I was originally classified at 70% disability with the VA then they started to pay me at the 100 percent rate due to the fact that I can't hold gainful employment. And my paper from them also said that I was p and t. I don't also understand why if I am P and T they don't think it warrens a 100 percent rating. Plus, I got more than a depression, I also have problems with remember oral instructions and remember where I put things a day after I done it. I was alright for over a year and a half while in the military, then it started to happen with my concentration, and memory. There is talk that agent orange was sprayed next to the base that I was stationed at while on active duty, but the VA don't want to admit it. And the Dr who interview me for my increase had a heavy accent, and I had a lot of problem understand what she was saying. Plus, I got a bad feeling that she was for the VA instead of my own benefit. And ever since my interview the VA seems to be dragging their feet with my case, namely my primary care Doctor.

Make sure you're getting seen for your conditions you're rated for. Either by the VA or private. Get a physical done once a year at the VA and provide them with your treatment notes if you're not being seen by the VA.

this month i just got bumped up to 70% from 40% - is it best to wait a couple years after that before re-applying for an increased rating? i think if i did it now theyd say it couldnt have gotten much worse over a few months.

So I was just bumped to 70% effective 1 Jan 23. But I am also 71yo. I have PTSD 70%, Tinnitus at 10%, 3 residuals at 0%, knee strain, foot puncture wound, hearing loss at 0% also. So do I understand correctly that if your over 67-8 you can't get unemployability to be paid at 100%?? I draw a small Civil Service pension, and because I do, I am also under the WEP with Social Security and am only allowed to draw $261 SS. Perhaps I can try for hypertension as I average 215/89, even with three BP meds and a med for hypertension.

I am a disabled veteran rated 80% unemployable and paid at the rate of 100%. It’s important for veterans to know that at the age of 67 when you can receive Social Security retiring you will lose your unemployable income and be rated at your disability rating. Only by accident did I find this out. I called the Regional Veterans office and yes that’s true. Unbelievable

O ya I forgot that they want me to come up with certain paperwork that they can lose our change at there convenience. Because my regular doctor said that I have degenerative disk dezeese in my lower back and my neck and major arthritis in both hands. And buy the military I'm not disabled and SSDI gave me disability for depression. Can't figure it out. Thank You very much if the people handling out money off of tweets. Thanks. JerryTipton

I'm a veteran rated at 80%. When I retired 14 yrs ago I was rated 0 for service connected bone spurs. Not your average bone spurs. Mine grow where the achilles tendon attaches to my ankle. Spurs grow enough to protrude through the tendons on both feet. During my service I had 3 separate operations to shave down the spurs. Twice on my roght foot, once on the left. Now the spurs have regrown and the VA podiatrist says further surgery is not an option. Shouldn't I be able to get that 0 % rating changed?

You have to do the paperwork to apply for it. The screwed up thing is that the VA knows about most of our medical issues but forces us to apply for the disability and upgrades instead of automatically awarding it…. And if we fill out the application wrong we get Jack, even though they know we have the issue cause either their doctor or a military doctor found it…..

I was injured in Korea on a field project and they said that I was injured in Hawaii on my off time and that is why I was turned down. And a friend told me to keep fighting for it because his friend gets his and he was home on leave when he got in a knife fight in a bar and he got his disability because he was still on active duty. I tried to get the VA to give me a grant for 3,500 hundred dollars to get this vehicle fixed that I I am buying from a friend for 1,500 and 3,500 for repairs for the wireing harness getting cut. It looks brand new in side and out. It is a 2001 Dodge Durango that was impounded from some people that he knew so he bought it from a auction. And I tried to get a VA grant for It and they had the nerve to send me a reply that if I was a disabled veteran then anything over 24 thousand dollars would have to come out of my pocket. I got my SSDI as soon as I told them that I slipped off the tailgate of my truck ín Korea on a field project and filed for my disability from VA and was turned down because they said that I was injured in Hawaii boogie boarding. I asked them why did they send me to sick bay every day for a half hour of hot oil massage and a hour of traction. If it was my hands because that is why they turned me down. Because they was going for my hands. And that is why I was trying to get this out to the people on tweeting money to people and when I was done writing it down it was put in drafts to send later. I don't know why. But when I went to my drafts right then to send it it was gone. My wife and I have been without a vehicle for going on 3 years now and it cost us 20 dollars to walk out the door anymore if we can reach one of the three people who will take us anywhere. We took everyone anywhere they needed to go. I'm about to give up. I went to Edwardsville IL to the VAs office to ask for help to get our power turned back on when it had been off for About a month and they said that they wouldn't turn it back on for less than 1,700 hundred dollars. VA waited around 3 weeks to have it turned back on and they only paid them 3 hundred and 3 dollars. I said thanks because I was in charge of the jump rig in communications while I was in the military. All communications that was sent out of the Field went through my rig. So I was going to be the first person to be taken out in war time and that is all that they would do for me. Thank you very much Uncle Sam

