claim with only the registration number of the Third Party. Insurers have access to the UK insurance database and can request details about Third Parties as a matter of course. Quite often claims are opened like this because the Third Party has driven off from the scene but either a witness has given the registration number to the insured or there is CCTV footage which provides it. You also get claims started by drivers who have been injured at the scene of an accident and taken unconscious to hospital who only have the registration number of the Third Party from the Police. Someone's not telling the truth here, either the person asking for the advice or their insurance company.

I'm in the USA. My neighbor precisely did the same thing after hitting my car that was parked in my assigned place in front of my house. The neighbor left a note on my car, stating that the neighbor hit my car (visible damage) and wanted to discuss details about the repair. The neighbor did not provide insurance information. I reported the damage to my insurance company and...surprise! The neighbor is also covered by the same insurance company. I learned this after filing the claim. Now, I see that the neighbor is way more careful to either not park or enter too close to my car as that person parks or, n the case with that person's larger vehicles, opts for parking (illegally) in the handicap parking spot.

The problem seems to be that unless you have reported the matter to the police and they have issued a S172 Notice, you cannot compel the registered keeper to reveal the name of the driver even if you get their name from the DVLA. Irrespective of who was driving, however, the insured car was involved in a collision causing damage and so your insurers should take up the cudgels without needing the driver's name.

Shortly after I'd bought my current car, I had parked it in a public car part for a couple of hours only to find it had been hit. They had scuffed my front bumper and busted one of my front parking sensor and left no note. This particular public car park had CCTV and had a form for requesting footage. They would only hand over footage if you had a crime number, so I filed a police report. They deemed it was too small to do anything about so never provided a crime number, so I couldn't get the footage to file an insurance claim. Catch 22. Ended up footing the bill myself.

If it's only minor damage, it may be more cost effective to take the hit and avoid having a no-fault claim on your insurance history. Even a no-fault claim will increase your insurance for 5 years, regardless of so called 'protected no-claims bonus'. If you have more than one vehicle, the increase will apply to the others as well. The protected no-claims just gives you the same discount off a higher initial premium because you are now considered a higher risk.

Was thinking how to protect myself in this scenario and dash cam with collision detection is something that might prove useful, however, I was in court on a civil matter approx 25 years ago and had to sit through a lot of cases, one was a speeding ticket and the truck driver in his own defence took the stand a produced a tacograph record for that day and said it proved he wasn’t speeding. The judge didn’t give him the time of day and asked him if he had an engineer in court to read and interpret the tacograph readings and when he said no, the evidence was dismissed. In the event that I had managed to catch evidence on my dash cam, what would I have to do to get it admitted in court if I needed to rely on it to make my case?
@Wilkins_Micawber
@Wilkins_Micawber Жыл бұрын
I sympathise with the driver producing the tachograph. However, the judge was perfectly correct in dismissing the evidence without the witness of an engineer to interpret the record. Forensic evidence MUST be produced by a person qualified in the subject. This evidence does not stand on it own. The judge cannot himself present and interpret this evidence. He will be making himself a witness in his own case. Also, he himself is not qualified to present the evidence. The diver would however, be open to bring an appeal and bring an expert witness to court. When the judge dismissed the evidence the driver could have asked for an adjournment while an expert could be sort and brought to the court. Then there is the question of calibration and accuracy of the Tachograph itself. Is the machine recording the speed correctly. The construction and use regulations require that Speedo’s are accurate only within +/- 10%. Tachographs are checked for accuracy on a regular basis. But the question is was the tachograph correct on the day of the offence? Again expert witness would have to certify both the device and the chart.

It depends on the country you reside in, it’s laws and your insurance company. In the States many laws limit an insurance company from paying on a hit and run while some allow insurance companies to use their own terms and limits on hit and runs. Understand that these hit and runs are usually paid out of an insurance pool that all insurance companies pay into if you have protection coverage for non insured, under insured coverage on your premium. In many States the insurance companies have open access to vehicles registration databases so they usually go after the owner if you can provide a registration number. Now understand Insurance companies = big money= top shelf attournies . Net result for the average joe= pay up or possibly jail time.

The fact that you have been dinged once means that you are more likely to be dinged in the future. At least that's how the insurance companies see it and it doesn't only apply to collisions, it applies to almost anything. For example if you are a passenger involved in an accident they consider that this makes you more likely to be in an accident as a driver in the future.

