Hello Ma'am, thank you for the info. I still have a few questions: 1. Let's say I buy shares worth Rs 50,000 and then gift it to my relative. Then they sell it for Rs. 60,000. For the record book, shares are bought by one person and sold by another. How does tax department track profit and loss for such a case? 2. How does the company know that my relative is now the shareholder and not me? Thank you for your help and your educational videos!

Basic in gifting stock, gift received day's price of stock will be buying price for the gift receiver and then tax will be calculated as follows

@@Lichibug for sender income will be 0. For receiver he will get 25 rs + tax+income tax Tax will be based on profits he makes and also that 25 rs must be added in income tax

Your broker has your pan details, they do update IT Dept. about all your and your relatives transactions. When your relative sell shares they will taxed as per Capital Gains 2. Company all gets updated about all its shareholders frequently

Tax implications when shares received in gift are sold should be covered- holding period of one year /3 years to be counted from donee' date of original purchase or date of gift What'll be cost of acquisition? etc

what will be the Average BUY Price in the receiver's demat account? and Rachana mam when will be that 3 stock of the month analysis be published ??

I don't think it even matters what the avg. buy price will be for them because the money invested was ours in the first place. It is a gift so no money was gone from their pocket. So practically their avg. buy price is ₹0. The whole sell amount will be their profit.

Buy price will be the original buy price of one who is gifting.

I think the average buy price will be the closing price of the day of transfer. For e.g. You buy stock at 100rs and now it becomes 150rs, the receiver will receive at 150rs buying price. So you must be thinking what about the 50rs? I think those 50rs will be credited to the sender's account as profit. Same for loss, the loss will be debited from sender's account. If this is true then what happens if the sender doesn't have any funds? Will the funds go into a negative?

Will say personally if you are frustrated this early then you don't look like a long term investor. And if we talk about itc. Every company has a cycle that sometimes no matter how good company is until they show the strategy working and growth is really there as in current time FMCG and other is growing and other that were contributing are shrinking that make complete balance sheet to be smaller and people don't see will they able to grow more or not. The answer is still not clear that is cigrate still a good buisness, FMCG is not saturated already and is there any more available to grow and as picture is unclear and even the margins and buisness viability. The other is rating do we value it as a cigarette company or a growth FMCG . Until they proff the FMCG is there future then only rerating will start and that atleast need either cigrate to fall by half or FMCG and other to double or triple. So until that happen rerating will not be there same have happen with relience (2014-2018), hul , kotak, many phrama company like laurus labs, Infosys in 2011-2017 period. They all have some period of stagnation and then blast will give multibagger in future until stock blast up.

Just bank transfer thr money and the person can directly buy the shares in his account. No headache, this shares as a gift is a solution looking for a problem.

If the shares to be gifted were bought at much lower cost say 50% then current market price then what u said won't work

@@adityapujari1331 it doesn't matter at what price the sender bought the stocks when the shares are transferred to receiver. Buying price for receiver is the price on the closing day when the shares are settled. So what @Krishanu says is correct, its the same as the sender selling his stocks and handing over the money in cash to receiver, but in the latter case sender has to pay LTCG

Nice Information. You have detailed the Tax implication part to the extent of tax applicability as recipient of gift and in case of relatives, it shall be Nil. However, please elaborate the tax implication of the dividends & taxable capital gains earned by the recipient on stocks received as gift.

Hey Rachna, Liked the way you explained the things. I just have 1 question How the taxation would work in case of selling gifted stocks. Does it will be applicable basis stock price at the time of gifting or it will applicable basis time of original purchase Like: I want to gift some stocks to my wife my purchasing price was 300/per share but at the time of transfering stocks price is 350/per share After that at the time of selling these stocks selling price is 400/ per share then how taxing would work here

Hi Rachna, I want to know that how the tax will be calculated on these gifted stocks for receipent. 1. What will the cost for receipent ? 2. Which buying date will be considered ? 3. Do recipient needs to mention anywhere in ITR about gift ? 4. If recipient applied for an IPO from his own bank account and wants that share back as gift then what will be the situation ?

Dear Sir, (This is from Mothilal Oswal reply) Please note this is our internal policy to block third party shares and avoid selling in such stocks. Also SEBI has given the authority to all the brokers to set an internal policy to safeguard /prevent their trading platform from fraud/unauthorized transaction and the same has to be adhered by all the clients/AP’s. In this case, we suggest the client to take back the shares to the original DP in case there is no blood relation between client and third party. ....pl. guide me

Hello I have two querries here. 1) Gifting stocks worth 5 lakhs to my Husband's Bua ( Sister of Father in Law) is under relativer or not. 2) if reciever ( relative/ non relative) keeps the stock then no tax in that financial year. Tax is to be paid only when stocks are sold. Whether Stcg or Ltcg. Please confirm Divine Thanks

One can also gift shares online through CDSL. If shares are gifted through CDSL, receivers consent is not required. Instead the concept of trusted account is applicable.

Zerodha, official video is saying after entering TPIN, someone has to follow the sms link received from CDSL and enter PAN. Before 8pm same day. But you haven't mentioned such step.

You have transferred the stocks as gift to your minor children, therefore the income from such shares will be *clubbed* in your income or your wife income ( whichever is higher )

Your video is indeed informative. However, I have a very specific query regarding tax liability on re-transfer of shares. It is understood that when transfer of shares/stocks takes place from A to B ( who is a relative of A) as a gift, then 1. There is no tax liability on A or B at the stage of transfer. 2. Later, when B sells these shares, capital gains shall be calculated from the date of purchase by original buyer i.e. A and the resulting tax liability shall be borne by B. My query is regarding tax liability which shall arise in case B does not sell but re-transfers the shares to C ( or back to A), which were originally received by him/her through transfer from A. In such case, will the tax liability remain same as was applicable to the transfer from A to B or now capital gains tax liability will arise and payable by B, even though B has not sold but further transferred the same shares as gift/ transfer to C. Kindly clarify.

This video is helpful. But please clarify our case from clubbing of income perspective : Mr. A (being a higher earner) gifts stock to Mrs. A (being a lower earner). Will clubbing of income provisions be attracted? Will the capital gains obtained from stocks gifted to Mrs. A taxed in the hands of Mr. A?

Thanks for making the video. Wanted to know about this but was too lazy to research. I've few questions. 50k gift limit is on Rupees. But here we're gifting shares and not Rupees. 1. What happens if at the time of gifting, shares were 50k and then again taxed as income from external sources for selling the shares? 3. If I pay tax on receiving shares worth >50k. And in the next FY i decide to sell it, I'll be charged both tax on gift and tax on selling the shares? 4. How will the capital gain be decided when i sell the shares? Because i never bought the shares.