I am at 100 percent worried that they are paying me too much what should I do getting $4,256.06 was getting before increase $3,915.42 Thia amount was on decision letter when I went to 100 percent

If you're 60% Service connected and have been on 100% unavailability for 28 years, why can the service connected not be moved up to 100% total & permanent?

It can, but you have to apply for an increase based on the rated issues having gotten worse and the medical records bearing that out.

Hi I am rated at 80percent but I’m getting 100 percent paid for p/t I U. I am confused shouldn’t my 80 percent rating be 100 percent I U p&t at 100 percent rating and not at 80 I’m confused they said TDIU would give 100 percent permanent and total rating I am receiving percent pay but at 80 percent rating can someone help me understand

ive been in the army for 13 years so far. im still in the army right now im going to appointments that i should have made a long time ago. when i was younger i never made appointments or went to sick call when i was injured because i didn’t want to look weak. very stupid i know. now that im older i realize how stupid i was. anyway im at 13 years right now if i go the full 20 then i can get my pension and a va disability check right? what if i get a new job as a truck driver after the army? will they cancel my va disability check because im now working? because obviously im not disabled if im working at a new job. because i would like to get 3 separate payments 1. my pension for serving 20 years. 2. my va disability payment. and 3. my payment for my new job as a truck driver or mechanic. is this possible?

you will get your retirement pension (1/2 base pay right?), your VA disability is separate and you will get the full amount based on your disability rating and that doesn't impact how much you can work because that is against the law, even if you are rated 100% disabled. Disabled people can still work to some degree. Now I have heard that if you are rated lower than 100%, say 80%, and you are unemployable and qualify/receive TDUI (Total Disability Unemployable Income) then you aren't allowed to work because it "auto bumps" you to 100%. I heard two sides, so not sure on the last one, but if you are receiving compensation for "being unemployable" then it it kinda makes sense that you don't work OR you only make enough money that it's not considered GAINFUL EMPLOYMENT, meaning you make less than say $12k-15k a year. Don't quote me, but I am pretty sure that is correct.

The ONLY reason you would not be able to work is if YOU apply for TDIU (when someone is at a lower percentage but being paid at 100% because one of their issues keeps them from being able to work).

Just messaged with someone at your firm. They asked if I was seeking legal representation and I told them I wasn't sure and stated why I reached out. They said you couldn't help but if I was seeking representation then to reach back out. How can I commit to representation if I don't know if we should file for an increase? I'm hoping someone can help me further.

I did the same thing and was asked the same question. I also said I wasnt sure and they then wanted to do an "intake" on me, so am not sure if they want to really help, or just want to see if they can gain a new client. Not sure what to do now.

When filing for TDIU am I able to state that it is due to two major disabilities? I have a 70% for depression and 40% for low back (which is static). I've read and heard that one should file for a single condition as opposed to multiple conditions. But I want to ensure that the VA knows for sure that I've I've unable to work since 2019 and I have tried working a job where I control my own hours. Can't manage anything. I also want to be as detailed as possible by preventing the VA from taking any loopholes, such as the argument for sedentary work. I'm not trained for that and I can't focus long enough to learn a new skill. Any advice?

All you gotta say is you can't work anymore due to your documented service connected disabilities. If the deny you , hire attorneys hill and pontoon . They will take it from there and get you 100 % .tdiu. T and P.