I had a car damaged in a supermarket carpark. I was in the car at the time. A woman parked next to me and dented my car while she was getting out of hers. There was no argument about the incident. But the woman said because of her size she found it difficult to get out if the car as the car spaces were so small. I agreed with her, the spaces were not a suitable size for a modern car. If supermarket and chainstores or anyone else for that matter make parking spaces that small are they not at least partly responsible for damage??

In your case, how did you obtain the CCTV footage from the shop that showed the other vehicle denting your car? Did you just ask nicely after explaining the situation, or was there a form you needed to submit to them as well? I know businesses are often reluctant to show their CCTV footage to anyone but police -- did you get the police involved in order to see the footage?

I have had a similar experience in an rta when the 3rd party refused to give me his details because he was adamant that it was my fault after the police left the scene after I gave my details. Anyway I couldn't communicate with the other parties insurance company because I had no details. After 8 weeks I was being sued in a small claims court for damages and personal injury compensation. The terms of the court was full disclosure within 7 days of the hearing. The plaintiff sent me there statement of facts on the 7th day before the hearing 2nd class post and on the evening post on the Friday according to the frank mark on the envelope. It arrived Tuesday 3 days before the hearing. Anyway I defended myself against the insurance company solicitor and I was found not liable and the judgement was in my favour. He was furious with the other parties tactics and none compliance with the order of disclosure and especially when I had given full disclosure within 30 days of the hearing. I had took several photo's of the crash scene and relative vehicle positions and skid marks. It was found that the plaintiffs claim that he was struck by my vehicle on his side of the road was blatantly false and the near side front wheel of my car was in the grass verge and hedge row trying to avoid the oncoming vehicle that collided with me a good 3rd on my side of the road. The judge asked what losses I had incurred in the accident and I explained that I had over £1000 costs for the damage that I paid formyself because I had no details to counter claim. The judge said that he was very sorry that he can't award me any damages because I have not made a counter claim that . He also acknowledged that because of the details being revealed in only 3 days before the hearing it would have been difficult to counter claim in such a short period of time and unfortunately I couldn't be compensated. He did however chastise the solicitor and his company as well as the plaintiffs insurance company and was going to write to the head office for their shoddy and underhand conduct for their none compliance of full disclosure and my inability to counter claim in such a short period of time before the hearing because I have not been informed of who they were until I received the claim of damages and to attend court. I have not been informed of the outcome of the judge writing to the insurance company but unfortunately they are a very well known and large company who regularly advertise on the television. One would assume that such tactics wouldn't be used by such a large and reputable company such as theirs.

Can you advise on the request for CCTV? I have asked a supermarket to provide footage of an incident and they stated that they will only deal with my solicitor. I instructed my solicitor to send them a letter requesting that redacted footage is sent directly to me and to retain unredacted footage until the matter is closed. The supermarket has since stated that they will only interact with my solicitor. At what point can I declare that I am representing myself? I have already paid my solicitor for his services (the formal letter) and do not want to incur more fees.

5:33 I would report it to the police within the alloted time anyway. Two reasons, the other party may have reported it as they are obligated to do, and it is too easy to twist around and counterclaim as damage is likely caused to their vehicle, which would make me obliged to furnish details or report to the police. You do not need to be in the act of driving, or even in the same country as your vehicle to be required to furnish/report. Being parked is enough. As a side point,

Is there a time limit of 24 hours to report to the police? A car reversed out a parking space and into the side of my car as I was passing. The driver was extremely apologetic, promised full restoration and begged me not to report the incident. A few days later when I contacted him about the incident he denied all knowledge, stating the accident never happened. I attempted to lodge a police report, but the constable at the desk told me I was too late as the report must be filed within 24 hours. If I have another incident I will immediately make a police report, irrespective of how much groveling the errand drive displays.

I'm not 100% sure, but I'm sure I read somewhere that the registered keeper automatically becomes liable if they can't or won't identify the driver. The reason being that as a registered keeper, you are supposed to know or have access to info on who was driving the vehicle at any given time.