I was told that in order to apply for TDIU one of my disabilities need to be at least 40% already by itself.

Wow, do I got out of Army in 2019, and I filed my VA disability 6 months prior to getting out, shortly after I hurt my back, so it’s not in my VA claims/rating. I have 40% now, Also I never claimed my knee but I am starting to have knee problems when I’ve injured it in the past. So I would be able to get reevaluated and get a new and hire rating?

I am sure that is illegal, so have the VA help you, I read they are obligated to track down records, whether military or private.

i am rated 30% for multiple sclerosis i am sure i do not have. i want that removed from my list of disabilities. i am rated 10% for 3 conditions i know will not change. i am rated 100% p&t for schizophrenia that i do not think i have either. i want that rating lowered. to prove i am healthy.

SPECIAL ALGORITHM: Largest Percentage of item at face value, every other item at half of the percentage awarded up until 90% (round down to the nearest ten), to get from 90% to 100% you need 100% more in face value awards after hitting 90%. EXAMPLE: I have Sleep Apnea @ 50% and that is my largest individual award so take it at face value of 50%. I have several other issues rated from 0% to 30%, since it takes 40 to get from 50 to 90 I take 80% of my remaining issues to count for the 40% from 50% to 90% and check and I have 80% left over, so I need to come up with 20% in new issues or upgrades in appeals. When I was rated at 70% I had the sleep apnea and 50% face value in four other issues, but take that at half value and get 25% then round down to 20% and add it to the sleep apnea 50% and boom, 70%. I’ve discussed this several times with VA employees, they all deny this is how it’s done, I always either say, “really? Because that pattern works for mine to get exactly what the VA calls my percentage.” Or I say, “fine, explain the algorithm in your words then.” They never can and always say it’s too difficult to explain, to which I say, “I got time.” At which point they make some BS excuse. I honestly think none of them have a clue how it works and their boss or the person who trained them said it was too difficult an algorithm to explain and they were stupid enough to believe that. I have discussed this algorithm with hundreds of people with VA disabilities and only a couple said my algorithm did NOT work for them, in each case I asked if what the VA awarded them was ten percent lower than what this would do and they all said yes…. So yes, a couple percent of the populace are ten percent lower than what I say would be, no I don’t know how it happens (but I didn’t ask what all their issues and percentages were so I don’t know if it had to do with certain medical issues or if they were really bad at math)…

The true algorithm, and excuse me if I'm misunderstanding what you were trying to explain, is they start with your largest claim at value, let's say 50%, take that away from 100 and you're left with 50%. Now a second claim is worth say 50%. Well, you take that second claim (50%), and you apply it to your remaining 50 that was left over from your first claim. So, 50% of that initial 50 equals 25%. So claim one rated at 50, and claim two is rated at 50, but it's only adding 25% to your overall score. 50 plus 25 equals 75, but the VA will round to the nearest 10, which in this case goes up to 80%.. So two 50% ratings equals 80%. Now, different scenario, one claim equals 50%, claim 2 equals 10%, claim three equals 10%. First claim is at 50, second claim 10% of remaining 50) is five points, so 55 total so far (which will round up to 60%, but we need to add all other claims before rounding), claim three is 10% (of remaining 45% would be four and a half points), add the 50, the 5, and the 4.5, you get 59.5 % which rounds up to 60% overall rating. That's why one person can have 50, 10 and 10, be rated at 60%, and another could be rated at 50 and 10 and be at 60% also. Take each claim percentage, apply it to whatever is left over from 100 after your initial claim, add them together and round up or down to get your rating. To get 100 either have many claims or high percentage claims. Use secondaries for big assists.

There is a chart on the VA website. You order your disabilities from highest to lowest and individually use the chart to find out. Example you start with 50% and have 3 10s. You find 50% collum and 10 row where they intersect that is combined rate. Then do it again and again and will have final percentage. The round to nearest multiple of 10

It's not how sick you are but how well you are. Your second and more percentages come off your wellness. Even if you have two at 50% your second one is 50% of 50% or only 25. so your still 25% well so 20% of 20 is only 5.