Be prepared to defend yourself should the other party say "Mate, you're gonna have to give me your phone" (so I can destroy any evidence you have against me), as I don't hand my phone over to (aggressive and violent) strangers. Contact the police online. Either deal with it independently or through your insurer. That's how I would deal with it. If aggression in imminent dial 999. Wish I'd seen this 6 months or so ago when a small truck hit my car and ran while it was parked in a car park, leaving a big dent in my tailgate. A witness got a photo including the number plate. Reported to police and insurance. The police did nothing. Insurance were only interested in charging me a large excess to get it fixed and didn't seem very helpful at all. So in the end I just left it as it wasn't worth the effort or expense. It seems in London you can hit and run and get away with it even if there is solid evidence! So now I drive around in a cosmetically damaged and spoiled car through no fault of my own and reminded every day of the injustices that go on.

Not wishing to say that you are wrong (it seems to me that it is your contact's insurance company that is incorrect), but I believe that insurance companies can identify the car owner's details given the vehicle registration as this happened to me many years ago, circa 2002 - 2003. I received a letter from my insurance company saying that a claim had been raised against me for an accident I had caused, having collided with another vehicle; "driven into" was the phrase on the letter. I was completely unaware of this collision. Briefly, the situation occurred at toll booths, after which many lanes, typically five at peak hours, converge into two. This is at the Birkenhead entrance of the Mersey Tunnel. The barrier in my lane had raised, I left the booth area and at approximately 20 feet further on I was forced to stop as I became aware that another car from the booth to my right was heading to the same tunnel lane. The other vehicle had also stopped and, since I had left the booth area a fraction of a second earlier and was approximately six feet ahead, I drove off. If anyone believes that I should have been paying more attention and aware of other vehicles around me, this was not possible as the toll booths obstruct vision to the right and left. I never felt or noticed in any other way this "collision" which was supposedly on the driver's side. Since it was peak hour in the morning, I decided that it was not worth the risk of communicating with the other driver and drove off into the tunnel. I assume that at this point the other driver must have recorded my number plate and raised a claim with her insurance company, who then found out my insurance company, who then subsequently contacted me. And for the curious who want to know the outcome, I informed my insurance company that an alleged "collision" had not occurred, pointing out that the other driver stated that I had "driven into" her when it would be impossible as my car cannot move sideways, and that if there had been a "collision", then why is there no damage to my vehicle. Almost twenty years have gone by and I have never heard any more on this matter.

Many years ago my insurance company would not pursue a claim against the other 'at fault driver' until such time as he informed his insurance company of the accident to enable the insurance company I was insured with to pursue the cost of damage he had caused to my vehicle, and that I would bare the claim for damage and repairs to my vehicle on my insurance (fully comp policy) until such time as he did inform his insurance company and they could reclaim their costs. I wasn't aware until this accident happened that legally you are not obliged to inform your insurance company as they only act as a third-party. Got fed up of my insurance's non actions on my behalf and issued small claims court summons against driver of known vehicle for £600 - which was a lot of money in the 1980's and won the case.

Dear BBB , i wonder what your view is about an incident i had about three years ago. I was driving very slowly through a car park of a public house. A car suddenly reversed into my car and caused a slight dent in my offside front wing. The driver of the other car apologised to me and admitted liability to his and my insurance company. However, a few months later when I came to renew my insurance I was told there would be an increase in my premium. I asked why and after pushing them I was told that there is a greater chance of me having an accident in the next year. How ridicules! I pointed out that I had been driving for almost sixty years at the time without being involved in an accident. I have driven all types of vehicles from motor cycles, cars, vans, hgv class two vehicles, fire appliance. I was also at one time a driving instructor and an advanced motorist. They would not accept my view that I was indeed a much smaller risk of having an accident due to the aforementioned facts. Nevertheless, they would not yield. Any views on this?

Of course, this doesn’t work if, when you return to the carpark and find your car has been rear-ended by someone in the bay directly behind you and the bay behind is empty. Note, there was no damage when I retrieved what I needed from the boot just immediately prior to leaving, on foot, for my appointment. Clearly, the culprit had either, simply ignored it and made themselves scarce, ( by parking elsewhere in the carpark?) or, possibly, were unaware and simply left the scene - oblivious to the fact they had caused any damage? I suspect the person who dinged my car, as described here, made off PDQ! Repairs remain outstanding. The damage has not affected any safety aspects - just bent trim and a small dent. It is in a difficult area halfway up the tailgate.
